MINUTES
MEETING OF: CITY COUNCIL (Special Meeting)

CALL TO ORDER: Mayor Lewis called the meeting to order at 10:15 am.
ROLL CALL:
Present: Council Members Kulchin and Mayor Lewis.
Absent: Council Members Nygaard, Finnila and Hall.
37 WORKSHOP WITH ASSEMBLY MEMBER BILL MORROW
1. Update on Current Leaislative Issues.
Assembly Member Morrow updated Council on legislative activities since the November, 1994 election.
He also summarized the content of the Tort Reform legislation, Senate Bills 31 and 994. Council
responded affirmatively to Assembly Member Morrow's question about the possibility resurrecting the
bill which would add skate boarding to the list of hazardous recreational activities.
2. San Diego Water Authority Representation.
Mayor Lewis stated that there are currently 34 members on the San Diego Water Authority. City
Councils are prohibited from appointing a Council Member as their representative on the Board unless
their water district is a subsidiary district of the City. Otherwise, they have to appoint either a staff
person or a citizen. Mayor Lewis questioned whether Assembly Member Morrow would sponsor
legislation to modify that restriction.
The City Attorney clarified the matter stating that the restriction was the result of determinations being
made under the "incompatible offices" statute.
It was noted that City staff would send additional information to Assembly Member Morrow concerning
the matter.
3. Prohibition of Contractors from Bidding on Projects if Involved in Lawsuit with Local Agencv.
The City Attorney explained that public bidding law requires cities to award public works contracts to
the lowest responsible bidder, and there are very few categories which allow the city to determine that
a bidder is not responsive. In that regard, the City would like to add an additional category which
would prohibit a contractor from bidding on city jobs temporarily while they are involved in litigation
with the city on a previous job.
Discussion resulted around possible wording which could be used that would not unfairly restrict
someone from bidding on a city job. Staff indicated they would send additional information to
Assembly Member Morrow.
