PUBLIC HEARINGS:
(99) 20. AB #I6695 - TENTATIVE MAP AND CONDOMINIUM PERMIT
AMENDMENT - CT 81-24/CP-6(A). APPLICANT: .ROSE GARDEN.
The Planning Director gave the staff report, essentially
as contained in the statement of the matter.
Vice-Mayor Casler opened the public hearing at 6:20 P.M.'
and .extended the invitation to speak. Since no one wished
to speak on the matter, the public hearing was closed.
Council directed the City Attorney to prepare. documents
approving CT 81 -24/CP-6 (A) , per Planning Commission
Resolution No. 1829.

PONDEROSA HOMES. I ..
The Planning Director gave a staff report on the 'matter.,
and indicated that the Planning Staff has .met with the
applicant and the Homeowers Association this date, and
have successfully resolved the concerns of the
Association. He stated that they are in agreement on the
following items:
..
1) 'There is a desire on .the part of the Homeowners
Association to have recreation on flat land, and
information will be provided, re costs.
2) ' They will be di.scussing a transfer of some of. the
flat .land to the Association in Unit 2.

3) They will be discussing how to maintain the open
space.

Vice-Mayor Casler opened the public hearing at 6:25 P.M.,
and extended.the invitation to speak.
Council. recognized Ed Labigay, President of the Homeowners
Association; who indicated that based on the
representations by,Mr. Putnam, Vicepresident of Ponderosa
Homes, the Association is not opposed to the rezoning.
In response to Councii query, Mr. Labigay stated that
negotiations were between the Homeowners Association and
Ponderosa, and did not involve the City.
Since no.one else wished to speak on the matter, Vice-
Mayor Casler closed the public hearing at 6:28 P.M.

Council accepted San Diego Gas and Electric's offer of
providing the necessary funds for the lifeguard services,
and adopted the following Resolution: I I
RESOLUTION NO. 6636, APPROVING AN AGREEMENT BETWEEN
THE CITY OF CARLSBAD AND THE STATE OF CALIFORNIA
PARKS AND RECREATION DEPARTMENT TO PROVIDE LIFEGUARD

FOR CONSULTING SERVICES RELATIVE TO THE FUTURE WATER

25. AB #6699 - AMENDMENTS TO MUNICIPAL CODE REGADING
ABANDONED VEHICLES.
The City.Manager gave the staff report, essentially as
contained in the statement of the matter. He also
submittea pictures of abandoned vehicle situations in the.
City for the Councils' review.
In response to Council query, the City Attorney explained
that the Ordinance would not affect vehicles that are in
running condition, and are legitimate vehicles.
Council introduced the following Ordinance:
ORDINANCE NO. 5062, AMENDING TITLE 10, CHAPTER 10.52
OF THE CARLSBAD MUNICIPAL CODE BY THE ADDITION OF
SECTIONS 10.52.130 AND 10.52.140, PROHIBITING
ABANDONMENT, PARKING OR STORAGE OF A VEHICLE IN
EXCESS OF THREE DAYS.
Council Member Anear suggested that the City send letters
to the people, advising that the Ordinance has been
adopted.

(67) 26. AB #6501 - Supplement #1 - PROPOSED ENERGY (3O)X ORDINANCE
The City Manager gave a brief introduction on the item. 1 I Marty Orenyak, the Building Official, continued the staff
report, explaining the Ordinance and giving some
background on the matter. He indicated that there is an
appeal. before the Energy Commission' regarding a similar
0rdinanc.e in Sacramento; and requested continuance of the
matter until they receive a decision on same.
,Council Member Anear referred. to .an article.in.the
Engineers' Magazine on the failure of solar systems, and
expressed concern about the lack" of. standards ...
Council recognized Kim-Kilkenny, 438 Camin-o Del Rio South,
San Diego; representing the. Construction Industry
Federation. Mr. Kilkenny indicated that if the. Council
desired to 'continue the matter, -they would be pleased to
work with Staff in the interim; as their intention was to
request a deferral of, the matter, based on other
concerns.
Mr. Kilkenny added that additional information is being
developed, .and they feel that same should be incorporated
opportunity for more. technical review.
Council discussed the desirability.of moving forward with
the pre-plumbing requirement.
Council introduced Ordinance No. 8093, only as it pertains
to Section 18.30.030.

Mr. Kilkenny addressed the Council, and indicated that

Vice-Mayor Casler suggested that they submit-their
objection in writing to the City within the next week.
(30) 27. AB #6700 - PROPOSED DESIGN STANDARD$ FOR ENERGY
CONSERVATION
With the aid of a transparency, Marty Orenyak,' the
Building Official, explained how lots of a subdivision
could be created to maximize solar access. He also
stated the intent was to encourage solar design, not
mandate it. t
The staff report was continued by Paul Klukas, Planning
Technician, with the aid of wall exhibits showing
examples,of subdivisions designed in accordance with the
recommended standards.
Kim Kilkenny addressed the Council, and requested
deferral of the matter, to allow review of other
jurisdiction actions, and completion of the revised
SANDAG -Regional Energy Strategy.

Council Member Anear referred to page 4 of Resolution No.
6639, item 3.2, and suggested that the word "shall" be
changed to "should." He also stated his opinion that it -
would be worthwhile to see what information other
jurisdictions will generate.
Council adopted the following Resolution, with the
amendment of Item 3.2,' page 4, to read, "The -developer
shall attempt to locate the maximum number of buildings
on lots' so as to take optimum advantage of summer breezes
and to be protected from exposure to winter winds:"
