AB #6711 - ZONE CODE AMENDMENT TO ALLOW PLANNING DIRECTOR REIEW OF CERTAIN VARIANCE APPLICATIONS AND PANHANDLE LOTS IN THE R-1 ZONE "ZCA-134 - APPLICANT: CITY OF CARLSBAD. The Planning Director gave a brief report on the matter noting that it is recommended. that subsection (.2)- -be deleted from Section '21 .51.020 of the .proposed ordinance .. Mayor 'Packard opened the public hearing and invited the public.to'speak regarding the matter. Since no one wished ' to speak, Mayor Packard closed the public hearing at 6:50 P.M. In: response to Council, query, the..Planning Direc:tor stated that' the- Police and Fire Departments would be required to review variance requests -as the? may affect their departments . AB,.#6720 - APPEAL OF CONDITIONAL USE PERMIT TO. PROVIDE A PAVED PARKING FACILITY ON LAGUNA DRIVE AND. STRATFORD LANE - CITY OF CARLSBAD.. .. The Assistant City Manager/Development, Ron Beckman,'gave a staff report on the matter detailing th.e history of Council's previous actions and considerations regarding the modular.units and additional parking spaces. With the aid of. wall exhibits, -he defined the current City Hall comp'lex and parking areas and the parking lot which would be lost when the modulars are placed on 'same. With the aid of a flip chart, he also explained the number of parking spaces currently available versus the number of spaces required. He also displayed a rendering of the proposed lot and explaitied the landscaping proposed. .I He stated that he takes issue with the 'findings 0.f- the Planning Commission in that the lot could be built so it would be compatible with' the surrounding area. Second; he stated that only Council could assure that the lot would be temporary, and not permanent, and that to date, Council's action had indicated the lot would be temporary. the Police Chief would address that issue. I Third, with regard to the noise impact, he stated that Police Chief Chief Jimno continued the report stated that the project would be built with a block wall around same to decrease the noise. He further stated the lot would-be used for only po1,ice and city vehicles, and ingress and egress to the lot would be from Laguna Drive. Further, the hours of operation for the lot would be from 7:OO A.M.to 6:OO - 7:OO P.M., after which time it would be locked. Mayor Packard suggested placing the Conditional Use Permit on only the lots fronting Laguna, leaving the lot fronting on Stratford vacant. ' He indicated ,his might be a compromise that may be more acceptable to the-residents on Stratford Lane. At the request of Council, the City Manager reported on the s tatu.s of negotiations with the County for land in 'the central area of the City. Counci1.directed that the City Manager provide the City .Attornep's Office. with the .a.ppro.bri.ate findings..for inclusion in the documents to prepared by the City Attorney, to. grant the appeal of CUP-198, approving a tempordry parking facility. .. .. .. . ". RECESS: Mayor Packard called a recess at 8:05 P.M. and 'Council r5convened at 8:25 P.M.. with four Council Members present. DEPARTMENTAL AND CITY MANAGER REPORTS: Engineering: I. .. i [99] 26. AB-#6712 - APPEAL OF TENTATIVE PARCEL MAP CONDITION - M. S. 504 - KLETT. . 1 The City Engineering gave a brief report on the matter with the aid of a wall exhibit showing a site plan for the project ., Council recognized Mr. Lou Dominy, Dominy 61 Bokal Architect's, 244 Ninth Street, Del Mar, repressenting the appellant.. Mr. Dominy stated that the existcng pipe has been there for several years and has never required maintenance. He stated the the Kietts proposed to build a 18-inch diameter line at 25-ft. anchors in a concrete box, the tog of which would be the .stairs. He stated that in this way,., 'the stairs could be removed in the'event that pipe maintenance would &required. Mr. Dominy further stated that Mr. Klett has expressed a willingness for the homeowner's association .to assume responsib.ility for the easement, and .removing the stai'rs should.-the need arise, and also for the maintenance of the pipe. . He concluded by stating that if concurrent easements were not allowed, they would only be able to build two units rather than three due to the parking requirements, and that the project would then not be financially feasible. Following brief discussion, Council granted the appeal of the tentative map condition, and agreed .to the joint use of the 5 foot easement, with a condition requiring that the builder assume maintenance responsibilities.. REPRESENTATIVE AND ALTERNATE' TO SAN DIEGUITO TECHNICAL ADVISORY COMMITTEE Mayor Packard suggested, and Council concurred; -that the Mayor .would talk wcth Planning Commissioner' Farrow and Council Member Kulchin about serving on-this -committee.
