HomeMy WebLinkAbout2001-09-05; City Council; MinutesMINUTES MEETING OF : CITY COUNCIL (Special Meeting) DATE OF MEETING: SEPTEMBER 5,200l TIME OF MEETING: 4:00 p.m. PLACE OF MEETING: City Council Chambers CALL TO ORDER: Mayor Lewis called the Special Meeting to order at 4:00 p.m. ROLL CALL was taken by the Deputy City Clerk, as follows: Present: ’ Lewis, Kulchin, Finnila, Nygaard and Hall. Absent: None. DEPARTMENTAL AND CITY MANAGER REPORTS: DISCUSSION AND ACTION ON THE PROPOSED AB 93. THE SAN DIEGO COUNTY REGIONAL AIRPORT AUTHORITY ACT AND OTHER PROPOSED LEGISLATION AFFECTING, IMPLEMENTING, OR CREATING A REGIONAL GOVERNMENTAL AGENCY FOR THE PERFORMANCE OF GOVERNMENTAL FUNCTIONS IN THE COUNTY OF SAN DIEGO. Joe Garuba, Management Analyst, explained the proposed AB 93 and how it might impact San Diego County and regional agencies. Mr. Garuba made a power point presentation (on file in the City Clerk’s Office). In response to Council, Mr. Garuba described the authorship of AB 93. Council asked questions of Mr. Garuba and discussed potential impacts AB 93 might have on the region. Mr. Garuba recommended that Council take one of the following actions: 1. Take a position of opposition to AB 93 2. Take a position of supporting AB 93 3. Take a position of supporting AB 93 with concerns or conditions. Council Member Finnila presented a brief history of the efforts accomplished jointly by SANDAG and the Port Authority regarding the siting of a new airport. She expressed concern that AB 93 will result in the abortion of the joint efforts. Council concurred regarding their opposition to AB 93 and said this legislation is being passed through too quickly and many questions are being left unanswered. September 5,200 1 Carlsbad City Council Special Meeting Page 2 Council Member Hall suggested that Council’s position on AB 93 be given to the City’s Legislative Consultant. Mayor Lewis recommended that correspondence be faxed to Senator Peace stating that Council appreciates the amendments to AB 93, but still has concerns. Mayor Lewis noted that Senator Peace had sent Council correspondence with bullet points (not on file in the City Clerk’s Office). Therefore, Mayor Lewis suggested outlining bullet points on Council’s position regarding AB 93 in Council’s correspondence to Senator Peace. Ron Ball, City Attorney, noted that he had not seen the amendments to AB 93 nor had he seen the correspondence from Senator Peace outlining certain bullet points. Mr. Ball said that the legislation, that he has seen, does two things. First, it allows the proposed airport authority to override local zoning. Second, AB 93 states that the proposed authority is not a local agency and is not required to follow local zoning laws. Mr. Ball asked if these two issues had been amended. Mayor Lewis replied no. Mayor Lewis explained that last week it was unclear if this new authority had eminent domain powers and he said it is now clear that the new authority does have eminent domain powers. Mr. Ball recommended that Council add a plank to their legislative platform addressing legislative proposals in the future. In response to Council, Mr. Garuba said he would generate correspondence to Senator Peace expressing appreciation for his efforts towards AB 93, but stating that Council still has concerns regarding the following: 1. Representation Issues. 2. Need for a Public Vote. 3. Financial Issues. 4. AB 93 is being rushed through the process. 5. There are still too many unanswered questions. ACTION: On a motion by Council Member Finnila, Council took an official position to oppose AB 93 and directed the City Attorney to add a plank to Council’s Legislative Platform to oppose AB 93. AYES: NOES: Lewis, Kulchin, Finnila, Nygaard, and Hall. None. COUNCIL REPORTS AND COMMENTS: None CITY MANAGER COMMENTS: None. CITY ATTORNEY COMMENTS: None.
