MINUTES OF: CITY COUNCIL (Regular Meeting) DATE OF MEETING: JANUARY 14, 1992 TIME OF MEETING: 6:OO p.m. PLACE OF MEETING: City Council Chambers CALL TO ORDER: Mayor Lewis called the Meeting to order at 6:05 p.m. ROLL CALL was taken by the Assistant City Clerk, as follows: Present: Council Members Nygaard, Stanton, Larson, Kulchin and Mayor Lewis. Absent: None. CONSENT CALENDAR: ACTION: On motion by Mayor Pro Tem Kulchin, Council affirmed the action of the Consent Calendar, as follows : AYES : Lewis, Kulchin, Larson, Stanton and Nygaard WAIVER OF ORDINANCE TEXT READING: Council waived the reading of the text of all Ordinances and Resolutions at this Meeting. I1 1. AB #11,507 - ACCEPTANCE OF GIFT TO THE CARLSBAD CITY LIBRARY. Council adopted RESOLUTION NO. 92-13, accepting a donation of $500 from the employees of Farmers Insurance Group to be used to purchase business books. 1 2. AB #11,508 - SETTLEMENT OF LAWSUIT - VILLASENOR V. CITY OF CARLSBAD ET AL, CASE NO. 112730. Council adopted RESOLUTION NO. 92-14, authorizing settlement of the case and payment of the settlement amount of $7,000 from the liability fund. 7 3. AB #11,509 - SELECTION OF ADMINISTRATIVE SERVICES CONSULTANT FOR 5 COMMUNITY FACILITY DISTRICT NO. 1. Council adopted RESOLUTION NO. 92-15, approving an agreement with Kadie- Jensen, Johnson and Bodnar to perform administrative services for Community Facility District No. 1, and appropriating funds in the amount of $100,000 for consulting services and city administrative services. PUBLIC COMMENT: There were no requests to address the Council at this time. MUNICIPAL WATER DISTRICT: Council adjourned to the Municipal Water District at 6:07 p.m., and re- convened at 6:08 p.m., with all Members present. 9 W a January 14, 1992 Page 2 DEPARTMEWAL AND CITY MANAGER REPORTS: 74 4. AB #11,510 - IMPASSE WITH CARLSBAD CITY EMPLOYEES' ASSOCIATION [CCEA). Steve Filarsky, Attorney representing the City of Carlsbad, presented the staff report, including a history of the meet and confer process from April 1, 1991, to the present. With the use of slides, he outlined the various proposals and issues, including compensation, health insurance, personnel rules and regulations, disciplinary procedures, grievance procedures and alcohol and drug policy. Kelly Irving, representing the Carlsbad City Employees' Association, P. 0. Box 2056, addressed the Council and expressed displeasure that CCEA had not been told in advance how much time they would be allowed for their presentation this evening. Mr. Irving also gave a history of the negotiation meetings that have occurred since last April and explained the survey process CCEA utilized to get input from their members regarding issues to be negotiated. Barbara Nedros, President of CCEA, further explained the changes proposed by the City's negotiator and expressed concern with the demeanor of the City's chief negotiator in the negotiation meetings. Michael Lopez, 319 Chinquapin, spoke in opposition to the change in grievance procedure, stating the present system does work. He felt new rules were not necessary. Tim Fennessey, 432 Dorsey Way, Vista, Engineering Inspector, felt Carlsbad had productive and loyal workers, but that negotiations really didn't take place during the period from April, 1991. Doris Cosman, 400 N. Myers, Oceanside, spoke of the gap between management and miscellaneous employees and was concerned with eight months of negotiations and no settlement and the fact that retroactivity was provided to other employee groups. Callie Ahrens, 2607 Via Bocas, Reference Librarian, felt the "team Carlsbad" has been destroyed over the last nine months and that forcing this City-proposed contract would not improve employee morale. Marc Kratzer, 1380 Broken Hitch Road, Oceanside, Utilities/Maintenance Department Electrician, stated that the employees take pride in serving the needs of the City and felt this impasse was a blunder that disregards the employees and people of Carlsbad. He felt the employees should be consulted and negotiated with by City employees--not an out- of-town lawyer. Leila Dooley, 2290 Avenida Magnifica, Member of the Library Reference Staff, spoke in opposition to the impasse. Terry Bradshaw, Technical Services, City Library, stated she respects and supports her fellow workers. Her husband works for Parks and Recreation and she told of all the extra hours and effort that he also gives to the City. She felt the City's negotiator did not exhibit the ideas expressed in the Investment in Excellence program. Rhoda Kruse, 908 1/2 Reed Avenue, San Diego, Cataloger at the Library, expressed concern over the lack of trust expressed by the new rule changes and stated it would be difficult for employees to keep morale and productivity high with those changes. 8 e 0 January 14, 1992 Page 3 DEPARTMENTAL AND CITY MANAGER REPORTS: (Continued) Susan Simpson, 2345 Via Francisca, Library employee, stated the proposed rule changes were unnecessary. She asked why the reserve fund set aside for insurance premium increases was not being used for that purpose. She expressed dismay and disappointment that management has not been negotiating in good faith. Joe Federico, 2075 Las Palmas Drive, stated that employees had taken a zero pay raise in 1981, to have the present deduction schedule for insurance premiums. The insurance rebate was taken away in 1988, and the insurance carrier was changed after an Insurance Committee was formed to evaluate Crown Insurance, the former insurance carrier. Northwestern was the lowest bidder, and the payroll deduction was chosen to help build a reserve to offset future increases in premiums. He stated $300,000 was saved the first year, and that the City has refused to use any of the money to offset current premium increases. Sherri Howard, 2075 Las Palmas, Associate Engineer, told of the extra hours put in by employees without pay and said the City should have the same faith in its employees. She stated that the proposals will result in poor morale. Helen Erzak, 918 Woodgrove Drive, Cardiff, stated this was the third impasse she has witnessed during the time she has worked for the City. She stated there are some employees who are afraid to speak out because of fear of retribution or dismissal. She expressed concern about the sudden need for so many rule changes, and asked Council to examine the rule changes very carefully. She stated the new rules will lower the already poor morale of City employees even further. ACTION: On motion by Mayor Pro Tem Kulchin, the City Council determined to resolve the impasse. AYES : Lewis, Kulchin, Larson, Stanton and Nygaard ACTION: On motion by Mayor Pro Tem Kulchin, Council adopted RESOLUTION NO. 92-16, resolving an impasse in negotiations with the City of Carlsbad and the Carlsbad City Employees' Association and imposing a salary increase and other terms and conditions of employment covering the 1991-1992 fiscal year.
