Mr. DeYoeger expressed the opinion that the agreement as completed, did not conform to what the parties had agreed upon. He stated it was the intention of the negotiating committee to have the agreement extend for two negotiating periods. Therefore, since he did not believe the agreement reflected that understanding, there was no agreement. He further expressed the opinion that he believed all parks were to have an agreement or the City would enact an ordinance regulating same. I Mr. Jack Robinson, owner of Lanikai Lane Mobile Home Park, addressed Council. Mr. Robinson stated the agreement contain the provision on page 8, Section XVIII, as specified by I Mr. DeYoeger. I Mayor Packard stated his belief that the negotiations had resulted in the fact that'.the agreement would carry negotia- tions through two periods, assuming that rent notices go out on the normal date of November 1. Mr. DeYoeger and Mr. Robinson affirmed that understanding. I The City Attorney stated the existing agreement meets that intent, but that clarifying language could be added if Counci so desired. t I RECESS: Mayor Packard called a recess at 9:36 A.M. to allow the opportunity for refinement of the wording in question, and Council reconvened at 9:55 A.M. with all Council Members I present. 1 The City Attorney stated both parties had agreed to add the following sentence to Section XVIII on page 8: "Any rent increase noticed at any time before November 1,-1982, will be negotiated and shall be subject to arbitration as provided in this agreement, even if that process shall go beyond November 1, 1982 .'I 1 1 Mayor Packard stated that the agreement had been signed by 1 Mr. Robinson, and noted, in accordance with the suggestion of the City Attorney, that both parties should initial the addit ion. Mr. George Brissey, 6259 Easy Street, Carlsbad, of Solamar, addressed Council. Mr. Brissey stated he had been a member of the negotiating committee in Solamar. Mr. Brissey reiterated the events leading to an agreement in the Solamar Park prior to the Council meeting of December 16, 1980, indicating that the owner had misinformed the residents, thereby encouraging the signing of the agreement. He further expressed the opinion that the agreements would not stand the test of'litigation due to many deficiencies. Mr. Joe Bastone, 7225 San Lucas, Carlsbad, of Lakeshore Gardens, addressed Council. Mr. Bastone stated he had been a member of the negotiating committee in Lakeshore Gardens, but due to serving on jury duty, was absent during the final week of negotiations. He reiterated the feeling that Council should adopt a regulatory ordinance. In summation, Mayor Packard noted that the desire of the park residents was for a regulatory ordinance. He further noted that the concentrated efforts of the City in attempts to work out agreements in each park were aimed at negating the need of an ordinance, yet yielding the same result. I I I e -. P
