Meeting of: CITY COUNCIL (Regular Meeting)

CALL TO ORDER:
Mayor Lewis cztlled the Meeting to order at 6:OO p.m.
i ROLL CALL was taken by the City Clerk, as follows:
Present: Council Members Nygaard, Stanton, Larson,
Kulchin and Mayor Lewis.
Absent : None.
PRESENTATION:
Mayor Lewis read a Proclamation declaring October as
DOMESTIC VIOLENCE AWARENESS MONTH. The Proclamation was
accepted by Denise Frey, Comnunity Educator, Women's
Resource Center.
CONSENT CALENDAR :
Mayor Pro Tem Kulchin stated she would abstain on Item
#8.
Council affirmed the action of the Consent Calendar, as
follows :
WAIVER OF ORDINANCE TEXT IiEADING:
Council waived the reading of the text of 5.11 Ordinances
and Resolutions at this Meeting.
1. AB #11,374 - ACCEPTANCE OF FUBLIC IMPROJEMENTS -
LAGUNA SHORES - CARLSBAD TRACT NO. 88-1.
Council accepted the improvements; authorized the
City Clerk to record the Notice of Completicn and
releass bonds; and directed the Utilitlzs acd
Maintenan?e Department to commence maintaiqing the
public streec and sewer improvements Constructed at
Park Drive and Neblina Drive.
2. AB #11,375 - ASEPTANCE OF PUBLIC IMPROVEMENTS -
' VILLAGE FAIRE--- PRIVATE DEVELOPMENT NO. 305.
Council accepted the improvements; authorized the
City Clerk to record the Notice of Completion and
release bonds; and directed the Utilities arid
Maintenance Department to commence maintaining the
public street, storm drain and sewer
improvements;and directed the Parks and Recreation
Department to maintain the median landscaping
constructed at Carlcbad Koulevard, Grand Avenue,
Carlsbad Village Drive and Washington Street.
3. AB #11,376 - ACCF,Pr&IICE OF STORM DRAIN IMPR07EMENTS - TAMARACK POINTILz-ILT 84-14, UNITS 1 E; 2.
Council accepted the improvemerits; authorized the
City Clerk to record the No.cice of Completion and
release bonds; arid ciirected the Utilities and
Maintenance Departn el~t to commenze maintainins the
pub1 Fc storm drain imprcvemsnts constructed at
Pontiac Drive.

FIRE MANAGEMENT SALARY PLAN.
Council adopted RESOLUTION NO. 91-329, approving
adjustments to the Management Salary Plan €or the
positions of Fire Chief and Fire Battalion Chief.
5. AB #11,378 - ADJUSTMENT TO THE CITY OF CARLSBAD
FIRE SALARY PLAN.
Council adopted RESOLUTION NO. 91-330, adopting the
1991 Fire Salary Schedule.
6. AB #13,379 - ADJUSTMENT TO THE CITY OF CARLSBA3
POLICE MANAGEMENT SALARY PLAN.
Council adopted RESOLUTION NO. 91-331, approving
adjustments to the Management Salary Plan for the
positions of Police Chief, Police Captain and
Police Lieutenant.
7. AB #11,380 - ADJUSTMENT TO THE CITY OF CARLSBAD
POLICE SALARY PLAN.
Council adopted RESOLUTION NO. 91-332, adopting the
1991 Police Salary Schedule.
8. AB #11,384 - DENIALSF' APPEAL - MC DONALD'S
RESTAURANT DRIVE-THRU - SDP 83-11 (C)/CUP 91-5.
Council adopted RESOLIJTION NO. 91-336, denying the
appeal and upholding the Planning Co.nmission's
denial of SDP 83-11 (C)/CUP 91-5.
PUBLIC COMMENT :
There were no requests to address Council at this time.
ORDINANCE FOR ADOPTION:
9. AB #11,386 =CITY-WIDE TRAFFIC IMPACT FEES.
Council adopted the following Ordinance:
ORDINANCE NO. NS-177, amendi.ng Title 18, Chapter
18.42 of the Carlsbad Mcnicipal Code establishing a
Traffic Impact Fee.
PUBLIC HEARINGS:
10. AB #11,381 - SPECIFIC PLAN AMENDMENT - CARLSBAD
AIRPORT CENTRE - SP-l81(A).
Mayor Lewis opened the daly noticed Public Hearing
at 6:18 p.m., and issued the invitation to =peak.
Mike Howes, Hofman Planning Associates, 2386
Faraday, Suite 120, representing the applicant,
stated they accepted all proposed changes and
requested approval.
Since no one else wished to speak on this matter,
Mayor Lewis closed the Public Eearing at 6:19 p.m.

