CALL TO ORDER:
Mayor Lewis called the Meeting to order at 6:OO p.m.
ROLL CALL was taken by the City Clerk as fol lows:
Present: Counci I Members Lewis, Ku I ch in, Pett i ne,
Mamaux and Larson.
Absent: None.
PRESENTATION:
Mayor Lewis read a Proclamation proclaiming the week of
Apirl 17 - 23, 1989, as PUBLIC SCHOOLS WEEK. The
Proclamation was accepted by Daniel McLaran, Senior
Deacon, Oceanside Masonic Lodge.

CONSENT CALENDAR:
Mayor Lewis announced a citizen request to remove Item
#6 from the Consent Calendar and Council Member Kulchin
requested Item #5 be removed from the Consent Calendar.

WAIVER OF ORDINANCE TEXT READING:
Counci I waived the reading of the text of a1 1 Ordinances
and Resolutions at this Meeting.
(99) 1. AB #9962 - ACCEPTANCE OF PUBLIC IMPROVEMENTS -
RISING GLEN SUBDIVISION - CT 83-20.
Counci I accepted the ons ite improvements of CT 83-
20, authorized the City Clerk to record the Not ice
of Completion and release bonds appropriately; and
directed the Utilities and Maintenance Department
to commence maintaining the public streets
associated with the subdivision.
(74) 2. AB #9963 - AMENDMENT OF CLASSIFICATION AND SALARY
PLAN FOR MEDIA SERVICES MANAGER.
Council adopted RESOLUTION NO. 89-111, amending the
classification plan and management salary schedule
to adopt the classification of Media Services
Manager.

(70) 3. AB #9964 - PLANS, SPECIFICATIONS, AND CONTRACT
DOCUMENTS FOR LIGHTING OF CARLSBAD HIGH SCHOOL
TENNIS COURTS - PROJECT NO. 86-1-37032.
Council adopted RESOLUTION NO. 89-112, approving
plans, specifications and contract documents and
authorizing the City Clerk to advertise for
lighting installation bids for the Carlsbad High
School Tennis Facility Project # 86-1-37032.
(28) 4. AB #9965 - AMENDED AGREEMENT FOR CONSULTING
(45) SERVICES FOR CITIZENS COMMITTEE TO STUDY OPEN SPACE.
Council adopted RESOLUTION NO. 89-113, approving an
amended agreement with Wallace Roberts 8, Todd to
increase the amount of fees paid to the consultant
from $15,000 to $30,000 for consulting service
associated with the Citizens Committee to Study Open
Space.
(81) 5. AB #9966 - ACCEPTANCE OF DONATION.
This item was removed from the Consent Calendar.
(105) 6. AB #9972 - OFFSHORE OIL DRILLING/EMISSIONS RULES.
This item was removed from the Consent Calendar.

Council Member Kulchin explained that she had made this
donation in memory of her mother-in-law, who had been
an active supporter during her campaigns.

Dan Hammer, 4015 Isle Drive, spoke in support of this
Resolution and commended Council for taking the lead in
the fight against offshore oil drilling in north
county
Council Member Mamaux reiterated his concerns about the
oi I dr i 1 I i ng and asked the citizens to write as many
letters as possible in opposition to it.

9. AB #9968 - PROHIBITION OF DOGS FROM CARLSBAD

BEACHES.
Dave Bradstreet, Parks and Recreation Director, gave
the staff report as contained in the Agenda Bill.
In answer to Council query, Mr. Bradstreet indicated
that Carlsbad only controls approximately 1.2 miles of
beach, and the State prohibits dogs on state-controlled
beaches.
Lynn Chase, Recreation Superintendent, gave the
statistics on neighboring cities as far as dogs or pets
on the beach, with Car 1 sbad and Del Mar the on I y two
areas where dogs were allowed.
Nancy Koontz, 773 Camellia Place, requested adding
summer restriction hours between the times of 8:OO a.m.
to 6:OO p.m., with the leash law and nuisance ordinance
to be in effect at a1 1 times.
Don Jackson, 260 Normandy Lane, spoke in favor of
banning dogs from the beach as a matter of heal thy safety and sanitation, not to mention the nuisance
factor and unsightliness. He requested a decision
based on the benefit of a1 I the peop le.

