CALL TO ORDER: Mayor Lewis called the Meeting to order at 6:00 p.m.
ROLL CALL was taken by the City Clerk, as follows:

PROCLAMATION:
Mayor Lewis presented a proclamation to Kevin Radcliffe, representing the Optimist
Club of Carlsbad, declaring May 7-13, 2000, “Respect for Law Week”.
APPROVAL OF MINUTES:
On a motion by Mayor Pro Tern Hall Minutes of the following meetings were
unanimously approved:
Minutes of the Special Meeting held April 25, 2000
Minutes of the Regular Meeting held April 25, 2000
CONSENT CALENDAR:
ACTION: On a motion by Mayor Pro Tern Hall, Council affirmed the action of the
Consent Calendar, Items #I through #3, as follows:

WAIVER OF ORDINANCE TEXT READING:
This is a motion to waive the reading of the text of all ordinances and resolutions at this

AB #I5720 - STOCKPILE AGREEMENT FOR CARLSBAD TRACT 97-lO/CDP
97-16, POINSETTIA PROPERTIES, LOCAL FACILITIES MANAGEMENT ZONE
22.
Council adopted RESOLUTION NO. 2000-138, approving the stockpile
agreement for Poinsettia Properties in Local Facilities Management Zone 22 for
Lots 1, 2, and 3, on property generally located at the northwest corner of Avenida
Encinas and Poinsettia Lane.
AB #I5721 - APPROVAL OF AMENDMENT NO. 2 TO AGREEMENT WITH
O’DAY CONSULTANTS, INC. FOR CANNON ROAD WEST - PROJECT NO.
3184
Council adopted RESOLUTION NO. 2000-139, approving Amendment No. 2 to
Agreement for Design Services and Construction Support for Cannon Road
West with O’Day Consultants, Inc. to allow for additional construction support
services.
AB #15,722 - REFUND TO SMURFIT PRESS FOR BUSINESS LICENSE TAX.
Adopting RESOLUTION NO. 2000-140, authorizing a refund to Smut-fit Press in
business license tax, due to their cessation of business activity.
ADOPTION OF ORDINANCES:
4. AB #15,723 - AMENDING THE CARLSBAD MUNICIPAL CODE REQUIRING
STOPS ON CALLE BARCELONA AT PASEO ALISO.
ACTION: On a motion by Mayor Pro Tern Hall, Council adopted
ORDINANCE NO. NS-540 amending Title 10, Chapter 10.28 of the
Carlsbad Municipal Code by the addition of Section 10.28.570
requiring stops on Calle Barcelona at Paseo Aliso.

5. AB #15,724 - AMENDING THE CARLSBAD MUNICIPAL CODE REQUIRING
STOPS ON CALLE BARCELONA AT PASEO ALISO.
Adopting Ordinance No. NS-541 amending Title 10, Chapter 10.28 of the
Carlsbad Municipal Code by the addition of Section 10.28.580 requiring stops on
Calle Barcelona at Paseo Aliso.
ACTION: On a motion by Mayor Pro Tern Hall, Council adopted
ORDINANCE NO. NS-541 amending Title 10, Chapter 10.28 of the
Carlsbad Municipal Code by the addition of Section 10.28.570
requiring stops on Paseo Aliso at Calle Barcelona.

Ellen Flanagan, 6930 Wildrose Terrace, President of the Childcare Association,
announced that the Childcare Economic Summit would be held on May 31, 2000 at the
California Center for the Arts, Escondido.
Mayor Lewis announced that Council Members have been invited to attend, and may
be participating in the following events:
Friday, May 12, 2000, 5:30 p.m., Carlsbad Library Hourly Employee Recognition Event,
Carlsbad Senior Center, 799 Pine Avenue, Carlsbad.
Sunday, May 14, 2000, 3:00 p.m., Annual Festejando a Las Madrecitas Event (Mother’s
Day Recognition), Holiday Park, Chestnut and Pio Pica, Carlsbad.
DEPARTMENTAL AND CITY MANAGER REPORTS:
6. AB #15,725 - REQUEST FOR EXEMPTION FROM MORATORIUM IN “OLDE
CARLSBAD” FOR SEAVIEW g-LOT SUBDIVISION - CT 98-21.
Joe Gallagher, 1165 Hoover Street, spoke in support of his request for The Seaview
Subdivision to be removed from the moratorium.
Lloyd Hubbs, Director of Public Works, reviewed the staff report.

