MINUTES
Meeting of: CITY COUNCIL (Regular Meeting)
Date of Meeting: January 16, 1990

CALL TO ORDER:
Mayor Lewis called the Meeting to order at 6:OO p.m.
ROLL CALL was taken by the City Clerk, as follows:
Present: Council Members Lewis, Kulchin, Pettine,
Mamaux and Larson.
Absent: None.
INVOCATION was given by Mayor Lewis.
PLEDGE OF ALLEGIANCE was led by Council Member Kulchin.
CONSENT CALENDAR:
Council affirmed the action of the Consent Calendar, as
follows:
WAIVER OF ORDINANCE TEXT READING:
Council waived the reading of the text of all Ordinances
and Resolutions at this Meeting.
( 74 ) 1. AB #lo, 453 - BUDGET ADJUSTMENT FOR PURCHASING
DEPARTMENT.
Council adopted RESOLUTION NO. 90-09, amending the
budget for FY 1989-90 to convert the Clerk Typist
I1 in Purchasing to a Secretary I.
PUBLIC COMMENT:
Dan Hammer, 4015 Isle Drive, stated that Council Member
Mamaux had pledged not to vote on any project involving
Centre Mortgage Company, but on November 14, 1989, had
voted to hire consultants for environmental studies on a
Centre Development project known as Carlsbad Promenade.
Mr. Hammer said that Council should never be
compromised, and that their standards are not being met.
He said that Council needs to encourage all members to
avoid even an appearance of impropriety or conflict of
interest.

Mayor Lewis said this was a serious accusation by Mr.
Hammer, and he want this checked by the City Attorney.
He requested a report on the matter from the City
Attorney at next week’s Council meeting.
ORDINANCE FOR ADOPTION:
(67) 2. AB #10,450 - AMENDMENT OF TITLE 11, CHAPTER 11.36
PERTAINING TO NEWSRACKS.
Council adopted the following Ordinance:
ORDINANCE NO. NS-104, AMENDING TITLE 11, CHAPTER 11.36
OF THE CARLSBAD MUNICIPAL CODE ADDING DEFINITIONS OF
OBSCENE MATERIALS.

3. AB #10,454 - SAN DIEGO GAS & ELECTRIC COMPANY
REOUEST FOR FUNDS.
John Sedlack, Account Executive with SDG&E, made the
presentation, requesting financial assistance from the
City to help the fight against Cystic Fibrosis. Mr.
Sedlack also asked the City to sponsor its own team in a
Sports Challenge event.
Council heard the request and took no action, but noted
SDG&E could submit their request for consideration
during the budget process.
4. AB #10,455 - ALGA ROAD ASSESSMENT DISTRICT NO. 88-
1. -
City Engineer Lloyd Hubbs gave the staff report as
contained in the Agenda Bill, using a transparency to
show the Assessment District Boundary.
Council adopted the following Resolutions: (one motion)
RESOLUTION NO. 90-10, MAKING FINDINGS ON PETITION.
RESOLUTION N0.90-11, APPROVING AND AUTHORIZING EXECUTION
OF SPECIAL ASSESSMENT DISTRICT ACQUISITION/FINANCING
AGREEMENT.
5. AB #10,456 - AWARD OF CONTRACT FOR AGUA HEDIONDA
SEWAGE PUMP STATION - PROJECT NO. 3303.
John Cahill, Municipal Projects Manager, gave the staff
report, using a slide presentation to show the pump
stat ion.
Council adopted the following Resolution:
RESOLUTION NO. 90-12, TRANSFERRING AND APPROPRIATING
FUNDS, ACCEPTING BIDS AND AWARDING A CONTRACT FOR THE
CONSTRUCTION OF IMPROVEMENTS TO THE AGUA HEDIONDA PUMP
STATION, PROJECT NO. 3303, TO P & H CONTRACTING, INC.
6. AB #10,457 - NOTICE OF COMPLETION FOR CARLSBAD
SENIOR CENTER CUSD EDUCATION CENTER - PROJECT NO.
3247.
John Cahill, Municipal Projects Manager, gave the staff
report as contained in the Agenda Bill.
Council adopted the following Resolution:
RESOLUTION NO. 90-13, ACCEPTING THE CONSTRUCTION OF THE
CARLSBAD SENIOR CENTER AND CUSD EDUCATION CENTER PROJEC'I
AS COMPLETE, DIRECTING THE RECORDATION OF THE NOTICE OF
COMPLETIONI APPROVING A SETTLEMENT AGREEMENT AND
APPROVING CHANGE ORDER NO. 62.
7. AB #10,458 - REPORT FROM PLANNING COMMISSION NOISE
SUBCOMMITTEE AND ADMINISTRATIVE NOISE POLICY.
City Manager Ray Patchett said that there have been
requests to continue this matter for 30 days.

Bill Hofman, Hofman Planning Associates, 2386 Faraday
Avenue, Ste. 120, requested this item be continued one
month to allow the people most impacted time to prepare
their presentations. He said this was not publicly
noticed and most developers do not know it is on the
agenda tonight. At the Planning Commission, noise
consultants were brought in, and this would be
beneficial to the City Council. He said he concurred
with staff recommendation with the exception of one
provision; the change of the noise standard from 65 to
60 CNEL, and he wanted to present information on the
consequences of that change.
Bob Ladwig, Rick Engineering, 1959 Palomar Oaks Way,
#200, stated he concurred with Mr. Hofman in asking for
a one month's continuance for the same reasons.
City Manager Ray Patchett stated that this matter was
legally noticed under the provisions of the Brown Act,
and although this is not a public hearing, the City did
meet the legal requirements.
In response to Council query regarding any impact the
continuance might have, Mike Holzmiller, Planning
Director, stated that there would be none, as there is
already a policy that requires mitigation to 60 CNEL,
and this is just formalizing that and getting City
Council concurrence.
By consensus, Council agreed to continue this matter for
30 days.
(39) 8. AB #10,459 - REPORT ON CITY INVESTMENTS.
Information item from the City Treasurer reporting on
the City's investment portfolio as of January 1, 1990.
COUNCIL REPORTS :
Council Members reported on recent meetings and
activities of the Committees and Subcommittees of which
they are Members.
ADJOURNMENT:
By proper motion, the Meeting of January 16, 1990, was
adjourned at 6:52 p.m., in memory of Bill Tarvin, the
deceased husband of Shelia Tarvin, Communications and
Records Supervisor of the Carlsbad Police Department.
