HomeMy WebLinkAbout1991-06-11; City Council; MinutesF a 0 MINUTES Meeting of: CITY COUNCIL (Regular Meeting) Date of Meeting: June 11, 1991 Time of Meeting: 6:OO p.m. Place of Meeting: City Council Chambers " CALL TO ORDER: Mayor Lewis called the Meeting to order at 6:OO p.m. ROLL CALL was taken by the City Clerk, as follows: Present: Council Members Nygaard, Larson and Mayor Lewis. Absent: Council Members Kulchin and Stanton. CONSENT CALENDAR: Mayor Lewis removed Item #3 from the Consent Calendar. Council affirmed the action of the Consent Calendar, with the exception of Item #3, as follows: WAIVER OF ORDINANCE TEXT READING: Council waived the reading of the text of all Ordinances and Resolutions at this Meeting. 1. AB #11,187 - STATE-LOCAL PARTNERSHIP PROGRAM APPLICATIONS FOR FUNDING FOR ARTERIAL STREETS. Council adopted RESOLUTION NO. 91-173, authorizing the City Engineer to make application to CALTRANS for State-Local Partnership Funds for certain arterial streets and to withdraw Cannon Road from the current year program. 2. AB #11,188 - SETTLEMENT OF NARDELLA V. CITY OF CARLSBAD, ET AL - CASE NO. N48117. Council adopted RESOLUTION NO. 91-174, authorizing the settlement of Nardella v. City of Carlsbad, et d, Case No. N48117, and authorizing the Risk Manager to pay the settlement &mount of $15,500 from the liability self insurance reserve. 3. AB #11,189 - TRANSFER OF LIBRARY'S 16" FILM COLLECTION. This item was removed from the Consent Calendar. 4. AB #11,190 - CONSULTANT AGREEMENT FOR 1991 GROWTH MANAGEMENT PLAN TRAFFIC MONITORING PROGRAM. Council adopted RESQLUTION NO. 91-176, approving a consultant agreement in the amount of $37,958, with JHK and Associates for the 1991 Growth Management Plan Traffic Monitoring Program. ITEM REIXJVED FROM THE CONSENT CALENDAR: 3. fil-#11,189 - TRANSFER OF LIBRARY'S 16" FILM COLLECTION. Mayor Lewis expressed concern for preserving the films of World War I1 that were a gift to the City. ill& - - COUNCIL I\/\ % %% % MEMBERS % %% % Lewis X Nygaard xx Larson X -r e 0 MINUTES June 11, 1991 Page 2 ITEM REMOVED FROM THE CONSENT CALENDAR: (Continued) Council adopted RESOLUTION NO. 91-175, declaring the Library's 16 mm films as surplus, and authorizing the transfer of the films to the Carlsbad Unified School District; and directed staff to preserve the seven World War I1 films on video prior to transfer. PUBLIC COMMENT: There were no requests to address Council at this time. ORDINANCE FOR ADOPTION: 5. AB #11,179 - TIME LIMITS FOR FILING COURT ACTIONS. Council adopted the following Ordinance: ORDINANCE NO. NS-150, amending Title 3, Chapter 3.32 of the Carlsbad Municipal Code regarding time limits for filing claims for damages. PUBLIC HEARING: 6. AB #11,198 - APPEAL OF CONDITIONAL USE PERMIT FOR GAS STATION/MINI"ART AND SELF-SERVE CAR WASH - CUP 90-1/SDP 90-4 - MOBIL OIL. Mobil Oil had requested this matter be continued to June 18 to have all five Council Members present. Council continued this matter to June 18. HOUSING AND REDEVELOPM%NT COMMISSION: Council adjourned to the Housing and Redevelopment Commission at 6:07 p.m., and reconvened at 6:30 p.m., with three Members present and Council Members Kulchin and Stanton absent. DEPARTMENTAL AND CITY MANAGER REPORTS: 7. AB #11,191 - APPEAL OF TRAFFIC SAFETY COMMISSION RECOMMENDATIONS REGARDING SPEED REDUCTION MEASURES FOR PONTIAC DRIVE. Thomas Johnson, 3624 Pontiac Drive, representing the Chestnut Hills Community Action Group (residents of Pontiac Drive), addressed Council stating the residents were concerned over safety. Eie stated the resident; wmt speed humps and stop signs installed. Tony Loeffler, 3555 Pontiac, representing the Chestnut Hills Community Action Group, explained speed humps and spoke in favor of installing them on Pontiac Drive. 