Joseph Vigil, M.D., 2805 Ocean Street, spoke in
opposition to the Ordinance presented tonight, stating
it was not poss i b le to enforce the two laws on the
books at the present time, and this would just add
another law that cou I d not be enforced. He sai d that
additional signs would not solve the problem as those
s igns are ignored by the peop le who break the other two I aws. He asked for el imi nati ng the dogs from the beach
entirely.
Council Members Kulchin, Larson and Mamaux all
concurred with a tota I ban of the dogs, stating the
beaches were for peop le, and not dogs.
Council Member Pettine supported trying the
recommendation of the Parks and Recreation Commiss ion as
indicated in the ordinance before Council this evening,
prior to a total ban.
Mayor Lewis stated he favored the total ban of dogs
from the beach due to his persona 1 observation of the
1 ack of control of the dogs by the owners.
By consensus, Council took no action on Ordinance No.
NS-61, and reaffirmed the ban on dogs from the beaches
as implemented by Ordinance No. NS-51.
10. AB #9969 - ADDITIONAL INFORMATION ON CHILD CARE.
J im Hagaman, Ana I ys is/Research D i rector, gave the staff
report as contained in the Agenda Bill, using
transparencies to show the Task Force recommendations.
Dan Hammer, 4015 Isle Drive, spoke in favor of
establishing a Child Care Commission.
Anna Knox, 1860 Highridge, the Task Force Chairperson,
reported on the work of the Child Care Task Force
during the year they met and that all but two
recommendations of that Task Force had been adopted.
She spoke in favor of establishing a Child Care
Commi ss ion.
Julie Nygaard, 3405 Spanish Way, spoke in favor of a
Chi,ld Care Commission, with a consultant to provide
technical assistance to the Commission. She suggested
using Community Development Block- Grant money to fund
this Commission.
Council Member Kulchin recommended establishing a
seven-member Child Care Commission, with staff support. ..
Council Member Mamaux suggested deleting the $200,000
for.the Convent4on and Visitors Bureau from the next
budget,,..and using that money to provide a budget for
chi I d ,ca're:. . He stated that the ob 1 i gations of the
Commission should be spelled out and that four.sites'be
established, one in each quadrant of the City, for chi 11
care. Mr. Mamaux suggested the City could provide
the land arid.zoning. Then, by bids, private enterprise
would build the structures, maintain and operate the
programs,on a joint-venture basis with the City.

Council Member Mamaux recommended the Child Care
Commission sunset at the end of four years, as he felt
once the Commission had estab I ished the day care centers and they were working, staff would be able to
handle whatever regulations that were necessary.
Council Member Pettine stated as far as the funding, he would like to see this item added to the regular budget process.
Council directed staff to return with documents creating a Child Care Commission and a report containing additional information concerning
a lternative methods of staffing, cost of staffing,
fundTng alternatives and possible work program
alternatives for the Commission.
11. AB #9973 - PROPOSED REVISED FEES FOR CITY SERVICES.
J im E 1 1 iott, Finance D irector, gave the staff report as contained in the Agenda Bill.
Council accepted the report and directed the matter be set to a Public Hearing on May 9, 1989.
12. AB #9970 - STATE WHALE WALK IMPROVEMENTS AND MAINTENANCE PROPOSAL.
Dave Bradstreet, Parks and Recreation Director, gave
the staff report as contained in the Agenda Bill, using transparencies to show the improvement costs,
maintenance costs and alternatives.
The consensus of Counci I was concern about maintaining
buildings and property which belong to the State.
Council directed staff to negotiate with the State
concerning ownership and maintenance alternatives for the Whale Watch blufftop walkway and the bluffs.
13. AB #9971 - CROSS-CONNECTION CONTROL PROGRAM.
Larry Wi 1 ley, Maintenance/Uti 1 ities Department, gave the staff report as contained in the Agenda Bill.

matter for a Public Hearing on May 2, 1989:
ORDINANCE NO.NS-62, AMENDING TITLE 14, CHAPTER 14.08 OF
THE CARLSBAD MUN IC IPAL CODE BY REPEAL I NG SECT 1 ON
14.08.010 AND ADDING CHAPTER 14.12 RELATING TO CROSS
CONNECTION CONTROL PROGRAM AND ADOPTING ARTICLE 1 OF
GROUP 4 OF SUBCHAPTER 1 OF CHAPTER 5 OF TITLE 17 OF THE
CALIFORNIA ADMINISTRATIVE CODE.
COUNCIL REPORTS:
Council Members reported on recent meetings and
activities of the Committees and Sub-Committes of which
they are members.