Council adopted the following Resolution and
introduced the following Ordinance: (one motion)
RESOLUTION NO. 91-333, approving a Negative
Declaration for an amendment to Specific Plan 181.
ORDINANCE NO. NS-178, approving an amendment to
Specific Plan 181 on property generally located
between El Camino Real, Palomar Airport Road, North
of College Avenue and McClellan-Palomar Airport.
11. AB #11,382 - ZONE CODE AMENDMENT - PROFESSIONAL
CARE FACILITIES - ZCA 91-2.
Mayor Lewis opened the duly noticed Public Hearing
at 6:29 p.m., and issued the invitation to speak.
Cheryl Bloodworth, Director of Development for
Marriott, 3230 South Harbor Boulevard, 3anta Ana,
asked for support fcr this amendment.
Since no one else wished to speak on this matter,
Mayor Lewis closed the Public Hearing at 6:32 p.m.
Council adopted th-? following Resolution and
introduced the following ordinance: (one motion)
RESOLUTION NO. 91-334, approving a.Negative
Declaration for a Zcne Code Amendment t3 amend
Title 21 of the Carlsbad Municipal Code, Chapter
21.18 - Residential-Professional Zone Ssction 21-
18.040; Chapter 21.42 - Conditional Uses, Section
21,42.010, to allow Professional Care Facilities in
the RP Zone with a Conditional Use Permit; and
Chapter 21.44 - parking, by adding a new parking
standard of .45 parki-13 spaces per every he3 in a
Professi.ona1 Care Facilixy.
" ORDI1JAYCR NO. NS-179, amending Title 21 of the
Carlsbhd Municipal Cod; Chaptsr 21.18 by the
addition of Section 21.18.040(4) (Residential
Profesional Zone), Chapter 21.42 by the addition of
Section 21.42.010(8)(B) (to allow Professional Care
Facilities in the RP Zone with a Conditional Use
Permit) and Chapter 21.44 by the addition of
Section 21.44.020(33) adding a new parking standard
of .45 parking spaces per bed in a Professional
Care Facility.
12. AB #11,387 - ZONECODE AMENDMENT TO REGULATE
BUILDING HEIGHT - ZCA 91-3.

at 7:11 p.m., and issued the invitation to speak.
Sally Katich, 4179 Highland Drive, presented a
petition to Council, and asked for stricter
limitations for residences in the lagoon area.

Lock Williams, 3480 Carlsbad Boulevard,
representing his father, spoke in favor of adopting
these amendments.
Since no one else wished to speak on this matter,
Mayor Lewis closed the Public Hearing at 7:24 p.m.
Council adopted the following Resolution and
introduced the following Ordinance: (one motion)
RESOLUTION NO. 91-305, approving a Negative
Declaration for a Zone Code Amendment to amend
various chapters and sections of the Zoning
Ordinance to allow for (1) the revision and
addition of zoning definitions, (2) building height
reductions, (3) industrial and commercial height
increases and (4) clarification of the building
height restriction with the Beach Area Overlay
Zone.
ORDINANCE NO. NS-180, amending various chapters and
sections of Title 21 of the Carlsbad Municipal Code
for the purposes of (1) the revision and addition
of zoning definitions (2) the establishment of
building height reductions in certain zones, (3)
the establishment of building height increases in
certain industrial and commercial zones, and (4)
clarification of the building height limit within
the Beach Area Overlay Zone.
Council instructed staff to return with a report
explaining the process and potential boundaries for
establishing an overlay zone that would provide
additional restrictions on building height.
Council Mesber Stanton returned to the dais.
MUNICIPAL 'dJxE[i DISTRICZ:
Council adjcurned to tha Municipal Water District. at
7:26 p.m., and re-convened at 7:27 p.m., with all
Members present.
HOUSING AND REDEVELOPMENT COMMISSION:
Council adjourned to the Housing and Redevelopment
Commission at 7:27 p.m., and re-convened at 7:34 p.m.,
with all Members present.

AND PLAN.
This item was continued.
15. AB #11,385 - PROPOSED ORDINANCE PROHIBITING THE USE
OF B.B. AND PELLET GUNS.
Council, by consensus, requested a report on what
other cities have done concerning this issue,
possibility of an ordinance, and enforcement
issues.
16. AB #11,355 - SENIOR COMMISSION APPOINTMENTS.
Council adopted the following Resolution:
RESOLUTION NO. 91-311, re-appointing George Heard
to the Senior Commission.
17. AB 511,356 - DESIGN REVIEW BOARD APPOINTMENTS.
The following Planning Commissioners were
recommended for appointment to the Design Review
Board:
Tom Erwin, Bailey Noble and Peggy Savary.
18. AB #11,357 - APPOINTMENTS TO CARLSBAD BUILDING
AUTHORITY.
Council adopted the following Resolutions: (one
mot ion )
RESOLUTION NO. 91-313, re-appointing Marvin Cap to
the Building Authority.
PWSOLUTION NO. 41-314, re-appointing Don Pool to
the Building Authority.

Council Members reported on activities and recent
meetings of the various subcommittees of which they are
Members .
