[llO? Authorization was given to seek legal counsel on the C.M.W.D. proposal for merger of the two water systems to determine the legality of such a merger in an amount not to exceed $500.

The Public Works director reported,that those changes requested by the Council at the previous Counci meeting had been made, deleting underground utility district, and the street improvement district to includ only the northerly .one-half of Cannon Road. between El Arbol and Carlsbad Boulevard, with a travel lane of 12' outside the district on the southerly side of the stree between El .Arb01 and Carlsbad Bouleva..rd.

The Council accepted the Environmental Impact Report which had been heard by the Planning Commission
on. October 24th.
Following discussion, the following resolutions were presented and adopted by title only.
RESOLUTION NO. 3010. A RESOLUTION OF THE CITY. COUNCIL OF THE. CITY OF CARLSBAD DETERMINING THE RESULTS OF HEARING,. OVERRULING PROTESTS, DETERMINING THAT THE PUBLIC INTEREST, CONVENIENCE AND NECESSITY REQUIRE CERTAIN WORK OR IMPROVEMENT SUBSTANTIALLY AS SET FORTH IN REPORT ON PROJECT UNDER THE MUN'ICIPAL IMPROVEMENT ACT OF- 1913, AS MODIFIED BY THIS RESOLUTION; .DETERMIN- . RESOLU'TION NO. 3013. 'A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD AWARDING CONSTRUCTION CONTRACT.
T.he construction contract was awarded to the low bidder, R. E. Hazard Contracting Company, in the amount of $187,238.85. The City Engineer stated 'that the contract price is on a unit basis.
Resolution No. 3011, establishing underground utility district was ordered filed with out action.

The City Attorney addressed the City Council regarding the status of current legislation on the sub- ject. He indicated that the situation still remains open and basically unresolved. T He recommended to the Counc.il that in considering the following ordinance and resolutions they keep in mind the possibility of changes and amendments to these documents in the near future.
