Mayor Lewis called the Meeting to order at 4:34 p.m. ROLL CALL was taken by the Assistant City Clerk as follows: Present: Council Members Hall, Kulchin, Finnila, and Mayor Lewis Absent: Council Member Nygaard PUBLIC COMMENT ON AGENDA ITEMS: None. CLOSED SESSION: Council adjourned to Closed Session at 4:34 p.m., for discussion of Item No. 3 regarding the following: 3. CLOSED SESSION - ACQUISITION OF REAL PROPERTY. The acquisition or potential acquisition of 2.699 acres of real property located in the Carlsbad Research Center, more specifically, Lot 96 of Carlsbad Research Center, Property Owner: L/M Properties LLC, pursuant to Government Code Section 54956.8. Council Member Hall left the Closed Session at the conclusion of Item No. 3, at 4:57 p.m., and Council continued the Closed Session for discussion of Item Nos. 1 and 2, regarding the following: 1. PENDING LITIGATION. The Matter of the Application of San Diego Gas & Electric Company (U 902E) for Authority to Sell Electrical Generation Facilities and Power Contracts, A-97-12-039, pending litigation, pursuant to Government Code Section 54956.9(a). 2. INITIATION OF LITIGATION. Initiation of litigation involving San Diego Gas & Electric Company and the acquisition of the Encina Power Plant site and its associated properties, pursuant to Government Code Section 54956.9(c). Council reconvened at 6:OO p.m. with three Council Members present and Council Members Nygaard and Hall absent. Mayor Lewis announced that Council had heard the information, and instructed staff and the Attorney regarding the items. Respectfully submitted, Assistant City Clerk
