MINUTES
MEETING OF CITY COUNCIL (Regular Meeting)

CALL TO ORDER: Mayor Lewis called the Meeting to order at 6:00 p.m.
ROLL CALL was taken by the City Clerk, as follows:
Present: Council Members Finnila, Nygaard, Kulchin, Mayor Pro Tern Stanton and
Mayor Lewis.
Absent: None.
INVOCATION was given by Father AI Capuchin0 of Christ the King Orthodox Church.
PLEDGE OF ALLEGIANCE was led by Council Member Nygaard.
PRESENTATIONS:
Mayor Lewis presented Proclamations regarding "Red Ribbon Weel<" to Julie Gallegos and Heather
Kibbee of Mission Estancia Elementary School, and to Scott Fleming and Natalie Carver of La Costa
Heights Elementary School.
Mayor Lewis presented a Proclamation for "Prevention Month and Red Ribbon Week" to Elizabeth
Accardi of the Family Recovery Center.
Mayor Lewis presented a Proclamation for "Arts and Humanities Month" to Library Director Cliff Lange
and Arts Manager Connie Beardsley.
APPROVAL OF MINUTES:
On motion by Mayor Pro Tem Stanton, Minutes of the following meetings were approved as presented:
Minutes of the Special Meeting held September 20, 1994.
Minutes of the Regular Meeting held September 20, 1994.

ANNOUNCEMENF
Mayor Lewis announced that all Council Members have been invited to attend and participate in the
Mexican-American Association Annual Dinner to be held at Pea Soup Andersen's Restaurant, Carlsbad,
on Friday, October 7, 1994, at 6:OO P.M.

CONSENT CALENDAR:
Council removed Item No. 2 from the Consent Calendar.
ACTION: On Motion by Mayor Pro Tem Stanton, Council affirmed the action of the
Consent Calendar, Items #1 through #5, with the exception of Item No. 2, as
follows:

WAIVER OF ORDINANCE TEXT READING:
Council waived the reading of the text of all Ordinances and Resolutions at this Meeting.
1. AB #12,889 - SETTLEMENT OF PROPERTY CLAIM OF ANTOINETTE FREEMAN.
Council adopted Resolution No. 94-280, authorizing settlement of the property claim of
Antoinette Freeman and authorizing the Risk Manager to disburse payment of $6,546.92 from
the liability self-insurance reserve account.
2. AB #12,890 - ACCEPTANCE OF DONATION.
The item was removed from the Consent Calendar.
3. AB #12,891 - ACCEPTANCE OF DONATIONS.
Council adopted Resolution No. 94-282, accepting donations totaling $13,684 for the 1994
Labor Day weekend concert held September 4, 1994.
4. AB #12,892 - REQUEST FOR AUTHORITY TO DESTROY FILES.
Council adopted Resolution No. 94-283, authorizing destruction of certain files in the City
Clerkâs Office.
5. AB #12,893 - APPROVAL OF LITIGATION COST-SHARING AGREEMENT.
Council adopted Resolution No. 94-284, approving the Litigation Cost-Sharing Agreement for
the lawsuit challenging the increase in solid waste tipping fees, and authorizing the Mayor to
execute the agreement.
ITEM REMOVED FROM THE CONSENT CALENDAR:
2. AB #12,890 - ACCEPTANCE OF DONATION.
Mayor Lewis accepted a check, in the amount of $7,500, from the President of the Arts Associates to
be used towards the purchase of a portable outdoor stage and storage unit.
ACTION: On motion by Mayor Pro-Tem Stanton, Council adopted RESOLUTION NO. 94-281,
accepting a donation of $7,500 from the Carlsbad Arts Associates.

PUBLIC COMMENT:
Don Williams, 2560 Orion Way, representing the Carlsbad Police Officers Association, addressed
Council regarding the contract dispute. He stated that Carlsbad police officers have not received a pay
increase for the last three years, and their salaries are among the lowest in the county. Mr. Williams
questioned why administrators are paid so much when line officers are not, and questioned why the
city refuses to spend money from its cash reserve.
Inez Yoder, 7738 Madrilena Way, spoke regarding the myth of growth, and stated that growth is not
the solution to the City's economic problems.
Assistant City Manager Frank Mannen responded to the remarks regarding the negotiations with the
Carlsbad Police Officers Association. He reported that the City had offered a contract for the period
July, 1994, through December 1995, which included a $1 200 cash payment for each officer, and a
three percent salary increase effective January, 1995. Mr. Mannen also stated that this matter will need
to go through the impasse process, and that if the matter cannot be resolved, it may be referred to the
City Council.
Human Resources Director Ann Jensen reported that the City's police officers compensation is
currently ranked seventh out of the ten agencies in the county survey group, and that the City's
proposal would have increased them to fourth position.
PUBLIC HEARINGS:
99 6. AB #12,894 - APPEAL OF MINOR SUBDIVISION NO. 93-2 - ALDER ESTATES.
City Manager Ray Patchett stated that a letter dated October 4, 1994, had been received from the
appellant withdrawing their appeal and requesting a refund of the appeal fee.
ACTION: On motion by Council Member Kulchin, Council directed staff to refund the
$490.00 appeal fee.

77 7. #12,895 - AMENDMENT TO LOCAL FACILITIES MANAGEMENT PLAN FOR ZONE 21 - LFMP 87-2 1 (A).
Mayor Lewis opened the duly noticed Public Hearing at 6:43 p.m., and issued the invitation to speak.
Since no one wished to speak on this matter, the Public Hearing was closed.
ACTION: On motion by Mayor Pro Tem Stanton, Council directed the City Attorney to
prepare documents approving the revisions to the Circulation and School
Facilities section of the Local Facilities Management Plan for Zone 21, with the
amendment of the circulation condition to replace the word "adjacent" with the
word "contiguous".

HOUSING AND REDEVELOPMENT COMMISSION:
Council adjourned to the Housing and Redevelopment Commission at 6:43 p.m., and re-convened at
6:44 p.m., with all five Members present.
COUNCIL REPORTS:
Council Members reported on the activities and meetings of the Committees and Subcommittees of
which they are Members.
ADJOURNMENT
By proper motion, the Meeting of October 4, 1994, was adjourned at 6:53 p.m.
