MINUTES
MEETING OF : CITY COUNCIL (Regular Meeting)

CALL TO ORDER: Mayor Lewis called the Meeting to order at 6:OO p.m.
ROLL CALL was taken by the City Clerk, as follows:
Present: Council Members Hall, Kulchin, Nygaard, Mayor Lewis
Absent: Mayor Pro Tern Finnila
APPROVAL OF MINUTES:
ACTION: On motion by Council Member Kulchin, the Minutes of the following meetings
were approved as presented:

Minutes of the Regular Meeting held October 13, 1998

PRESENTATION:
Mayor Lewis presented a Proclamation to Judi Strang, Executive Director, San Dieguito Alliance for
Drug Free Youth, proclaiming the week of October 23 - 3 1, 1998, as “Red Ribbon Week”.
ANNOUNCEMENTS:
Mayor Lewis announced that Council Members have been invited to attend, and may be participating in
the following events:
Skateboard Park Dedication, Wednesday, October 28, 1998, 3:30 p.m., located next to the Safety
Center at 2560 Orion Way, Carlsbad.
Closed Session for Council, Friday, October 30, 1998, 12:OO p.m., at the Council Chambers, 1200
Carlsbad Village Drive, Carlsbad.
Candidate’s Forum, Saturday, October 31, 1998, 9:OO a.m., at the Lakeshore Gardens at Avenida
Encinas and Poinsettia Lane, Carlsbad.

CONSENT CALENDAR:
Item #1 was removed from the Consent Calendar.
ACTION: On motion by Council Member Kulchin, Council affirmed the action of the
Consent Calendar, Items #1 through #5, with the exception of Item #1, as follows:

WAIVER OF ORDINANCE TEXT READING:
Council waived the reading of the text of all Ordinances and Resolutions at this Meeting.
1. AB #14.905 - CARLSBAD CONVENTION AND VISITOR’S BUREAU REPORT.
This item was removed fi-om the Consent Calendar.
2. AB #14,906 - INTERIM USE AGREEMENT TO RENT SPACE TO ACCOMMODATE SAN
DIEGUITO UNION HIGH SCHOOL DISTRICT FLEET.
Council adopted RESOLUTION NO. 98-351, approving an interim use agreement with San
Dieguito Union High School District to lease space at the Fleet Operations Yard for school bus
parking and service.
3. AB #14,907 - FINAL MAP FOR CARLSBAD TRACT NO. 93-09(A). OCEAN BLUFF.
Council adopted RESOLUTION NO. 98-352, approving the Final Map for Carlsbad Tract No.
93-09(A), Ocean Bluff and authorizing the City Clerk to process the map for recordation.
4. AB #14.908 - SUPPORT OF PROPOSITION L ON THE MARCH 2, 1999 SPECIAL
ELECTION.
Council adopted RESOLUTION NO. 98-353, supporting Proposition L, to be placed on the
March 2, 1999 Special Election Ballot, and appropriating funds to satis6 the City of Carlsbad’s
pro-rata share of the cost of that election.
5. AB #14,913 - LEASE AGREEMENT AND SPACE PLANNING AGREEMENT FOR CITY
DEVELOPMENT AND ADMINISTRATION FACILITY.
Council adopted RESOLUTION NO. 98-357, approving a lease agreement with Faraday
Business Plaza, LLC, and approving an extension and amendment to the agreement with IR2
Interior Resource, Inc., for space planning.

ITEM REMOVED FROM THE CONSENT CALENDAR:
1. AB #14,905 - CARLSBAD CONVENTION AND VISITOR’S BUREAU REPORT.
Steve Link, Manager of the Convention and Visitors Bureau, 1616 Avenida Guillermo, Oceanside, gave
an overview of the quarterly report for the period ending July 3 1, 1998.
ACTION: On motion by Council Member Kulchin, Council accepted the report for the
period of May 1, 1998 through July 31, 1998.

