HomeMy WebLinkAbout1992-05-12; City Council; MinutesL 0 MINUTES OF: CITY COUNCIL (Regular Meeting) DATE OF MEETING: May 12, 1992 TIME OF MEETING: 6:OO p.m. PLACE OF MEETING: City Council Chambers CALL TO ORDER: Mayor Lewis called the Meeting to order at 6:OO p.m. ROLL CALL was taken by the City Clerk, as follows: Present: Council Members Nygaard, Stanton, Larson, Mayor Pro Tem Kulchin and Mayor Lewis. Absent: None. PRESENTATION: Mayor,Lewis presented a Proclamation for NATIONAL ASSOCIATION OF INSURANCE WOMEN WEEK to representatives from the Association. APPROVAL OF MINUTES: On motion by Mayor Pro Tem Kulchin, Council approved the Minutes of the Special Meeting held April 28, 1992, as presented. AYES : Lewis, Kulchin, Larson, Stanton and Nygaard CONSENT CALENDAR: ACTION: On motion by Mayor Pro Tem Kulchin, Council affirmed the action of the Consent Calendar, as follows : AYES : Lewis, Kulchin, Larson, Stanton and Nygaard WAIVER OF ORDINANCE TEXT READING: Council waived the reading of the text of all Ordinances and Resolutions at this Meeting. .oo 1. AB #11,676 - SETTING DATE TO HEAR APPEAL OF DELINOUENT TAX. Council directed staff to set a hearing on June 9, 1992, to consider the appeal by Rapp & Luxenberg Development of their notice to pay delinquent Transient Occupancy Tax, interest and penalties. PRESENTATION: 8 AB #11,675 - SPECIAL PRESENTATION BY THE HISTORIC PRESERVATION COMMISSION FOR NATIONAL PRESERVATION WEEK: Marje Howard-Jones, Chairperson, Historic Preservation Commission, narrated a slide presentation entitled "Three Minute Success Story", which is a synopsis of the Historic Preservation Commission's success utilizing a variety of grant resources. Alan Kindle, 2622 El Aguila Lane, Friends of Carrillo Ranch, stated he wanted to re-emphasize the points made by the slide presentation with regard to the restoring of Carrillo Ranch. 108 0 0 t, May 12, 1992 Page 2 PUBLIC COMMENT: Mayor Lewis announced that there will be a Quadrant Meeting May 26, 1992, and that the Split Pavilion issue will be on the June 2, 1992, Council Agenda. Jerri Wolder, 5460 Carlsbad Boulevard, asked that the Split Pavalion item be heard no later than May 26, 1992, and read a letter expressing dissatisfaction with the Members of the Arts Commission. ORDINANCES FOR ADOPTION: 114 2. AB #11,680 - OFF-SITE REAL ESTATE SIGNAGE - ZCA 90-2. ACTION: On motion by Mayor Pro Tem Kulchin, Council adopted ORDINANCE NO. NS-199, amending Title 21 of the Carlsbad Municipal Code by amending Chapter 21.41 regarding off-site real estate signage. AYES : Lewis, Kulchin, Larson, Stanton and Nygaard -14 3. AB #11,681 - ADULT ENTERTAINMENT PERMIT REVIEW PROCESS - ZCA 91-8. ACTION: On motion by Mayor Pro Tem Kulchin, Council adopted ORDINANCE NO. NS-200,amending Title 21, Chapter 21.43 of the Carlsbad Municipal Code by the amendment of Section 21.43.110 to add time limits for processing adult entertainment permits. AYES : Lewis, Kulchin, Larson, Stanton and Nygaard MUNICIPAL WATER DISTRICT: Council adjourned to the Municipal Water District at 6:30 p.m., and re- convened at 6:31 p.m., with all Members present. DEPARTMEN!CAL AND CIm MANAGER REPORTS: Item 17 was taken out of order. '4 7. AB #11,682 - NONDISCRIMINATION POLICY. ACTION: On motion by Mayor Pro Tem Kulchin, Council adopted RESOLUTION NO. 92-128, declaring its intent to establish a discrimination-free work place. AYES : Lewis, Kulchin, Larson, Stanton and Nygaard 2 4. AB P11.677 - REVIEW OF SANDAG ALTERNATIVE REPORT ON AIR CARRIER AIRPORT SITES AND TECHNOLOGIES. Council received a presentation from SANDAG staff on the report "Review of Alternative Air Carrier Airport Sites and Technologies." 5 5. AB P11.678 - UPDATE ON SOLID WASTE MANAGEMENT ISSUES. Council received an update on Solid Waste Management Issues. /07 0 0 * May 12, 1992 Page 3 DEPARTMENTAL AND CITY MANAGER REPORTS: (Continued) 93 6. AB R11.679 - MASTER DRAINAGE AND STORM WATER OUALITY MANAGEMENT PLAN. 47 Louis Taschner, Attorney, 1533 South Hill Street, Suite D, Oceanside, submitted a letter dated May 12, 1992, addressed to the Mayor and Council Members, and stated he'would reserve comments until the.public hearing . ACTION: On motion by Mayor Pro Tem Kulchin, Council accepted the Master Drainage and Storm Water Quality Management Plan dated April 1992, and authorized staff to solicit public and industry comments and schedule a public hearing for adoption of the final report and implementing ordinances. AYES : Lewis, Kulchin, Larson, Stanton and Nygaard 74 7. AB #11,682 - NONDISCRIMINATION POLICY. This item was taken out of order. (See page 2) 74 8. AB #11,683 - AMENDMENT TO PERS CONTRACT FOR LOCAL MISCELLANEOUS AND $5 LOCAL FIRE MEMBERS. ACTION: On motion by Mayor Pro Tem Kulchin, Council adopted RESOLUTION NO. 92-129, a Resolution of Intention to approve an amendment to contract between the Board of Administration of the Public Employees' Retirement System and the City Council of the City of Carlsbad; and introduced ORDINANCE NO. NS-201, authorizing an amendment to the contract between the City Council and the Board of Administration of the California Public Employees' Retirement System. AYES : Lewis, Kulchin, Larson, Stanton and Nygaard COUNCIL REPORTS: Council Members reported on activities and meetings of the various Committees and Subcommittees of which they are Members.
