HomeMy WebLinkAbout1986-05-27; City Council; MinutesI e MINUTES 0 Meeting of: CITY COUNCIL (Regular Meeting) Time of Meeting: 6:OO p.m. Date of Meeting: May 27, 1986 Place of Meeting: City Council Chambers (86) (80) (114) CALL TO ORDER: Mayor Casler called the Meeting to order at 6:OO p.m. ROLL\,CALL was taken by the City Clerk, as follows: Present - Council Members Casler, Lewis, Kulchin, and Pettine. Council Member Chick arrived at 6 :08 p.m. Absent - None. PRESENTATION: Tina Napier, Fairest of the Fair, presented Council Members with tickets to the Del Mar Fair, and encouraged attendance on Carlsbad Day. Mayor Casler read and presented a Proclamation to Bob Lucas in recognition of T.V. Pursuits Day on May 29, 1986. PUBLIC HEARINGS: 1. AB #8516 - Supplement #2 - MASTER PLAN DENSITY RANGES AND DENSITY CALCULATIONS FOR OPEN SPACE - ZCA-ISO/AMENDMENT TO MP-1, 139, 149, 174 & 175. Mike Holzmiller, Planning Director, gave the staff report as contained in the Agenda Bill and his memorandum dated May 20, 1986. Mayor Casler opened the public hearing at 6:35 p.m., and issued the invitation to speak. Bob Ladwig, Rick Engineering, referred to page I of the Ordinance, line 26 1/2, and expressed the opinion that the word "floodways1' should be "floodplain". Mr. Holzmiller expressed agreement with the change suggested by Mr. Ladwig. Mr. Ladwig continued referring to page 2 of the Ordinance, Section 21.44.240, and indicated the section was unclear, and could cause confusion in the future. For clarification purposes, Mr. Holzmiller stated though commercial and industrial did not have density calculations, they should be sensitive to the areas identified in Section 21.44.230 of the Ordinance. Doug Avis, Bieri-Avis Partnership, addressed Council. Mr. Avis referred to the recommendations of the Citizens Committee, and stated he did not believe these additional restrictions were necessary. He noted that if Council did determine to move forward with these changes, that the development restrictions proposed for 40% slopes should not apply to the R-L Zone. JJO T \p 5 COUNCIL 3 % MEMBERS % $ 1 - -.r I ~ i * e MINUTES 0 May 27, 1986 Page 2 PUBLIC HEARING: (continued) Since no one else wished to speak on the item, Mayor Casler closed the public hearing at 6:45 p.m. Mayor Casler referred to Ordinance No. 9795, and indicated that items 5 through 9 in Section 21.44.230 were not approved, nor recommended, by the Citizens Committee; therefore, she could not vote in favor of the proposed Ordinance. Additionally, Ordinance No. 9794 also referred to Ordinance No. 9795, and those items; therefore she could not vote in the affirmative for either Ordinance. Council Member Chick concurred with the comments of Mayor Casler. Council introduced the following Ordinance: ORDINANCE NO. 9794, AMENDING ORDINANCE NO. 9778, 9708, 9706, 9735, 9570 AND 9694 TO APPLY THE LAND USE ELEMENT DENSITY RANGES ADOPTED ON DECEMBER 17, 1985 AND NEW OPEN SPACE PROTECTION MEASURES TO EXISTING MASTER PLANS WITHIN THE CITY OF CARLSBAD. Council introduced the following Ordinance: ORDINANCE NO. 9795, AMENDING TITLE 21, CHAPTER 21.44 OF THE CARLSBAD MUNICIPAL CODE BY THE ADDITION OF SECTIONS 21 .'44.230 AND '21.44.240 TO RESTRICT DEVELOPMENT ON CERTAIN OPEN SPACE AREAS IDENTIFIED IN THE GENERAL PLAN AND TO EXCLUDE CONSIDERATION OF SPACE LAND FROM DENSITY CALCULATIONS. DEPARTMENTAL AND CITY,MANAGER REPORTS: (77) 2. WORKSHOP ON GROWTH MANAGEMENT PROGRAM. Mayor Casler announced that Council would not take any public testimmy on this item at this time. Public testimony would be received at the scheduled public hearing on the proposed ordinance. City Manager, Frank Aleshire, introduced the matter indicating this was being provided for information purposes for the City Council. He stated it was not necessary for Council to take any action, and he aave an overview of the matter. I I I I I Community Development Director, Marty Orenyak, continued with the report explaining the projects considered to be in the pipeline as noted in the Agenda Bill in Categories A, B, and C. He further explained that in Category A, 1,746 units could pull building permits after 3uly 22, 1986 without a phasing plan; and 1,757 in Category A would require a phasing plan. In Category B, 860 of the 4,609 total units would be exempt from the moratorium, but not exempt from the phasing plan requirements. And, in Category C, 304 of the 3,973 total units would be exempt from the moratorium but not from the phasing plan requirements. He also indicated that since 1980, the City has averaged approximately 1,500 residential permits per year. I .* e MINUTES 0 - -r I May 27, 1986 Page 3 DEPARTMENTAL AND CITY MANAGER REPORTZ: (continued) Mike Holzmiller, Planning Director, continued with the report referring to his memorandum dated May 23, 1986, and the workload of the Planning staff. He gave an update on the status of action which resulted from the Citizens Committee recommendations noting those items completed, those scheduled for completion by 3uly 22, 1986, and those to be completed after 3uly 22, 1986. Mayor Casler called a recess at 7:53 p.m., and Council reconvened at 8:08 p.m., with all Council Members present. 2. WORKSHOP ON GROWTH MANAGEMENT PROGRAM. (continued) City Manager Frank Aleshire continued with the report explaining the possible modifications to the Growth Management Program as contained on page 3 of the Agenda Bill. He referred to a wall exhibit which divided the City into three categories, and stated that the program could be simplified by the elimination of those three categories. He also stated that the City could develop the public facilities phasing program for the entire City rather than just for Zones 1-6. He referred to the draft ordinance attached to the Agenda Bill, and stated that it was prepared in accordance with the original proposal which included the 25 zones and the three categories. Mr. Aleshire responded to questions noting that the growth would be controlled by the timing of the public facilities. He also indicated that Council direction had focused on the density of the City at buildout, and the provision of public facilities concurrent with need. Council Member Pettine expressed concern that the program did not address the phasing of growth. He also stated that the City should set the standards; therefore, the City should prepare the public facilities plan. Council directed City staff to hire a consultant to do a public facility phasing plan for Zones 7 through 25.
