CALL TO ORDER: Mayor Lewis called the Regular Meeting to order at 6:00 p.m.

PRESENTATIONS:
Judi Strang, Executive Director, San Dieguito Alliance for Drug Free Youth, accepted a
Proclamation from Mayor Lewis in recognition of Red Ribbon Week - October 23-31.
Ms. Strang introduced the representatives from various schools in Carlsbad and
Encinitas, who each received a proclamation.
CONSENT CALENDAR
ACTION: On a motion by Mayor Pro Tern Hall, Council affirmed the action of the
Consent Calendar, Items # 1 and 2, as follows:

WAIVER OF ORDINANCE TEXT READING:
This is a motion to waive the reading of the text of all ordinances and resolutions at this
meeting.
81 1. AB #15,940 - APPROVAL OF A QUITCLAIM OF EXISTING SEWER
EASEMENT - CRC LOT 12 - PR 0045.
Council adopted RESOLUTION NO. 2000-327, quitclaiming a Deed of Easement
to DSK Carlsbad Partners for sewer purposes over a portion of CRC Lot 12.

81 2. AB #15,941 - AUTHORIZATION OF THE PURCHASE OF ADDITIONAL
PROPERTY FOR USE AT 2075 LAS PALMAS DRIVE.
Council adopted RESOLUTION NO. 2000-328, approving all documents
associated with the acquisition from the Hawthorne Family Trust of a portion of
the property for the purpose of additional parking at 2075 Las Palmas Drive.
PUBLIC COMMENT
Michele Levy, 3021 Highland, expressed concern that trees in the public right-of-way
were removed near the James Canyon project without following the Tree Policy. She
asked that a sign stating “patrons only” be posted in the Cole Library parking lot.
Dr. Jack Debes, 4055 Park Drive, expressed concern that trees in the public right-of-
way were removed near the James Canyon project without following the Tree Policy.
In response to Council, Ray Patchett, City Manager, explained that the James Canyon
Project was conditioned to plant replacement trees along Hillside Avenue. He said that
Magnolia Trees were planted and will grow to be approximately 50 feet high at maturity.
In response to Council, Lloyd Hubbs, Director of Public Works, said typically, box trees
are 1 O-l 5 feet tall. He explained that the developer’s contractor incorrectly removed the
trees along Hillside and the penalty for removal was the planting of the Magnolia Trees.
Larry Stapleton, 920 Rosemary, spoke of the need for additional inland roads. He
expressed concern that there are no rules in place regarding Palomar Airport’s growth.
Concern was also expressed that SANDAG is not meeting Carlsbad’s transportation
needs. Mr. Stapleton said that businesses in the Village Area lose money during the
days of special events. Mr. Stapleton said the golf course should be built and the
property not sold. Mr. Stapleton also spoke in support of terms limits for the mayor and
council members.
In response to Council, Mr. Hubbs presented a brief history of College Avenue and the
surrounding projects. He explained that the opening of College Avenue is being delayed
to study growth management and safety issues.
Mr. Hubbs explained the City of Carlsbad is only one member of the 18 members on
SANDAG (the transportation planning organization for the County of San Diego). There
is a finite amount of resources and the City has been successful in receiving a
significant amount of state and federal money for street projects.
In response to Council, Mr. Hubbs explained the environmental issues related to the
improvements of the Highway 78/l-5 Interchange. He said that the City is aggressively
pursuing CALTRANS to proceed with the project.
Mr. Hubbs explained how the City of Carlsbad coordinates development project with
road improvements.

Mayor Lewis explained that the County of San Diego is the controlling agency of
Palomar Airport. He said that the City is working with churches and business in the
Village Area to address their concerns during special event days.
In response to Council, Michael Holzmiller, Planning Director, said that the owners of
Box Canyon have been trying to turn the property over to a state agency or
conservancy. The property is designated in Carlsbad’s General Plan as open space.
There are no plans to develop the canyon, but there is a proposal for the vacant
privately owned adjacent land.
Doug Char-tier, 2697 Wilson Street, expressed concern that redevelopment dollars have
not been used to provide additional parking in the redevelopment area. He expressed
concern that the Business Improvement District will result in double taxation. Mr.
Char-tier said there is a need for additional beach parking.
Council Member Nygaard explained that the City is funding the study of the Business
Improvement District in response to the merchants in the Village Area.
In response to Council, Debbie Fountain, Housing and Redevelopment Director,
presented a history of the creation of parking spaces in the redevelopment area. She
noted that the recent Parking Program Study determined that there is an adequate
amount of parking in the redevelopment area. Ms. Fountain said that concern for the
proximity of parking spaces is the issue and there are several parking lots that are not
completely used.
Ms. Fountain described Phase 2 of the redevelopment area and said that one of the
goals is to add public parking and recreational opportunities in the beach area. She
said that staff is studying the realignment of Carlsbad Boulevard to determine if
additional parking could be achieved. Ms. Fountain said that staff will be returning to
Council with a work plan and there will be opportunity for public input.
Ms. Fountain also discussed revenue generation and the decision making process for
the Business Improvement District.
DEPARTMENTAL AND CITY MANAGER REPORTS:
78 3. AB #15,942 - LOCAL LAW ENFORCEMENT BLOCK GRANT FUNDING.
Lynn Diamond, Senior Management Analyst, presented the staff report.
ACTION: On a motion by Mayor Pro Tern Hall, Council directed staff to schedule a
public hearing regarding the proposed use of Department of Justice Local
Law Enforcement Block Grant funds to support various police department
functions.

31 4. AB #15,943 - MASSAGE BUSINESS, MASSAGE TECHNICIAN, AND HOLISTIC
HEALTH PRACTITIONER LICENSING REQUIREMENTS.
Ron Ball, City Attorney, presented the staff report.
In response to Council, Police Chief Jim Hawks said the proposed ordinance would
result in upgrading the established standards for licensing requirements.
Cecelia Quinn, 2717 York Road, a Holistic Health Practitioner, expressed concern for
how the proposed ordinance will affect her practice. She asked why a waiting period is
necessary. She also asked if the City has been working with the State to create
general, statewide licensing requirements.
Cindie McMahon, Deputy City Attorney, explained the need for a waiting period. She
also explained that the proposed ordinance is consistent with neighboring cities.
ACTION: On a motion by Mayor Pro Tern Hall, Council introduced and waived
further reading of ORDINANCE NO. NS-560 amending Chapter 5.16 of
the Carlsbad Municipal Code to clarify the requirements for obtaining a
massage business, a massage technician, or a holistic health practitioner
license and to establish a reapplication waiting period.
