Frank Mannen, Assistant to the City Manager, gave. an additional report on the implementation of the legislation. He also stated the fees previous1 collected from the developers could be spent by the school districts for m'any purposes; however, now legislation requi,red the fees be spent only for building temporary facilities.
David Courson, 7228 Mimosa, Carlsbad, .expressed frustration with the school situati'on, and queried the proper course of action to follow to attempt to remedy the problem.
Lois Humphreys, 3337 'Cadencia, Carlsbad, referenced the existence of a Public Facilities Element of the General Plan, and queri-ed the issuance of building permits if facilities are lacking. 1 Staff and Council again explained legislation, and the need for changes at the State level. In addi- tion, it was noted as to problems for financing any public facilities due to Proposition 13. Also suggested was the possibility of uti'lizing the year-round school schedule. The collection of fees from developers was explained. It was also noted that if a Schopl district would, or could, refuse to accept further students due to lack of- capacity, it would then. place Council in the posi- tion to deny applications for development due to lack 'of school facilities.
The City Manager indicated, and Council concurred, that staff would meet with representatives of various school districts, and prepare a report as to status, and steps to be taken and people to contact re the school problem,
G'uy Casey, 2122 Subida Terrace, Carlsbad, stated he was an airline pilot and member 0.f the Board of Directors for the Airline Pilot's Association. He referenced Palomar Airport and its rating as a general avi ation airport and expl ai ned possible problems which may result if airport expa.nds. He suggested that the City exercise any and all possib controls over the airport to keep status as is, and to-prevent additional noise problems.
Council indicated their desire to retain the status of the airport as is, and to discourage the status changing to that of a major commercial airport.
Linda Hancock, 2894 Luciernaga Street, Carlsbad, questioned the proposed date for completion of the extension of Alga Road to Melrose. In addition she expressed concern about lack of speed limit signs on El Camino Real, and the speeding on Alga.
Mr. Fred Morey, 2618 Abedul, Carlsbad, stated the current proposed date for completion of Alga to Melrose is approximately 1-1/2 years.

The City Ivlanager gave a brief report on the matter as contained in the Agenda Bill. He referenced a map showing the areas within the Coastal boundaries and the areas affected by the Mello Bill.
Council discussed the'matter and indicated agreemen
with the proposal of the State Coastal Commission to pay for the consultant to prepare Carlsbad's LC.P and to pay for a City staff person to assist
in the preparation.
Council directed staff to respond favorably to Mot i on
Coast Commission proposal to prepare implementing Ayes recommendations for Counci.1 action.
ADDITIONAL BUSINESS:

Councilman Lewis .questioned the status of the
previously discussed merger of the water systems.
Th-e 'City Manager stated the report had been receive from the financial consultant, and that staff is currently reviewing the report.
Council directed staff to place the report on an Motion early agenda for Council consideration. Ayes
City Manager's Position
The City Manager stated Mr. Ande,rson, the consultan requksted, an opportunity to meet with Council to review the results of the recruitment.
Council concurred that 2:OO P.M. on Monday; Decembe 3, 1979, would be a convenient time.
CITY ATTORNEY ADDITIONAL BUSINESS:
The Assistant City Attorney, Dan Hentschke, distri- buted to Council a letter from County Counsel re- questing the City's Amicus Curiae support in the . case of Rancho La Costa v. County of San Diego.
Mr. Hentschke gave a brief history of the -events leading to the case, and expressed the feeling that such a case could .adversely affect the City if it establishes a precedent relative to Inverse Condem- nation.
It was moved that the request be filed. Motion The motion failed for lack of a majority
