MEETING OF: CITY COUNCIL (Special Meeting)

CALL TO ORDER: Mayor Lewis called the Meeting to order at 4:30 p.m.
ROLL CALL was taken by the City Clerk, as follows:
Present:
Absent:
Lewis, Kulchin, Finnila, Hall, and Nygaard.
None.
CLOSED SESSION:
Council recessed into Closed Session at 4:30 p.m. pursuant to the following:

1. GOVERNMENT CODE SECTION 54956.9(a) - Sierra Pacific v. Taylor Ball,
Case No. N81303
2. GOVERNMENT CODE SECTION 54957.6 - To discuss employer-employee
0750-65 relations, salaries, salary schedules, and compensation in the form of fringe
benefits with designated staff as labor negotiators (Frank Mannen, Assistant City
Manager; Julie Clark, Acting Human Resources Director; Deborah Porter,
Management Analyst; Cindie McMahon, Deputy City Attorney; and, Richard S.
Whitmore, Esq.) with respect to the negotiations with the CPOA, CFA, CCEA,
Police Management Association employee organizations and unrepresented
employees.

3. GOVERNMENT CODE SECTION 54956.9(c) - To discuss initiation of litigation
regarding the destruction of public property
Council reconvened at 6:05 p.m. with Mayor Lewis and all four Council Members
present.
Mayor Lewis announced that Council had heard the information and instructed staff and
the attorney regarding Item Nos. 1 and 2.
Ron Ball, City Attorney, announced the action for Item No. 3 as follows: The City
Council has directed the City Attorney to file the necessary court actions to seek full
recovery for all the City’s losses and damages resulting from the tree cutting incident on
or about December 18, 2000. Council has also directed the City Attorney to seek the
fines and penalties under the appropriate statutes. Mr. Ball said the names of the

individual plaintiffs would be disclosed when the matter becomes public in the court
process.
No other action was announced.

By proper motion, the Special Meeting of January 23, 2001 was adjourned at 6:06 p.m.