111 - COUNCIL I\/\ % %' % MEMBERS % %% % Lewis X Nygaard X Larson xx Lewis X Nygaard xx Larson X Lewis X Nygaard xx Larson X c a e MINUTES June 11, 1991 Page 3 DEPARTMENTAL AM) CITY MANAGER REPORTS: (Continued) Lois Booth, 2633 Banbury Court, spoke in opposition to the appeal, stating that the Traffic Safety Commission’s recommendations would take care of the problem. She said that is a public road and belongs to all of the citizens of Carlsbad. Janet Jones, 2613 Banbury, spoke in opposition to the appeal, stating there is no criteria for installing speed humps, and if they are installed on Pontiac Drive, then citizens from all over Carlsbad will be requesting speed humps. She said the decision of the Traffic Safety Commission should be upheld. Council directed staff to return with documents to place four-way stop signs at Spokane/ Pontiac Drive, and three-way stop signs at Victoria/Pontiac Drive, including all proper signing. RECESS : Mayor Lewis declared a Recess at 7:30 p.m., and Council re-convened at 7:39 p.m., with three Members present and Council Members Kulchin and Stanton absent. DEPARTMENTAL AND CITY MANAGER -PORTS: (Continued) 8. AB #11,192 - AUTHORIZATION TO AMEND AGREEMENT FOR CONSULTING SERVICES FOR HABITAT MANAGEMENT PROGRAM. Council adopted the following Resolution: RESOLUTION NO. 91-177, approving an amended agreement with Consultants Collaborative, Inc. 9. AB #11,193 - REVIEW OF CCVB 1991-92 BUDGET REQUEST. Representatives from the Chamber of Commerce/CCVB gave a report on their budget request for 1991-92. Lynne Cook, 2832 State Street, Co-Chair of the Village Merchants Association, spoke in favor of the budget request. Council stated they would consider their budget request during budget deliberations, but would not favor allocating a percentage of the T.O.T. 10. AB #11,194 - AMENDMENT OF CHAPTER 10.56 OF THE CARLSBAD MUNICIPAL CODE TO ALLOW LAW ENFORCEMENT BICYCLES ON SIDEWALKS. 12. AB #11,195 - AMENDMENT OF CHAPTER 11.32 OF THE CARLSBAD MUNICIPAL CODE TO ALLOW LAW ENFORCEMENT BICYCLES ON THE SEAWALL. Council adopted the following Urgency Ordinances: (one motion) URGENCY ORDINANCE NO. NS-151, amending Title 10, Chapter 10.56 of the Carlsbad Municipal Code by the amendment of Section 10.56.010 to allow law enforcement bicycles on sidewalks. URGENCY ORDImCE NO. NS-152, amending Title 11, Chapter 11.32 of the Carlsbad Municipal Code by the amendment of Section 11.32.070 to allow law enforcement bicycles on the seawall. Items 13, 14, 15, 116, 17 and 18 were continued until a full Council is present. 13. AB #11,165 - APPOINTMENT TO SISTER CITY COMMITTEE. 14. AB #11,180 - LIBRARY BOARD OF TRUSTEES APPOINTMENT. 15. AB #1,182 - TRAFFIC SAFETY COMMISSION APPOINTMENTS. 16. AB #11,183 - SENIOR COMMISSION APPOINTMENT. 17. AB #11,196 - BEACH EROSION COMMITTEE APPOINTMENT. 18. AB #11,197 - HISTORIC PRESERVATION COMMISSION APPOINTMENT. COUNCIL REPORTS: Council Members reported on the activities and meetings of the Committees and Subcommittees of which they are Members.
