HomeMy WebLinkAbout1997-03-11; City Council; Minutesri e 0 MINUTES MEETING OF : CITY COUNCIL (Regular Meeting) DATE OF MEETING: March 11,1997 TIME OF MEETING: 6:OO p.m. PLACE OF MEETING: City Council Chambers CALL TO ORDER: Council Member Nygaard called the Meeting to order at 6:OO p.m. ROLL CALL was taken by the Assistant City Clerk, as follows: Present: Council Members Hall, Kulchin and Nygaard Absent: Mayor Pro Tem Finnila and Mayor Lewis ANNOUNCEMENTS: Council Member Nygaard announced that Council Members have been invited to attend and participate in the following event: SANDAG Workshop - Population Growth, Land Use and Visions for 2050, to be held on Friday, March 14, 1997, from 11 a.m. to 4 p.m., at the Hyatt Regency, 3777 La Jolla Village Drive, La Jolla. CONSENT CALENDAR: ACTION: On motion by Council Member Kulchin, Council unanimously affirmed the action of the Consent Calendar, Items # 1 through #7, as follows: WAIVER OF ORDINANCE TEXT READING: Council waived the reading of the text of all Ordinances and Resolutions at this Meeting. 39 1. AB #14,080 - REPORT ON CITY INVESTMENTS. Council approved the City Treasurer’s report on the status of city investments as of January 3 1, 1997. Council adopted RESOLUTION NO. 97-95, accepting the Public Improvements, authorizing the City Clerk to record the Notice of Completion, release bonds, and directing the Community Services Department to commence maintaining the public improvements constructed at the southwest corner of the intersection of Calle Barcelona and Calle Acervo, Vista Santa Fe Area “B’, CT 85-09. 99 3. AB # 14,082 - ACCEPTANCE OF PUBLIC IMPROVEMENTS FOR SEAPOINTE RESORT, CT 93-10. Council adopted RESOLUTION NO. 97-96, accepting the Public Improvements, authorizing the City Clerk to record the Notice of Completion, release bonds, and directing the Community Services Department to commence maintaining the public improvements constructed between Carlsbad Boulevard and Avenida Encinas, south of Palomar Airport Road, Seapointe Resort, CT 93-10. 99 4. AB #14,083 - ACCEPTANCE OF PUBLIC IMPROVEMENTS FOR AVIARA, UNIT E, CT 85- - 35. Council adopted RESOLUTION NO. 97-97, accepting the Public Improvements, authorizing the City Clerk to record the Notice of Completion, release bonds, and directing the Community Services Department to commence maintaining the public improvements constructed south of Aviara Parkway and west of Aviara Drive, Aviara Unit E, CT 85-35. 99 5. AB # 14.084-ACCEPTANCE OF PUBLIC IMPROVEMENTS FOR TIERRA SANTA FE. CT 90- - 4. Council adopted RESOLUTION NO. 97-98, accepting the Public Improvements, authorizing the City Clerk to record the Notice of Completion, release bonds, and directing the Community Services Department to commence maintaining the public improvements constructed on the north side of Calle Barcelona between west of Calle Acervo and Rancho Santa Fe, Tierra Santa Fe, CT 90-04. 99 6. AB #14,086 - ACCEPTANCE OF PUBLIC IMPROVEMENTS FOR AVIARA, PLANNING AREA 27, CT 90-34. Council adopted RESOLUTION NO. 97-100, accepting the Public Improvements, authorizing the City Clerk to record the Notice of Completion, release bonds, and directing the Community Services Department to commence maintaining the public improvements constructed north of Batiquitos Drive between Kestrel Drive and Aviara Drive, Aviara PA 27, CT 90-34. PUBLIC COMMENT: There were no requests to address Council. DEPARTMENTAL AND CITY MANAGER REPORTS: 57 8. AB # 14,087 - HOUSING PRODUCTION REPORT FOR FISCAL YEAR 1995- 1996. ACTION: On motion by Council Member Kulchin, Council accepted the staff report on housing production for the reporting period, July 1,1995 to June 30,1996. AYES: Nygaard, Kulchin and Hall 30 9. AB #14,088 - MODIFICATION TO THE BUILDING CODE TO PREVENT THE USE OF WOOD SHAKES AND SHINGLES AS ROOF COVERINGS. Pat Kelley presented the staff report, reviewed the history and damage caused by the Harmony Grove Fire, including the fact that the majority of the homes destroyed during the fire had wood shake or shingle roofs. He explained staffs reasons for determining that Class B roofs should no longer be permitted in Carlsbad due to local climatic and topographical conditions. Following the staff report, Fire Chief Van der Maaten stated his concerns with regard to existing fire hazards and a variety of ways to eliminate them and build a more fire safe community. He also spoke of the need to develop defensible spaces between wildlands and homes. Retired Fire Chief Girard W. Anear, 3747 Vista Compaiia So., Unit #44, Oceanside, spoke of how weather conditions relate to fires and also stated that a new fxeproofketardant aluminum and galvanized steel roof shingle is now available and is offered in ten different colors. He also warned against using fiberglass andor polyester fibre shingles that are not fire rated. City Attorney Ron Ball referenced a letter received from Larry Livingston, Legislative Advocate of the Buildmg Industry Association of San Diego County, dated March 10, 1997, requesting consideration of reducing or rescinding fees for re-roofing homes for greater fire protection, (a copy of which is on file in the office of the City Clerk) and suggested that the Council may wish to refer it to staff. ACTION: On motion by Council Member Kulchin, Council introduced ORDINANCE NO. NS-398, amending Title 18, Chapter 18.04, Section 18.04.230 of the Code amending the City’s adopted Uniform Building Code, to require the use of Class A roof coverings, and to prevent the use of wood shake or shingle roof coverings for all new buildings and for all buildings re-roofed within the City. AYES: Nygaard, Kulchin and Hall .* 0 0 March 1 1, 1997 CITY COUNCIL Page 4 By unanimous consensus, Council referred the above referenced letter from the Building Industry Association of San Diego County, to staff.