ACTION: On a motion by Mayor Pro Tern Hall, Council granted the waiver
and exempted the project known as Seaview g-Lot Subdivision
from the Urgency Ordinance prohibiting the issuance of building
and/or grading permits for projects processed under Titles 20 or 21
of the Carlsbad Municipal Code, located within the area known as
“Olde Carlsbad”.

104 7. AB #15,726 - PRESENTATION ON THE FAST FORWARD STRATEGIC PLAN BY
THE NORTH COUNTY TRANSIT DISTRICT.
Karen King, Director of Development and Communication Services, North County
Transit District, reviewed a report entitled “Fast Forward: Transit Solutions for the 21”
Century” (on file in the City Clerk’s Office). She answered questions from Council
regarding ridership and travel along the corridor.
No action was required or taken on this item.
68 8. AB #15,727 - PRESENTATION ON STATE-LOCAL FISCAL REFORM BY
SANDAG (SAN DIEGO ASSOCIATION OF GOVERNMENTS)
Ken Fabricatore, Project Manager, San Diego Association of Governments (SANDAG),
401 B Street, Suite 800, San Diego, distributed a booklet entitled Achievino Fiscal
Reform in California - San Dieoo Association of Governments. He reviewed SANDAG’s
proposal for state-local fiscal reform and answered Council questions on how it might
impact schools, property tax and the City of Carlsbad.
Council Member Finnila spoke in support of SANDAG’s proposal. However, Mayor
Lewis said he would need additional information. He asked that SANDAG give periodic
updates to Council.
Discussion ensued regarding the four principals for state and local reform identified in
Achievinq Fiscal Reform in California - San Diego Association of Governments. In
response to Council Member Finnila, Mr. Fabricatore explained the intent of “strengthen
growth management incentives”.
Ron Ball, City Attorney, said that staff would return to Council with a report on the
impacts to the City of Carlsbad under SANDAG’s proposal. He noted that would be the
appropriate time to take action on the four principals. Council concurred
(No Council action was required or taken. This item was for information only.)

9. AB #15,728 - REVISION OF MUNICIPAL CODE 8.36 PROHIBITING CAMPING
ON PUBLIC PROPERTY EXCEPT IN AREAS SPECIFICALLY AUTHORIZED FOR
SUCH ACTIVITY
Police Chief Bob Vales reviewed the staff report.
ACTION: On a motion by Mayor Pro Tern Hall, Council introduced ORDINANCE
NO. NS-542, amending Chapter 8.36 of the Carlsbad Municipal Code to
prohibit camping on public property, except in designated areas.

10. AB #15,729 - DESIGNATING “NO PARKING” ON THE EASTERLY SIDE OF THE
CARLSBAD BOULEVARD SOUTHBOUND LANES FROM PALOMAR AIRPORT
ROAD TO A POINT 535 FEET SOUTH.
Bob Johnson, Deputy City Engineer, reviewed the staff report.
ACTION: On a motion by Mayor Pro Tern Hall, Council introduced ORDINANCE
NO. NS-543 amending Title 10, Chapter 10.40 of the Carlsbad Municipal
Code by the addition of Section 10.40.041(b)(5) to designate NO
PARKING from 1 I:00 p.m. to 5:00 a.m. on the easterly side of the
southbound lane of Carlsbad Boulevard from Palomar Airport Road to a
point 535 feet south of Palomar Airport Road.

11. AB #15,730 -APPOINTMENT TO THE BEACH EROSION COMMITTEE.

ACTION: On a motion by Mayor Lewis, Council appointed Norine Sigafoose
to the Carlsbad Beach Erosion Committee to fill the remainder of
the term to June, 2002.

COUNCIL REPORTS AND COMMENTS
Council Member Nygaard said that May is “Bike Safety Month” and that Carlsbad’s Bike
Rodeo for elementary school children will be held May 20, 2000 from 9:00 a.m. to 2:00
p.m. at 2525 El Camino Real in the Sears parking lot.
Council Member Finnila said B-17 and B-24 Airplanes will be displayed at Palomar
Airport on May 11, 2000 through May 14, 2000. Tours will be available.
Council Member Finnila also announced that Daniel’s Cablevision won the Beacon
Award for the production of the Carlsbad State of the City Video.
Mayor Lewis said he has met with the Chief of Staff for Senator Morrow regarding
matching funds for the police shooting range.
Mayor Lewis said he has asked staff to present an update to Council regarding the
water rate structure.
