CALL TO ORDER:
Mayor Lewis called the Meeting to order at 6:OI p.m.
ROLL CALL was taken by the City Clerk, as follows:
Present - Council Members Lewis, Kulchin,

Pettine and Mamaux.
Absent - None. ~
Mayor Lewis announced the Council Meeting of March 3,
1987, had been adjourned to this date in order for Council to convene in a closed session to discuss
Items No. 6, 7 and 8 from the March 3rd agenda.
6. CLOSED SESSION PENDING LITIGATION.
7. AB A8906 - CONCERNED CITIZENS VS CITY OF
CARLSBAD.
8. AB #I8830 - Supplement 81 - HOSP GROVE REFERENDUM.
By motion, the City Council authorized a closed Lewis
Citizens v. City of Carlsbad litigation; and to
Company, v. City of Carlsbad; to discuss the Concerned
Mamaux receive legal advice regarding Odmark Development
Pettine pursuant to Government Code Section 54956.9(a) to
Kulchin session at 6:04 p.m. to discuss pending litigation

discuss pending litigation in conjunction with the
Council reconvened at 7:OO p.m., with all Members
present, and took the following action:
Council directed the City Attorney to return with a Lewis
purchase agreement to effect the acquisition of Hosp Kulchin
Grove in accordance with the December 4, 1986 Letter
Mamaux of Intent.

Council directed that an item be placed on the Agenda
for the March 17th Council meeting to make a policy
determination on the way to raise the necessary funds
to pay for the acquisition of Hosp Grove.
Council directed the City Attorney to seek agreements for dismissal of the Odmark Company referendum lawsuit
and Friends of Hosp Grove EIR and development approval
lawsuits to be executed in conjunction with the
closing of the purchase agreement.
Council continued action on a decision on the
referendum petition and directed that the City
Attorney return the matter with an Ordinance repealing
the outstanding developmental approvals (with the consent of affected developers and property owners)
when the purchase agreement is presented to the
Council.

With regard to the pending action of concerned
Citizens v. City of Carlsbad, Council directed the
City Attorney to vigorously defend that action on
behalf of the City.
With regard to the judge's order suspending the
issuance of building permits, Council directed the
City Attorney to make an appearance before the judge
seeking a total lifting of that order. If the judge
determines in favor of the existing order, then the
City Attorney is directed to secure a modification of
the order, pending the hearing, to allow owner-
occupied single-family building permits for which
applications had been accepted prior to 5:OO p.m. on
the 25th of February.
blayor Lewis questioned whether any of the four
citizens that were present at the March 3rd Council
meeting, and had submitted "Request to Speak" forms on
Item No. 7, were present this evening. He indicated
ltf they were, they would be allowed to address
Counci I.
Dennis Meehan, 3981 Gloria Lane, addressed Council
representing A1 Tomasebi. Mr. Meehan indicated that
Mr. Tomasebi is the owner of a small lot on Medford
Lane and he wants to build a house. He indicated the
significant impact the Concerned Citizens lawsuit was
having on citizens in Carlsbad. He requested that
Council proceed as quickly as possible to resolve
problems that the lawsuit was causing for the property
owners in the City.
Mr. Meehan also requested that Council be more
specific in the procedures required for public
participation. He expressed concern that three
citizens that had been present at the March 3rd
meeting were denied the opportunity to address
Council.
Mayor Lewis indicated that the attempt would be made
.to spell out requirements for Council participation.
