ROLL CALL :
A. Legislation affecting Elections.
1. Agenda Bi 11 #3282. Candidates' Fi 1 ing Fees and Qualification Statements.
The City Attorney reported on the changes in the Election Code regarding filing fees, which pro- vides that if a filing fee is required by the City a reasonable alternative must be provided. In the City of Carlsbad in lieu of paying a $25.00 filing fee a candidate may submit a petition containing the signatures of four registered voters for each dollar of the filing fee. It is necessary for the City of Carlsbad to act to amend Section 1.12.010 of the Municipal Code to bring it into accord with the new law, or repeal the section of the code eliminating any filing fee.
Following discussion it was the decision of the Council to retain the $25.00 filing fee and the following ordinance was introduced for a first reading:
Reading of the text of Ordinance #1175 was waived by the unanimous consent of the Council.
ORDINANCE NO. 11 75, AMENDING SECTION 1.12.010 OF THE CARLSBAD MUNICIPAL CODE TO PROVIDE FOR THE SUBMISSION OF A PETITION CONTAINING SIGNATURES OF REGISTERED VOTERS IN LIEU OF A CANDIDATE'S FILING FEE, was introduced for a first reading.
The City Attorney also reviewed the new State law which now allows the Council by ordinance to in- crease the size of the qualification statement from 200 to 400 words. The same law also provides for the inclusion of materials in addtion to the qualification statement in the official ballot mailing. Further, under the new law the City can no longer require a deposit in advance for the cost of printing the qualification statement, but may bill each candidate for his prorata share of the actual cost of printing and handling after the voters pamphlet has been printed and distributed.
It was the Council's decision that the length of the qualification statement remain at 200 words, and that no additional material be allowed in the official ballot mailing.
Council vacancy. Mayor Frazee stated the main purpose of the meeting was to consider filling the vacancy on the Council. He referred to the correspondence received by him and other members of the Council in regards to the appointment of a Council member.
Executive Session. The Mayor called an executive session at 5:20 P.M. to discuss filling the vacancy on the Council.

The meeting reconvened at 6:28 P.M. with all members present.
The Mayor announced the executive session was called for the pupose of discussing an appointment to fill the vacancy on the Council. No decision was reached at this meeting and the matter will be considered I) further at the next regular meeting of the City Counci-.
Adjournment. By proper motion the meeting was adjourned at 6:30 P.M.
