AGENDA BILL #5m - COORDINATED PROGRAM OF PROPOSED PUBLIC WORKS. - FINDING OF GENE'RAL PLAN CONFORMITY. ,_ .* x The City Manager gave a brief introduction of the matter stating it had been continued at the re- quest of Councilman Skotnicki. lacked adequate background info; as well as the feeling that some of the items should not be in- cluded on the list. He continued by stating he felt it was merely a list of everybody's projects and not a coordinated program. In conclusion he stated he felt the projects on the list should be related and shown in time sequence. In addition, he expressed the need for defining the meaning of. "Conformity with the General P1 an". item be returned to staff for comprehensive revie of those public works i tems that are significant, .throwing out those that are inconsequential and insignificant, and after review, to return to the Planning Commission with recommendations as to whether each individual project does in fact con- form with the General Plan and with the Capital Improvement Program, which is supposedly based on the General Plan. The motion died for lack of a second. 2. AGENDA BILL #5120 - SALE OF POLICE PISTOL "l' RANGE PROPERTY (Old Carlsbad Dump 'Site). The City Manager gave the staff report on the to execute said agreement. [lo51 3. AGENDA BILL #5254 - PARTICIPATION IN FEDERAL - SURPLUS PROPERTY PROGRAM. AGENDA BILL #5255 - GROUP TRAINING AND POLICY DEVELOPMENT (Co'unci.1. Team Development). The had In te Mr. City Manager gave a brief report stating he recently been contacted by Mr. Emerson of 'the rgovernmental Training and Developient Center Emerson indicated it would be desirable to be aware of Council's intentions re the training to enable them to more efficiently schedule their times. Councilman Skotnicki briefly referenced his pre- vious report on the matter and again expressed his feeling that the training ShOUild be received prior to the 1978 Election. Council discussed the proposed training and whether it would be more beneficial before or after the March 1978 Election. It was moved that some preliminary negotiations be made by the City Manager to indicate to the Intergovernmental Training and Development Center of Council's need and desire to contra-ct for the training some time in 60 to 90 days following the March 1978 Election. The motion received a second. Following brief discussion relating to the time period involved, and with the concurrence of the s'econd, the motion. was amended as follows: That the City Manager-be directed to advise Mr. Emerson of the Intergovernmental Training and Development Center that Council intends to con- tract for their services for this. training within 90 days following the March 1978 Election, with the proviso that a definitive date will be es- tablished soon after the 1978 Election. [48] 5. AGENDA BILL #5257 - 1978 GENERAL MUNICIPAL ELECTION. The City Clerk reported briefly on her recent attendance at the League's first meeting for City Clerks, which focused on the changes in the election laws. She then stated she needed Counci guidance on a few matters relating t,o the electio The first i tern being the hours that the polls wil be open on Election Day, in that Cities have the option of either 7:OO A.M. to 7:OO P.M. or 7:OO .. A.M. to 8:OO P.M. Following brief discussion, it was moved that the hours of the polls for the forthcoming Municipal Election be set as 7:OO A.M. to 7:OO P.M. The City Clerk then Stated the next item for con- sideration pertained to the printing of Candidate Statements which are to be included in the Voter' Pamphlet and mailed with the sample ballot to each voter. The Federal Voting Rights Act of 196 requires that a Spanish trans1ati:on shall be pro- vided; however, a candidate may not be charged for printing the Spanish translation unless they have requested said translation. After discussyon, the following Resolufion was 3 adopted: RESOLUTION NO. 5260, ADOPTING REGULATIONS FOR CANDIDATES FOR ELECTIVE OFFICE, PERTAINING TO MATERIALS SUBMITTED TO THE ELECTORATE AND THE COSTS THEREOF. \ The City C1er.k then stated Council had previously established a $25.00 filing fee, and questioned if Council wished to retain the filing fee. It was moved that the $25.00 filing fee charge be retained. [114] 6. AGENDA BILL #5249 - ZONE CODE AMENDMENT - PRIVATE SENIOR HOUSING (ZCA-85). The City Manager stated.this item was continued for further Council discussion, and there was no additional staff report on the matter. 0 Council discussed the desirability of including a requirement for a rent control contract, as well a*s the desirability of including discretionary c'ontrol as to the number of projects that would be allowed in the City under this type of develop ment. Council also expressed concern relati've to sub- section (4) on page 2 of the proposed Ordinance, which would require the Housing Authority to in- sure compliance with the limitations not only by the tenants placed by the Authority, but also the tenants from the general public. Questions were raised as to what rent the general public would pay, and what affect the additional tasks would have on the Housing Authority. Also suggested was a cond-ition setting a maxirrium income limit for tenants. Council directed staff to return to Council with a report based on their discussion at this meet- ing. Councilman Skotnicki requested that staff also .