ORDINANCE FOR ADOPTION:
6. AB #14,914 - SP 210(A) - POINSETTIA PROPERTIES SPECIFIC PLAN.
ACTION: On motion by Council Member Kulchin, Council adopted ORDINANCE NO.
NS-460, amending the Poinsettia Properties Specific Plan by the amendment of
various sections, incorporating the California Coastal Commission’s suggested
modifications.

PUBLIC COMMENT:
There were no requests to address the Council.
PUBLIC HEARING:
7. AB #14,909 - CT 98-03/CP 98-01 - RANCHO CARRILLO VILLAGE A.
Mayor Lewis opened the duly noticed public hearing at 6:30 p.m., and issued the invitation to speak.
Mike Howes, Hofman Planning Associates, 5900 Pasteur Court #150, Carlsbad, stated that he concurred
with staffs recommendation and the conditions of approval.
Russ Haley, 10721 Trina Street, San Diego, representing Shea Homes, responded to Council query stating
that Shea Homes has a “wrap-up insurance program” which insures all of their subcontractors, thereby
allowing them to build attached housing.
Seeing no one else wishing to speak, Mayor Lewis closed the public hearing at 6:33 p.m.
ACTION: On motion by Council Member Kulchin, Council adopted RESOLUTION NO.
98-354, approving a Tentative Map and Planned Development Permit to allow a
one lot subdivision and condominium permit on the property which will allow for
the development of 169 multi-family attached dwelling units all on property
generally located south of Palomar Airport Road, east of Melrose Drive and north
of Poinsettia Lane.

CARLSBAD MUNICIPAL WATER DISTRICT BOARD. HOUSING AND REDEVELOPMENT
COMMISSION, AND CITY COUNCIL JOINT SPECIAL MEETING:
Mayor Lewis convened a Joint Meeting of the City Council, Carlsbad Municipal Water District Board,
and Housing and Redevelopment Commission at 6:35 p.m.
CARJSBAD MUNICIPAL WATER DISTRICT BOARD AND CITY COUNCIL JOINT SPECIAL
MEETING:
Mayor Lewis convened a Joint Meeting of the City Council and Carlsbad Municipal Water District Board
at 6:36 p.m.
DEPARTMENTAL AND CITY MANAGER REPORTS:
10. AI3 #14,912 - ESTABLISHMENT OF NINETY-MINUTE PARKING TIME LIMIT FOR
PARKING SPACES AT THE SWIM COMPLEX.
Traffic Engineer Bob Johnson, gave the report stating this was a request by Carl Pope, the Aquatic
Supervisor at the Carlsbad Swim Complex. This request is to designate the 13 spaces located to the south
of the swimming complex as ninety-minute parking and is consistent with the restriction on the east side
of the complex.
Mayor Lewis stated that in order to solve the problem, the parking restriction would have to be signed and
enforced.
ACTION: On motion by Council Member Kulchin, Council introduced ORDINANCE NO.
revision of Section 10.40.076 to declare "Ninety-Minute Parking, Twenty-Four
Hours Per Day, Seven Days Per Week" for the parking spaces in the parking lot
directly south of and adjacent to the swimming pool at the Carlsbad Community
Swim Complex.

PUBLIC COMMENT:
Gwynne Hodge, 3027 Via Sabinas, Carlsbad, stated that there have been a lot of traffic problems through
the Tanglewood Complex and requested that staff be directed to proceed with one of the following
actions, in order of preference: (1) turn over the main streets surrounding the complex to the homeowners
association so that they may be made into private streets and gated; (2) install stop signs at Avenida de
Anita in all intersections; (3) install speed bumps along the long stretches of road on Avenida de Anita; or
(4) turn Avenida de Anita into a cul-de-sac at Calle Suzanna.
Council requested staff to place the matter on a future agenda with a report concerning the requests. In
the meantime, the Police Department was asked to enforce the speed limit in the area.

Council Members reported on the activities and meetings of some committees and sub-committees of
which they are members.
