CALL TO ORDER: Mayor Lewis called the Meeting to order at 5:OO p.m.
ROLL CALL was taken by the City Clerk, as follows:
Present: Council Members Hall, Kulchin, Nygaard, Mayor Pro Tern Fimila, Mayor Lewis
PUBLIC COMMENT ON AGENDA ITEMS: None.
1. AB #14,822 - ACOUISITION OF PROPERTY.
ACTION: On motion by Mayor Pro Tem Finnila, Council adopted RESOLUTION NO. 98-285,
approving property acquisition, ratifying the Mayor’s signature as the City’s authorized
representative on the escrow instructions, accepting the Planning Commission’s finding of
General Plan consistency for the purpose of the subject property, authorizing the release of
funds for the purchase of 10 acres of property located between Newton Drive and Faraday
Avenue, and more specifically identified as Assessor Parcel Numbers (APN) 212-050-13,
36, 37, 38 and 39, for a parklrecreational facility.
AYES: Lewis, Finnila, Nygaard, Kulchin, Hall
Council adjourned to Closed Session at 5:04 p.m., with four Council Members present, and Council Member Hall
absent to discuss the following two items:
CLOSED SESSION:
3. PENDING LITIGATION.
The San Dieno Gas & Electric v. Citv of Carlsbad, pending litigation, Case No. U 902E, pursuant to
Government Code Section 54956.9(a).
4. ACOUISITION OF REAL PROPERTY.
The acquisition or potential acquisition of real property at the site of and surrounding the Encina Power
Plant, and generally identified as APNs 210-010-11, 210-010-24, 210-010-26, 210-010-32, 210-010-36,
206-070-10, 206-070-11, 211-010-24, 21 1-010-26, 211-010-27, Property Owner SDG&E, pursuant to
Government Code Section 54956.8.
RECESS:
Council recessed at 7:OO p.m., and reconvened at 7:lO p.m., with four Council Members present, and Council
Member Hall absent.

Council Member Hall joined the Council in Closed Session at 7:55 p.m., to discuss the following item:
2. ACOUISITION OF REAL PROPERTY.
The acquisition or potential acquisition of real property located in the Carlsbad Research Center, and
generally identified as Lot 106 of Carlsbad Research Center, approximately 4 acres, APN 212-130-3 1-00,
Property Owner: Real Estate 2, LLC, pursuant to Government Code Section 54956.8.
Council reconvened at 8: 15 p.m. with all Council Members present. Mayor Lewis announced that Council had
heard the information, and instructed staff and the Attorney regarding the items.