- consider in the report the possibility that if nc limits are set on income, a senior citizen, 62 years of age and in good health, wil.1 probably have a vehicle. In a case like that, the reducec parking requirements would not be satisfactory. )31 [93] 7. AGENDA BILL #5158 - Supplement #4 - FIRST PHASE SEWER ALLOCATION SYSTEM - REVISIONS. Staff stated this item was back for documents. The following Resolution was adopted:. RESOLUTION NO. 5259, REVISING THE FIRST PHASE TION NO. 5199 PURSUANT TO SECTION 18.05.030 OF TI CARLSBAD MUNICIPAL CODE. PHASE SEWER ALLOCATION SYSTEM ADOPTED BY RESOLU- ( + .L 1 CITY OF CARLSB -4- November 22, 1977 1111 D e RECESS: Mayor Frazee called a recess at 8:51 P.M, and Council reconvened at 9:05 P.M. with all Council members present. Mayor Fraz:ee relinquished the Chair to Vice-Mayor Lewis for the next item due to his affi-liation with the company. 8. AGENDA BILL #5258 - SAN DIEGO GAS AND ELECTRI( PROGRESS ON AIR MONITORING. The City Manager stat.ed that staff had no report. This was a request from San Diego Gas and Electric to report to Council concerning the progress of the development of the fifth unit, air monitoring problems connected with the Encina plant, and current data on the activity of reducing fallout from the plant. He then turned the matter over to SDG&E for their report. Mr. Bob Lacy, Manager of Generation Engineering, SDG&E, addressed Council. He stated they would be reporting on measures taken and update status of the falloutlabatement program, status report as to where they stand in relation to meeting the conditions of the Ordinance, as well as seek- ing clarification regarding the intent re the use of. the tall stack. H,e then introduced Mr. Menzer, Engineer in the L"icense and Environmental Department of SDG&E. Mr. Menzer reported on the measures taken with regard to resolving the fallout abatement. In this regard he explained the method and purpose o.f the major turbine overhauls, boiler overhauls, condensor tube scraping .and the electric produc- tion performance monitoring program. Mr. Jim Heindrichs of SDG&E then reported to Council on their testing program. Showing trans- parencies titled as follows, he explained each: 1. History and Purpose of Encina Fallout Test 2. What is Fallout 3. Does all Fallout Cause Damage 4. Why do Just the Large Particles Cause Damage 5. What a Cenosphere looks like 6. Extent of Fallout 7. Fallout Control Methods 8. Additional Tests 9. Claims (Damage) He concluded his. portion of the report by stating the acidic fallout, which causes darn.age, has been reduced by 95% due to this program and with the aid of an additive which contains manganese and magnesium. The Health Department is currently running tests as to qny possible ill effects due to manganese. He further stated the additive achieves the same results with or without the manganese; however, using it seems to provide better efficiency in the operation of their equip ment. Program GglS6NCfkMEE I V -m m '4 ~S-pP f"!. g- GAP; SF; fi\ <-*, .I t Wk kL -%#T-\g - 2 -5- November 22, 1977 " - Mr. Ted Liston of the Stanford Research Institut then addressed Council re preliminary test re- sults for determining ambient level of manganese Mr. Lacy then gave the final portion of the report with the aid of transparencies showing portions of the Ordinance and their compliance with those conditions. He then reviewed the necessary procedures for tie-ins to the tall stack. He stated there was a problem in that construction requires units to be tied in prior to unit five being tied in and unit five has to be tied in prior to tests being conducted. Further, he stated it is desirable to place the tall stack in operation as soon as possible. Therefore, he requested a Resolution clarifying Council's intent,ion with regard to use of the tall stack before it is placed in commercial service. Council then recognized Mr. William Simmons, Air Pollution Control District Officer. Mr. Simmons stated his greatest concern is about the health affects. He stated the abatement order will probably expire of its own accord or will be extended a few months to enable further tests. In any event, he could not say at this time that the problem has been solved in that he would need to see the results from the Health ':Department. However , he indicated it would be in the best interest of the community to use the tall stack. Council discussed at length the Ordinance condi- tion which requires the finding .from Council and the Air Pollution Control District Officer that the fallout problem has been reduced prior to allowing use of the tall stack. Council directed staff to review the San Diego Gas & Electric Specific Plan Ordinance and report back to Council at the next meeting as to courses of action- Council could take. Vice-Mayor Lewis returned the Chair to Mayor Frazee. CTTY COUNCIL ADDITIONAL BUSINESS: Council authorized Councilman Skotnicki to be the voting delegate to attend the National League of Cities Conference in San Francisco.
