CALL TO ORDER: Mayor Lewis called the Regular Meeting to order at 6:00 p.m.
INVOCATION AND PLEDGE OF ALLEGIANCE:
Mayor Lewis offered the invocation and Council Member Kulchin led the Pledge of
Allegiance.
ANNOUNCED CLOSED SESSION ACTION:
Mayor Lewis announced that the City Council met in closed session and directed the
City Attorney to intervene in the case Canyons Network, Sierra Club and Cenfer for
Biological Diversitv v. Gale Norton, in her official capacity as Secretary of the U.S.
Deparfment of the Interior and the United States Department of the Interior, Case No.
DO18677 (Appellate Court Case Number) now pending before the Federal District Court
in San Diego. The substance of the litigation is to overturn the approvals in 1995 of the
Habitat Conservation Plan under the Endangered Species Act given by the U.S.
Department of Fish and Wildlife Service to the Fieldstone Development Company and
the City of Carlsbad.

PRESENTATION:
Mayor Lewis presented a commendation to Darby Toth, in appreciation of her
assistance in reporting a fire in her neighbor’s home.

1. AB # 16,228 -APPROVAL OF AGREEMENT FOR THE ACQUISITION OF ALL
ASSETS AND OBLIGATIONS OF OGDEN ENVIORNMENTAL AND ENERGY
SERVICES CO., INC. FOR PROFESSIONAL ENVIRONMENTAL SERVICES
Council adopted RESOLUTION NO. 2001-168, approving the assignment of
agreement with Ogden Environmental and Energy Services Co., Inc., to AMEC
Earth and Environmental, Inc. for professional environmental services.
2. AB # 16,229 - AUTHORIZING THE REIMBURSEMENT FOR A TRAFFIC SIGNAL
AT THE CARLSBAD VILLAGE DRIVE AND TAMARACKAVENUE INTERSECTION

Council adopted rRESOLUTION NO. 2001-169, authorizing reimbursement to
Cypress Valley, LLC, and GVP Consultants for the construction of a traffic signal

3. AB # 16,230 -APPROVAL OF DOCUMENTS FOR USEOF FEDERAL GRANT
FUNDS AND REQUEST FOR EXTENSION ON USE OF FUNDS BY JOIN HANDS-
SAVE-A LIFE.
Council adopted RESOLUTION NO. 2001-170, approving agreements for the
City’s Federal Community Development Block Grant Program; and,
Adopted RESOLUTION NO. 2001-171, approving a request for extension to use
Community Development Block Grant Program funds for the development of a
youth center
(Council Member Hall abstained from approval of this item.)
4. AB # 16,231 - STREET LIGHTING AND LADNSCAPING DISTRICT NO. 1
Council adopted RESOLUTION NO 2001-172, authorizing the initiation of
proceedings and ordering the preparation of an Engineer’s Report for a Special
Maintenance District; and
Council adopted RESOLUTION NO. 2001-173, approving the Engineer’s Report;
and
Council adopted RESOLUTION N0.2001-174, setting a public hearing for July
17, 2001.
5. AB # 16,232 -APPROVAL OF SETTLEMENT OF WORKERS’ COMPENSATION
CLAIM OF S. LANCE TURNER.
Council adopted RESOLUTION NO. 2001-175, authorizing the expenditure of
funs for settlement of the Workers’ Compensation Claim of S. Lane Turner.
ADOPTION OF ORDINANCES:
6. AB # 16,233 -AMENDMENT OF TITLE 1, CHATER 1.10, TO ALLOW FOR
ADMINISTRATIVE REMEDIES FOR VIOLATIONS OF THE CARLSBAD
MUNICIPAL CODE.
ACTION: On a motion by Council Member Kulchin, Council adopted
ORDINANCE NO. NS-591, amending Title 1 of the Carlsbad
Municipal Code by adding Chapter 1.10 providing for Administrative
Code Enforcement Remedies.

7. AB #16,234 -AMENDMENT OFORDINANCE PERTAINING TO THE DISPOSAL
OF LOST AND UNCLAIMED PROPERTY.
ACTION: On a motion by Council Member Kulchin, Council adopted
ORDINANCE NO. NS-590, amending Section 3.30.070 of the
Carlsbad Municipal Code to provide for the electronic auction of
lost and unclaimed property.

ACTION: On a motion by Council Member Finnila, Council adopted
ORDINANCE NO. NS-589 amending Title 21, Section
21.203.040 of the Carlsbad Municipal Code to modify
regulations relating to Coastal Resource Protection.
AYES: Lewis, Finnila, Nygaard and Hall,
NOES: None.
ABSTAINED: Kulchin.
PUBLIC COMMENTS:
Clayton Robins, 3945 Foothill Avenue, spoke of the importance of making College
Avenue a through street. He asked Council to reconsider their previous policy.
Mayor Lewis explained that Council has a very strong opinion that the opening of
College Avenue should not occur until Cannon Road has been completed and noted
that the roads in the neighborhoods in this area are not designed for heavy traffic. He
said various options are currently being reviewed to help address safety concerns on
College Avenue.
Council Member Finnila noted that SANDAG holds no responsibility for the opening of
College Avenue and it is strictly the city’s decision.
PUBLIC HEARING:
9. AB 16,235 - REVISED SAN DIEGO COUNTY ANIMAL CONTROL ORDINANCE
BY REFERENCE
Lynn Diamond, Senior Management Analyst, presented the staff report.
Mayor Lewis opened the duly notice public hearing at 6:29 p.m. and asked if anyone
wished to speak on this matter in any way. No one asked to be heard, so he closed the
public hearing at 6:29 p.m.

ACTION: On a motion by Council Member Kulchin, Council adopted
ORDINANCE NO. NS-586, amending Title 7, Chapter 7.08 of the
Carlsbad Municipal Code to adopt by reference the recently revised
San Diego County Code of regulatory ordinances dealing with
rabies, animal control and regulations and to specify the penalties
for violation.

Mayor Lewis adjourned the Regular Council Meeting to the Joint Special City Council,
Municipal Water District and Redevelopment Commission Meeting at 6:30 p.m.
RECONVENE TO THE COUNCIL MEETING:
Mayor/President/Chair Lewis adjourned to the continuation of the City Council Meeting
at 8:12 p.m. and reconvened to the Regular Council Meeting at 8:12 p.m. with all
members present.
