Place of Meeting: Council Chambers 1- ROLL CALL : 2- Agenda Bill #3123. Amended Land Use Element of I371 the City of Carlsbad General Plan. Mayor Frazee announced the meeting was a public hearing which had been continued, and th.at the Council would hear staff reports on each item being considered and then testimony would be taken from persons wishing to speak. Mr. Don Agatep, City Planning Director, using plot lay-outs on the overhead projector, gave the basic issue of each of the items and the recommendations of the Land Use Committee and the Planning Commission, as well as staff recommendations and justification. Itemi#l. RLM Density. A question was raised by Mr. John McCoy regarding the density allocation for "Low-Medium Density" Residentia areas (0-4 DU/acre). In the developed portion of the city with R-1-7500 zoning, it would be possible to obtain a yield of 5.81 under the most ideal situation. However, by using a standard area reduction of 25% for public s the yield would be 4.3 7500 sq. ft. lots per acre. The Land Use Committee and the Planning Com- mission have recommended the 0-4 density allocation. However, the issue raised by Mr. McCoy was not discussed at the Commission 1 eve1 . The staff recommended that a 4.5 density allo- , cation would be an equitable solution for thos areas within the City's R-1-7500 zone district on the basis of existing streets and the 25% area reduction for public streets would not apply as it would in newly developing areas. Mr. John McCoy spoke in support of the 4.5 dwelling units per acre in R-1-7500 zones. The Council.concurred with the staff recommen- dations. Item #2. Mr. A. W. Stone has requested that his property at the southwest corner of Chestnut Avenue and Interstate 5 be allocated a density range that would permit 18 units.. ' The existing zoning is R-3 with an 8-21 densi recommended. According to current recommen- dations for R-3 this would have to be the "High Density" Residential category .(16-24 DU). The Land Use Committee and Planning Commissio have each recommended the density range of 4-10 dwelling units per acre. .The staff recommended that the designation of RMH ( 10-16 DU/acre) that exists on the north side of Chestnut Avenue be continued souther1 to include all of the existing R-3 parcels .in thatarea -on the basis of compatibility with existing developed parcels. .,- . . . ... . ... .-. - .B kef: CITY OF CARLSBAD mNCf LME I -2- July 15, 1974 Mr. Stone spoke in support of the RMH desig- nation. The Council concurred with the staff recommen- dations. Item #3. Mr. Bill Savage has .requested that RH classification (16-24 DU/per acre) be placed on his property instead of RM (4-10)- and RLM (0-4) which is now shown. The property under discussion lies just north of Batiquitos Lagoon and east of 1-5. Both the Land Use Committee and Planning Com- mission recommend the area remain RM and RLM. The staff recommended the area remain as shown also on the basis that such densities are con- sistent with adjacent properties already in th City with approved Master Plans. Further, one of the guidelines of the adopted Open Space Element suggest that future options be kept open to develop Batiquitos Lagoon as a scenic and multi-purpose recreation facility and to encourage establishment of a regional park. RH designation could substantially diminish these options. Mr. Savage spoke at length in support of his request for RH designation. It was the concensus of the Council that the recommendations of the staff be sustained and land use des.ignations of RM and RLM be retain Item-#4. La Costa Land Company has reque , ted a combination RH/O district on the south side of Costa Del Mar Road and east of El Camino Real to permit development of executive offices at the main entrance to La Costa to provide single source'information regarding real estate, recreation and other activities in the La Costa area. Both the Planning Commission and Land Use Com- mittee recommended the area remain as R-H. The staff recommended that the area be desig- nated as the combination district RH/O on the basis that this is the most suitable area to locate a consolidated information center far the entire La Costa area. M:r. Fred Morey, representing the La Costa Land Company, spoke in support of the RH/O desig- nation. .. The Council concurred with the recommendations of the staff. .-.,I- . . ... . . . Item #5. Mr. Jerry Rombotis has requeste that density allocations for a portion of Laguna Riviera with an approved Master Plan be changed to basically reflect the 'densities approved by said Plan. Specifically, it is requested that the 8-1/2 acre parcel south of Park Drive be designated as "Medium High Density" Residential (10-16 DU/acre) and the %a.lance'of the 'P-C area as ."Medium De'risityl" Residential (4-10 DU/acre). 