CALL TO ORDER: Mayor Lewis called the Meeting to order at 5:OO p.m.
ROLL CALL was taken by the Assistant City Clerk as follows:
Present: Council Members Kulchin, Nygaard, Mayor Pro-Tem Finnila, and Mayor Lewis
Absent: Council Member Hall (Hall arrived at 6:20 p.m.)
PUBLIC COMMENT ON AGENDA ITEMS: None.
CLOSED SESSION:
Council adjourned to Closed Session at 5:OO p.m., to discuss the following:
1. PENDING LITIGATION.
The Matter of the Application of San Diego Gas & Electric Company (U 902E) for Authority to Sell
Electrical Generation Facilities and Power Contracts, A-97-12-039, pending litigation, pursuant to
Government Code Section 54956.9(a).
2. INITIATION OF LITIGATION.
Initiation of litigation involving San Diego Gas & Electric Company and the acquisition of the Encina
Power Plant site and its associated properties, pursuant to Government Code Section 54956.9(c).
Council Member Hall arrived at 6:20 p.m., and Council continued the Closed Session to discuss the following:
3. CLOSED SESSION - PENDING LITIGATION.
Pending litigation, Schmidt v. Citv of Carlsbad, Case No. N76530, pursuant to Government Code
Section 54956.9(a).
RECESS:
Council recessed at 7:OO p.m., and reconvened in Closed Session at 7:05 p.m. with all five Council Members
present, to discuss the following:

4. CLOSED SESSION - NEGOTIATIONS.
Employer-employee relations and negotiations with the CFA, CCEA, CPOA, and Police Management
Association employee organizations, and unrepresented employees.
Council reconvened at 8:26 p.m., with all Council Members present. Mayor Lewis announced that Council had
heard the information, and instructed staff and the Attorney regarding the items.
