Date of Meeting: January 31 , 1978 Place of Meetin : Council Chambers ROLL CALL: Mayor Frazee arrived at 5:28 P.M. [92] PHASE I11 EXPANSION OF THE ENCINA GjATER POLLUTIO CONTROL FACILITY. The City Planager gave a brief introduction stati the request for the meeting was due to the fact that the hearings and staff meetings relative to B the Coastal Permit on the Encina Water Pollution Control Facility are scheduled so that if dis- cussed at the next regular meeting, time con- straints may prohibit adequate input. The Public Works Administrator g'ave the staff report outlining his Memorandum to the City Manager dated January 31 , 1978. He outlined the condition as proposed by State staff, and possible effects on Carlsbad. He then reference two wall exhibits showing the areas of Carlsbad designated as agriculture and, steep slope. He concluded his report by referencing the various courses of action Council may take on the matter Council discusse,d the proposed condition and expressed the feeling that the first portion appeared to present no problems to Carlsbad. Council questioned the meaning of "population p%ojections" in the second portion of the pro- posed .condition. Also discussed was the portion that would require unanimous agreement by the members of the Joint Powers Agency to, accept the permit prior to commencement of any construction The greatest concern expressed by Council was relative to the portion which would prevent land in agriculture and steep slope areas from being ''assessed for benefit". This would be extremely restrictive as to methods of financing for im- provements. Also discussed was the amount of additional capacity that would be realized from the Phase 111 expansion and the fact that Encinitas did no need additional capacity. They are merely complying with federal regulations re secondary treatment; and therefore, will not agree to any conditions being imposed. m, Council acknowledged acceptance of the condition with the proviso, if possible, that the provisio for "assessed for benefit" paragraph, be eliminat from the condition as finally imposed for reason that financing plans would be unduly complicated and difficult to arrange; and with the proviso that the definition of agriculture lands and slo areas be the subject of further negotiations at staff level. Further, it was moved that Carlsbad support the position of Encinitas in their request for ex- clusion from the condition to be levied in con- nection with this permit. I - I COUfSCf %ME!
