Place of Meetina: Council Chambers ., ROLL CALL: The Mayor announced this meeting was called to con- sider taking a position on a proposal pending before the Board of Supervisors that the County of San Diego act as lead agency with regard to the proposed Macario Refinery. Mayor Frazee stated he had filed a letter with the Fair Political Practice Commission and he would re- frain from any discussion on this matter until he has received a ruling as to whether his interest in the utility company's stock represents a conflict of interest. Further, if it is determined that a con- flict of interest exists it could open up the larger question as to his function on this body. [37] Macario Refinery. The City Manager gave a background report, stating in order for the City to proceed the property would have to be annexed to the City of Carlsbad. An application for annexation was submitted by Japatul and filed with the Local Agency Formation Commission. The application has not been processed by LAFCO as they are waiting for the City to determine the land use as well as the submittal of the EIR. The staff has held meetings with representatives from Japatul and it was agreed that a specific plan would be submitted, which will be incorporated with the General Plan. The staff is of the opinion that an outside firm should be con- tracted to prepare the EIR, and an attempt is being made to contact outside firms. The City Manager further stated he reviewed Super- visor Walsh's statement something other than the refinery as it has significant implication. The processing that has been done by the City so far should be made a part of the hearing tomorrow before the Board of Supervisors. The issue that the Council is faced with is "what is the proper role of the County when it affects an individual City, and who is the lead agency"? The City Att'orney cited legal reasons why in his opinion the City of Carlsbad has the lawful right to be the lead agency, pointing out the governmental agency wi.th the greatest concern is usually the lead agency. Vice Mayor Chase asked for comments from the members of the Council and Council appointee Mary Casler. It was the concensus of the members the City of Carlsbad should have representation at the Board of Supervisor's meeting on Tuesday. L. W. Rash, a member of Community Cause, addressed the Council and stated he was speaking as an indi- vidual and felt the refinery decision would .be best determined by the City of Carlsbad. By proper motion it was agreed that the City of 1 Carlsbad have representation at the meeting before I the Board of Supervisors on Tuesday, and that the City of Carlsbad present the position that the City be the lead agency on the Macario Refinery. It was agreed that Cmn. Chase, the City Attorney and the City Manager would represent the City before the Board of Supervisors on this matter.
