HomeMy WebLinkAbout2001-05-16; City Council; Minutes (2)MINUTES SPECIAL MEETING OF: CITY COUNCIL STUDY SESSION DATE OF MEETING: May 16,200l TIME OF MEETING: 1l:OO a.m. - 1:OO p.m. PLACE OF MEETING: Faraday Administration Center F173A The Mayor called the special meeting to order at 1l:OO a.m. Mayor Lewis, Council Members Nygaard and Finnila were in attendance. Mayor Pro Tern Kulchin and Council Member Hall were absent. Also in attendance was City Manager, Ray Patchett, and City Attorney, Ron Ball, who acted as Clerk Pro Tern. The Mayor requested Item No. 4 be taken out of order and discussed at this time. The Council held a discussion of the principal permittee under the NPDES Master Permit issued by the Regional Water Quality Control Board. Public Works Director Lloyd Hubbs and Environmental Programs Manager Rosanna Lacarra facilitated the discussion and answered the Council’s questions. The Council directed the Public Works Director to indicate its preference for the County of San Diego to serve as a single county wide principal co-permittee as indicated in its letter of May 3, 2001 (copy attached). The Council continued its meeting receiving reports on Council Members’ regional roles and assignments. Council Member Nygaard reported on NCTD activities including proposed bus routes and parking lots in Carlsbad. Council Member Finnila reported on SANDAG activities including its potential study of the intra-regional issue of jobs-housing balance. She further reported on ARJIS activities including possible future expansion of its regional role and capabilities. She continued with a discussion of the activities on the Palomar Airport Advisory Commission and the steering committee, which will complete its report to the San Diego County Board of Supervisors. Mayor Lewis reported on activities of the Metropolitan Water District including proposed programs and funding for desalination proposals. The City Manager reported on the “City of Carlsbad Goal Project Tracking 2001-2002 “ (on file in the office of the City Clerk) including updates on Carlsbad’s Habitat Management Program and the regional multi-species Habitat Conservation Plan. CA 92008-I 949 Dear Mr. Patchett: The purpose of this letter is to notify your municipality of the County’s desire to serve as the Principal Copermittee under NPDES Order No. 2001-01 (Permit) issued by the San Diego Regional Water Quality Control Board (RWQCB). The permit requires the Copermittees to select a Principal Copermittee and notify the RWQCB within 90 days, which is May 23, 2001. During a recent Memorandum of Understanding meeting, staff representing the Copermittees requested that the County provide our proposal in writing to assist you in making a decision. The following describes the County’s position and provides a rationale for the County to act as Principal Copermittee: 1. The Countv is willing to serve as a sinqle Countywide Principal Copermittee. The County is willing and desires to serve as Principal Copermittee under a single countywide permit. We are not at this time considering other scenarios such as multiple . Principals under a single permit or multiple permits (e.g., a north-south or other watershed-based split). We believe that a regional approach is necessary to ensure consistency between programs and to fully utilize economies of scale that would not otherwise be presented. The County has extensive experience in developing and implementing regional programs. We believe that this experience will greatly benefit the Copermittees in meeting the requirements of the new Permit. 2. The County will waive administrative fees. If selected as Principal Copermittee, the County agrees to waive all administrative fees for those activities that are necessary to support shared regional level programs under the permit. These responsibilities are described in Section 0 of the Permit (Principal Permittee Responsibilities). This includes administrative fees for activities necessary to procure and manage consultant services (e.g., for monitoring, outreach, etc.). Please note that this offer is limited to shared regional level activities only. As such, it excludes watershed and jurisdictional level activities except with respect to the regional development of guidelines and standards that will be applied at those levels (e.g., watershed URMP guidance, data management and reporting formats, etc.). , A 3. The County has made a lonq-term commitment to water qualitv throuqh Proiect Clean Water. Over the past four years, the County has demonstrated a strong commitment to the continued development of stormwater management programs throughout the region, and to providing Copermittees the tools they need to make this happen. The County Board of Supervisors most recently underscored this commitment in December 2000 when they directed staff to develop model programs and ordinances in support of the Permit. All 20 Copermittees are currently participating in the development of these programs. Additionally, Project Clean Water goes beyond permit compliance to critically examine the way we approach the management of our water resources and to develop a long-range management strategy. The County believes that it possesses the expertise, experience, and dedication necessary to work with CopemWees to cooperatively develop and implement the programs required under the Permit. For the past four years the County has diligently worked to build strong relationships among the Copennittees. To ensure compliance with the May 23,200l Permit deadline for designation of a Principal Copermittee. we are requesting that all Copermittees be prepared to vote to designate a Principal Copermittee at the Copermittee meeting on May 17, 2001.
