13': AB 115970 - ZONE CODE REQUIREMENTS FOR FINDINGS AND REFERRALS BACK TO PLANNING COMMISSION.
Council adopted the following Ordinance:

ORDINANCE NO. ,9530, AMENDING TITLE' 21 OF THE CARLSBAD MUNICIPAL CODE BY THE AMENDMENT OF SECTIONS 21.36.040, 21.38.110., 21.50.130, 21.50.140 TO AMEND THE REQUIREMENTS FOR REFERRALS OF
CERTAIN MATTERS BACK TO THE PLANNING COMMISSION AND TO NEND PROVISIONS FOR FINDINGS BY THE CITY COUNCIL ON ZONE CHANGES.

The following item was removed from order at the request of the appellant and heard at this time:
18. AB $15978 - REQUEST TO ADDRESS COUNCIL MRS. ELMER V. WILKE.
Council recognized Dorothy Wilke, 2606 Jacaranda Avenue, Carlsbad, CA. ' Nrs. Wilke addressed Council essentially as set forth in her August 12-, 1979 letter, and presented Council with pictures of the subject and surrounding lots. Mrs. Wilke was provided a copy of the La Costa R-1-15 Zone Map which indicated existing sidewalks and projected sidewalks in the subject area.
Council agreed that continuations of the . existing sidewalks (when future homes were built) were an acknowledged element of the design of the subdivisions, as well as providing important safety. Seaff pointed
out that a lien contract would satisfy the Municipal Code requirement for sidewalks.
A motion was made to uphold the decision of the City Engineer and require the in of sidewalk as a condition of the Wilke
building permit.
