CALL TO ORDER: Mayor Lewis called the Regular Meeting to order at 6:00 p.m.
ROLL CALL was taken by the City Clerk, as follows:

APPROVAL OF MINUTES: None.
CONSENT CALENDAR:
Council concurred to remove Item 1 from the Consent Calendar.
ACTION: On a motion by Mayor Pro Tern Hall, Council affirmed the action of
the Consent Calendar, Items #2 through #3, as follows:
AYES: Lewis, Hall, Finnila, and Nygaard.
NOES: None.
ABSENT: Kulchin.
WAIVER OF ORDINANCE TEXT READING:
Council waived the reading of the text of all Ordinances and Resolutions at this
Meeting.

AB #l&954 - REQUEST TO DESTROY RECORDS
Council adopted RESOLUTION NO. 2000-335, authorizing destruction of certain
records kept in the Police Department.
AB #I 5,955 - APPROVAL OF A QUITCLAIM OF EXISTING
RELINQUISHMENT OF ABUTTER’S RIGHTS OF ACCESS - CT 92-03,
AVIARA PHASE Ill UNIT 1 - PR 3.7.118
Council adopted RESOLUTION NO. 2000-336, approving a quitclaim deed for
the relinquishment of abutter’s rights of access to Ambrosia Lane from the JPI
Apartments at Aviara.

1. AB #15,953 - REQUEST FOR CONTINAUANCE OF CITY COUNCIL
COMMITTEE APPOINTMENTS.
Ron Ball, City Attorney, presented the staff report and recommended that this item be
continued until the City Clerk has received the Registrar of Voters General Municipal
Election Canvass. Council concurred.
ADOPTION OF ORDINANCE:
4. AB #15,957 - REPEAL OF SECONDHAND DEALER ORDINANCE
John DeWitt, 2946 State Street, expressed concern that Council’s action would result in
an unfair and unnecessary tax. He said it would be a hardship on businesses.
Shelly DeWitt, 2946 State Street, explained that there is a lot of confusion in the
community regarding this agenda item. She asked questions regarding definitions in
the ordinance.
In response to Council, Ron Ball, City Attorney, explained that the action before Council
is a repeal of a current ordinance. State law has been amended and the City of San
Diego’s Secondhand Dealer Ordinance has been declared as preempted. Therefore,
Mr. Ball said he recommends that Chapter 5.40 of the Carlsbad Municipal Code
pertaining to secondhand dealers be repealed.
Cindy Vene, a shop owner in the Village, asked if State expects the City to be the
enforcement arm for their laws.
Police Chief Jim Hawks noted that the Police Department is in the process of improving
their communication concerning the code. He reported that the business liaison officer
would be providing information to the business owners regarding state law. Chief
Hawks also explained the state fees.
ACTION: On a motion by Mayor Pro Tern Hall, Council adopted ORDINANCE NO.
NS-561 repealing Chapter 5.40 of the Carlsbad Municipal Code pertaining
to Secondhand Dealers.
AYES: Lewis, Hall, Finnila and Nygaard.
NOES: None.
ABSENT: Kulchin.

PUBLIC COMMENT:
Michele Levy, 3021 Highland, expressed concern that there seems to be missing
videos and empty shelves at the Cole Library. She also asked if magazines could be
placed on the empty rack and that a sign indicating library parking only be installed in
the parking lot.
Ernie Soczka, General Manager of the Cabrillo Power Plant, said his firm was notified
by SDG&E of a Stage 2 Alert because the gas supply was not sustainable. In
response, Cabrillo Power Plant began burning oil, and at the current rate, they have
enough oil to sustain their supply for several months. Mr. Soczka explained how
additional oil would be delivered to the plant and the safety precautions that will be
taken.
PUBLIC HEARING:
5. AB #15,958 - Specific Projects For Funding Under The Department Of
Justice Local Law Enforcement Block Grant Fundinn.
Senior Management Analyst Lynn Diamond presented the staff report.
The Mayor opened the duly noticed public hearing at 6:41 p.m. and asked if anyone
wished to address Council on this issue. No one asked to be heard. Therefore, the
Mayor closed the public hearing at 6:42 p.m.
ACTION: On a motion by Mayor Pro Tern Hall, Council adopted RESOLUTION NO.
2000-338 Accepting Specific Projects For Funding Under The Department
of Justice Local Law Enforcement Block Grant Funding.
AYES: Lewis, Hall, Finnila and Nygaard.
NOES: None.
ABSENT: Kulchin.
ADJOURNMENT TO THE CARLSBAD MUNICIPAL WATER DISTRICT MEETING
Council adjourned to the Carlsbad Municipal Water District Special Meeting at 6:43
p.m. with all members present, except Kulchin.
ADJOURNMENT TO THE CONTINUATION OF THE CITY COUNCIL MEETING
The Board of Directors adjourned at 6:44 p.m. to the continuation of the City Council
Meeting with all members present, except Kulchin.

Frank Mannen, Assistant City Manager, presented the staff report.
Council Member Finnila said that all Carlsbad residents should receive a copy of this
useful resource directory.
Council Member Nygaard expressed appreciation to Marilyn Campbell for her efforts on
this project. Council concurred.
ACTION: On a motion by Mayor Pro Tern Hall, Council adopted RESOLUTION NO.
2000-339 authorizing a transfer of funds from the general fund
contingency account to the public information account and accepting a bid
authorizing the execution of a purchase order and appropriation of funds.
AYES: Lewis, Hall, Finnila and Nygaard.
NOES: None.
ABSENT: Kulchin.
