Date of Meeting: April 22, 1980 Place of Meeting: Council Chambers I ROLL CALL: Mayor Packard called the meeting to order and stated the first item on the agenda dealt with redevelopment, and should be discussed by the Housing and Redevelopment Commission. ,I (28) HOUSING AND REDEVELOPMENT COMMISSION Council adjourned at 7:Ol P.M. to the Housing and Redevelop- ment Commission and reconvened at 8:33 P.M. with all Counc i 1 members present. RECESS: Mayor Packard called a recess at 8:33 P.M. and Council reconvened at 8:53 P.M. with all Council members present. 1 (47) AGENDA BILL #6197 - PROPOSED GRADING ORDINANCE. The City Engineer, Les Evans, began the staff report by outlining the sources used for preparation of the proposed ordinance. -He then referenced Section 11.06.010 of the proposed ordinance and explained the goals of the ordinance as contained therein. Mr. Evans then explained the portion of the ordinance which relates to excavations, and briefly outlined those excava- tions which,woul d be exempt from the permit requirement. Council discussed whether the exempt amount of excavation should be 100 cubic yards or 250 cubic yards, and requested further staff report on the matter. Mr. Evans then explained the portion of the proposed ordi- nance which relates to fills and erosion protection and erosion control for the Coastal Zone. In this regard, he stated. the Erosion Control for the Coastal Zone portion would prohibit significant grading on hillsides with a slope greater than twenty-five persent (25%). 8 Council queried whether the ordinance addressed setbacks from bluffs and setbacks from fill or cut slopes and requested the ma,tter be further reviewed by staff. In conclusion, Mr. Evans identified the following issues for Council consideration: 1. 'Question of a hillside protection policy throughout the City. 2. Question of whether to apply the Coastal Zone Erosion i Protection measure throughout the City. 3. Question of whether to prohibit clearing of natural vegetation without a permit. 4. Question of whether to require supervised grading which will add to the cost of designing and building a subdivisio and will then increase the cost of the home for the buyer. I c \ 1 gitp of QLarl§ibab COUNCIL : -. Council recognized Mr. Bob Ladwig of Rick Engineering Co., 3088 Pi0 Pic0 Drive, Carlsbad. Mr. Ladwig spoke in regard to issue #4 stating the supervised grading would be a good idea, but would add a considerable amount of money to the cost of the home. Mr. Ward referenced the construction on the satellite plant stating a full-time soils engineer is on the job, and expressed his approval of same. Council. concurred that additional review and report on issue #4 was desirable. Council concurred that due to administration problems which could result from implementation of issue #3, that staff should respond to complaints only. It was the consensus of Council that issue #3 would be undesirable to implement. With regard to issue #1 , Council expressed the desire to Council also requested additional report as to the in- clusion of a requirement for the applicant to identify all underground utility locations so as to minimize damage to same, and to study the possibility of requiring the re- placement of the topsoil on the finished lot. Staff: stated the matter would be returned to Council after review as per the directions of Council. ADJOURNMENT: By proper motion, the meeting was adjourned at 10:21 P.M.
