Roll Call: 8' Mayor Packard-stated the purpose of the meeting was to conduct a public. hearing. on the.proposed Second Phase Sewer Allocation System. Prior to the public hearing, Mayor Packard requested Council consideration of proposed Memorandums of Understqnding. with two employee groups. In accordance with the Council .Policy Ordinance it was the consensus of Council -to act on the i terns. [74] 1. AGENDA BILL #5926 - MEMORANDUM OF UNDER- STANDING WITH CARLSBAD CITY MI'SCELLANEOUS EMPLOYEES' ASSOCIATION. ¶ Council adopted the following Resolutions: RESOLUTION NO. 5853, ADOPTING A MEMORANDUM OF Motion UNDERSTANDING BETWEEN REPRESENTATIVES OF Ayes MANAGEMENT AND THE CARLSBAD CITY MISCELLANEOUS EMPLOYEES' ASSOCIATI.ON. @ RESOLUTION NO. 5854, ADOPTING THE SALARY PLAN FOR EMPLOYEES REPRESENTED BY THE CARLSBAD CITY MISCELLANEOUS EMPLOYEES' ASSOCIATION FOR FISCAL YEAR 1979-1980. AGENDA BILL #5927 - MEMORANDUM OF UNDER- 'STANDING WITH CARLSBAD- FIREFI.GHTERS" ASSOCIATIOF Council adopted the following Resolutions: RESOLUTION NO. 5851, ADOPTING A MEMORANDUM OF UNDERSTANDING BETWEEN REPRESENTATIVES OF MANAGEMENT AND THE CARLSBAD FIREFIGHTERS' ASSOCIATION, INC. RESOLUTION NO. 5852, ADOPTING THE SALARY PLAN FOR EMPLOYEES REPRESENTED BY THE CARLSBAD FIRE- FIGHERS' ASSOCIATION, INC. FOR THE 1979-1980, 1980-1951, AND 1981-1982 FISCAL YEARS. Councilman Skotnicki requested that the City Manager make available to the news media all the information relative to these agreements to insure their receipt of factual information as to the contents of these Memorandum's of Understanding. AGENDA BI.LL #5740 - .Suppledent #2 .- SECOMD PHASE SEWER 'ALLOCATI.ON 'SYSTEbl., 1 I As a matter of introduction, Councilman Skotnicki explained the history of the sewer shortage and resulting moratorium for those in the audience who were unaware of same. The City Manager then gave a brief report on the matter stating upon finalization of the Grove lawsuit, and an updated report from the Public Works Administrator re current flow rates at the plant, there is a possibility of having approximately 1200 EDU's available. I f Dorothy Doan, 1501 Westcliff Drive, Newport Beach, representing Pelican Properties, addressed Council. . Ms. Doan .expressed opposi- tion t.o..the proposed lottery.' In addition; she requested clarification on page 6 wherein . people would be allowed.to progress and not be guaranteed s'ewer. She also requested. reconsideration of the maximum limit of EDU'.s allowed in the high-dens.ity.residentia1, and suggested consideration of project phases. .. Jack Kubota., P. 0. Box 1095, Carlsbad, addressed Council. .Mr. Kubota expressed- oppo- sition to the lottery and. to the section which excludes projects approved on a septic system. ! .. I I I i ! July 23, 1979. 7:OO P.M. - if R Nick Banche, 3464 Ridgecrest, Carlsbad, attorney representing Highland Company and Tiberio Peacoc addressed Council. He spoke in' opposition to th proposed lottery and suggested that each develop ment be looked at on an individual basis. He 'suggested that Council first consider the number of final maps, tentat.ive maps, number of improve .rnents completed- and hardship on current owners wherein a- few are supporting open areas proposed for many, Mr. Larry Hunts , 501 Chinquapin, Carlsbad, Hunts spoke in opposition.to the lottery and suggested it be simi-lar to the First Phase Sewer Allocation System, and that developments be based on merit. He also expressed concern' about the 25 limit in any particular category and suggested it be based on phasing. Mr. Bob Allan representing Standard Paci'fic of San Diego, '7906 Convoy Court, -Sari Diego; addressed Council in opposition to the lottery. Ms. Jean Jensen of Land Planners, 2910 Jefferson Street, Carlsbad, addressed Council. Ms, Jensen expressed opposition to the. delay imposed for projects in the redevelopment .area, but not . ' addressed Council' on. behalf of Papaga'yo.. -Mr. .within the core redevelopment area. .- RECESS: .Vice-Mayor Skotnicki called a recess at 8:29 P.M. and Council reconvened at 8:43 P.M.. . with all Council members present. @ Council recognized Mr. Jerry Elder; 1286.1 Camini de las Olas, Del Mar. Mr. Elder stated.he owned. property located behind Von"s and next to Tanglewood. He stated the p.rOPertY is not included in the infill area map, and requested that it be included in that there appears to be no other area within which it fits. Since no,one else wished to speak, Vice-Mayor Skotnicki closed the public hearing at 8:47 P.M. , ,Vice-Mayor Skotnicki recapped the major points expressed by those addressi:ng Council and suggested that Council first discuss the lottery. The City Manager indicated for Council info that a system could be devised based on either a requirement of all discretionary approvals or on the lottery, or on a combination of both. The current p.roposed system. does not requir-e all discreti-onary approvals, Council discussion reflected opposition to the lottery, and expressed a desire for a system that would determine allocation priority on another method. such as. discretionary approvals and benefit to the community, Council also indicated a desire for the system to be reworked and re-evaluated as to the figures in the event the larger amount of EDU's become available.