160 - ~ ~~ ~ - .. The staff recommended that the requested allo- cations be changed as requested on the basis of using a defined "density transfer" program. It was also recommended that until that 'program is developed, the allocations should relfect the densities approved on the Master Plan. Mr. Rombotis spoke in support of his request. Mr. A.J. Skotnicki, City Councilman elect, inquired about parcel 'IC'' which goes to the lagoon and for which a temporary fill permit was issued some time ago. The staff:informed Mr. Skotnicki that a temp- orary per'mit was issued to use the land as a storage area for dirt and that its removal would be accomplished on demand by the City. Following discussion by the Council a motion was made accepting the recommendations of the staff. Item #6. Mr. Oakley Parker has reques,ted that his property at the northwest intersectio of Adams Street and Chinquapin Avenue be given an increased density allocation to match the approved Specific Plan densities. There are 27.4 existing dwelling units per acre and the approved density for the vacant parcel is 33..6 dwelling units per acre. The proposed Land Use Plan -recommends "Medium-High Density" Residential (10-16 DU/acre). Both the Land Use Committee and the Planning Commission recommend "Medium-High Density" Residential. The staff recommendation supports "High Densit Residential on the basis that it would be more in keeping with the approved densities of the Specific Plan which has been approved by the Counci 1. Mr. Parker addressed the Council and stated the proposed development was planned to avoid impacting Adams Street by developing toward the center of the parcel and fencing the perimiter facing Adams. Following discussion, a motion was made to accept the recommendations of the staff. li RECESS: Mayor Frazee called a recess at 8:50 p.m. and the meeting reconvened at 9:00 p.m. i B At the suggestion of the staff, the portions of the report regarding Bedroom Densities, Inner City Densities, and the RMH and RH I Density Ranges were deferred to a later time. In response to the request of many property owners that a more intense land use designation be considered on Pi0 Pico, north of City Hall because of the impact of Interstate 5, this area received detailed consideration. The Land Use Committee and the Planning Com- mission concurred that eventually the land uses will intensify in this area, but recommended no action be taken until precise development plans are submitted.because of the potential impact of commercial and office uses on the existing residential neighborhood. .The staff recommended that specific parcels be Mr. Galen Nornhold, a. property owner in the subject area, urged a more intense land use designation along Pi0 Pic0 Drive. The Council discussed the matter and considere those parcels being recommended as Professiona Administrative and Related Commercial individ- ually. It was agreed that oneparticular parce at Pi0 Pic0 and Buena Vista be deleted from such designation. Item #8. Car.lsbad Raceway Area. The their land north of Palomar Airport Road, with the exception-of the proposed commercial desig Their reason being the impact of the Raceway, the Airport, and the surrounding proposed industrial uses. The owners of the Carlsbad Raceway have requested their property be designated as somet.hing other than residential for .the same reason. The Land Use Committee recommended that desig- nations remain as shown, while the Planning Commission. recommended the Raceway property be designated "Recreation Commercial" and the subject Carrillo property be "Non-Residential Reserve. Following discussion, a motion was made to accept the recommendations of the staff. Item #9. North Shore of Agua Hediond'a. Major developments pending in this area have requested a density of approximately 14 dwell- ing units per acre or Medium-HighDensity Res- dential (10-16 DU/acre). Many surrounding property ow.ners have requested that proposed The Land Use Committee and Planning Commission as well as the staff agree that higher density allocation may not be justified because of the proposed Scenic Route designation on Adams Street, the steepness of the terrain and the family homes. Mr. Nick Sauer, representing nine(9) property owners for a total of 13 acres, urged favorabl consideration of a Medium-High Density. Mrs. Jane Skotnicki, member of the Land Use C.ommittee, opposed Med.ium-High density for the area because of circulation. The Council discussed the matter and an impass was reached. Action was deferred. Item #lo. The owners and potential devel opers of the area known as the Rinker property have requested that a portion of their propert be designated as "Community Commercial." It is presently-designated as "Professional and Related Commercial." The area being consid- ered constitutes 866 feet on the northerly portion,,with the remaining portion of 500 fee designated as "Professional-Administrative." The Land Use Committee and Planning Commission have recommended the area remain as shown. The staff recommended designation of "Communit designation to the west of El Camino Real, with the stipulation that the major orientatio of this commercial area be to Marron Road, based on the impact of commercial uses around Marron Road by approval of a community shoppin center to the north. By orienting the commer- cial area to Marron Road,a natural cut-off for any further expansion of commercial uses southerly on El Camino Real is created.
