HomeMy WebLinkAbout1992-02-04; City Council; Minutes. *. m {m MINUTES OF: CITY COUNCIL (Regular Meeting) DATE OF MEETING: February 4, 1992 TIME OF MEETING: 6:OO p.m. PLACE OF MEETING: City Council Chambers CALL TO ORDER: Mayor Lewis called the Meeting to order at 6:OO p.m. ROLL CALL was taken by the City Clerk, as follows: Present: Council Members Nygaard, Stanton, Larson, Kulchin and Mayor Lewis. Absent: None. INVOCATION was given by Mayor Lewis. PLEDGE OF ALLEGIANCE was led by Mayor Pro Tem Kulchin. APPROVAL OF MINUTES: On motion by Mayor Pro Tem Kulchin, Council approved the following: Minutes of the Special Meeting held January 7, 1992. Minutes of the Regular Meeting held January 7, 1992. Minutes of the Special Meeting held January 14, 1992. Minutes of the Regular Meeting held January 14, 1992. AYES : Lewis, Kulchin, Larson, Stanton and Nygaard CONSENT CALENDAR: ACTION: On motion by Mayor Pro Tem Kulchin, Council affirmed the action of the Consent Calendar, as follows: AYES : Lewis, Kulchin, Larson, Stanton and Nygaard WAIVER OF ORDINANCE TEXT READING: Council waived the reading of the text of all Ordinances and Resolutions at this Meeting . I9 1. AB #11,543 - ACCEPTANCE OF PUBLIC IMPROVEMENTS - MS NO. 749. Council accepted improvements, authorized the City Clerk to record the Notice of Completion and release bonds, and directed the Utilities and Maintenance Department to commence maintaining the public street and sewer improvements constructed at Garfield Street and Chinquapin Avenue. '9 2. AB #11,544 - DENIAL OF APPEAL - TENTATIVE MAP AND CONDOMINIUM PERMIT CT 90-33/CP 90-10 - GARDALITY CONDOMINIUM CONVERSION. Council adopted RESOLUTION NO. 92-43, denying the applicant's appeal and upholding the Planning Commission's denial of an application €or a tentative map and condominium permit to convert twelve single family apartment units to condominiums located at 2836-2908 Unicornio Street. PUBLIC COMMENT: There were no requests to address the Council at this time. 3s 'e '. February 4, 1992 Page 2 HOUSING AND REDFVELOPMENT COMMISSION: Council adjourned to the Housing and Redevelopment Commission at 6:06 p.m., and re-convened at 6:15 p.m., with all Members present. MUNICIPAL WATER DISTRICT: Council adjourned to the Municipal Water District at 6:15 p.m., and re- convened at 6:35 p.m., with all Members present. ' DEPARTMENTAL AND CITY MANAGER REPORTS: )9 3. AB S11.538 - EXTENSION OF CONDITIONS OF APPROVAL FOR ARROYO LA COSTA, RANCHO VERDE AND TIERRA SANTA FE - CT 88-03, CT 89-18 AND CT 90-4. ACTION: On motion by Council Member Larson, Council adopted RESOLUTION NO. 92-36, approving an extension to Condition No. 98 of Resolution No. 90-258; and RESOLUTION NO. 92-37, approving an extension to Condition No. 1 of Resolution No. 90-274; and RESOLUTION NO. 92-38, approving an extension to Condition No. 63 of Resolution No. 91-162. AYES : Lewis, Kulchin, Larson, Stanton and Nygaard 7 4. AB #11,545 - PROPOSED AMENDMENT TO CITY CARD ROOM ORDINANCE. ACTION: On motion by Mayor Pro Tem Kulchin, Council instructed the City Attorney to prepare documents amending the Municipal Code to allow the playing of card games at the Carlsbad Senior Center. AYES : Lewis, Kulchin, Larson, Stanton and Nygaard 0 5. AB #11,546 - CARLSBAD STATE BEACH PARKING FEES. 2 5 ACTION: On motion by Council Member Larson, Council adopted RESOLUTION NO. 92-44, authorizing an agreement with the California State Department of Parks and Recreation and the expenditure of funds for maintaining free parking at the Carlsbad State Beach, amended to include the following: "4. This resolution shall not act in any way or be deemed to be a waiver of any of the City's rights or abilities to obtain or pursue legal, legislative, or other methods to oppose the continued implementation of parking fees"; and Council instructed-the City Attorney to investigate other legal remedies in this matter, including, but not limited .to, intervening in the Surf Rider Foundation law suit. AYES : Lewis, Kulchin, Larson, Stanton and Nygaard 7 6. AB #11,547 - ORDINANCE REGULATING THE DISCHARGE OF BB AND PELLET GUNS. This item was withdrawn.
