CALL TO ORDER: Mayor Lewis called the Meeting to order at 6:00 p.m.
ROLL CALL was taken by the City Clerk, as follows:

CONSENT CALENDAR:
Council Member Finnila said she would vote no on Item #I A6 #16,383 - DENIAL OF
APPEAL - AT&T WIRELESS - CUP 00-36. Council Member Nygaard said she has
reviewed the record and is prepared to also vote no on Item #I.
Mayor Lewis noted that this would create a split vote and said Consent Calendar Item
#I would be continued to a Council meeting when all Council Members are present.
ACTION: On a motion by Council Member Finnila, Council affirmed the
action of the Consent Calendar, Items #2 and 3, as follows:
AYES: Lewis, Finnila, Nygaard and Hall.
NOES: None.
ABSENT: Kulchin.
WAIVER OF ORDINANCE TEXT READING:
Council waived the reading of the text of all Ordinances and Resolutions at this
Meeting.
1. AB #16,383 - DENIAL OF APPEAL -AT&T WIRELESS - CUP 00-36.
This item was continued to a Council Meeting when all Council Members are
present.
2. AB #16,384 -APPROVAL OF PURCHASE OF DEFIBRILLATOR/MONITORS.
Council adopted RESOLUTION NO. 2001-310, approving the purchase of
defibrillator/monitors and upgrades from Medtronics Physio-Control Corporation.
3. AB #16,390 -ACCEPTANCE OF THE CARLSBAD BIKEWAY MASTER PLAN.
Council adopted RESOLUTION NO. 2001-313, accepting the Carlsbad Bikeway
Master Plan.

INTRODUCTION OF ORDINANCES:
4. AB #16,385 -AMENDMENT OF ORDINANCE ADJUSTING THE COMPENSATION
OF THE CITY CLERK.
Council Member Nygaard requested staff to return with a resolution authorizing a car
allowance of $200 per month for the City Clerk. Council concurred.
ACTION: On a motion by Council Member Finnila, Council introduced ORDINANCE
NO. NS-600, amending Section 2.08.030 of the Carlsbad Municipal Code
to Adjust the Compensation of the City Clerk.
AYES: Lewis, Finnila, Nygaard, and Hall.
NOES: None.
ABSENT: Kulchin.
5. AB #16,386 -AMENDMENT OF ORDINANCE ADJUSTING THE COMPENSATION
OF THE CITY TREASURER.
ACTION: On a motion by Council Member Finnila, Council introduced ORDINANCE
NO. NS-601, amending Section 2.08.020 of the Carlsbad Municipal Code
to Adjust the Compensation of the City Treasurer; and,
Council adopted RESOLUTION NO. 2001-311, increasing the City
Treasurer’s Monthly Automobile Allowance.
AYES: Lewis, Finnila, Nygaard, and Hall.
NOES: None.
ABSENT: Kulchin.
PUBLIC HEARING:
Council concurred with staffs request to consider Item Nos. 6 and 7 together.
6. AB #16,387 - GPA Ol-OllZCA 01-03 LIVABLE STREETS.
DEPARTMENTAL AND CITY MANAGER REPORTS:
7. AB #16,388 - LIVABLE STREETS IMPLEMENTATION ACTIONS.
Mike Smith, Acting Fire Chief; Bob Johnson, Deputy City Engineer; and Bob Wojcik,
Deputy City Engineer, presented the staff report. They said that the off-set driveway
element has been removed from the Livable Streets Program because of grading and
drainage concerns expressed by staff.
In response to Council, Mr. Johnson explained that the Livable Streets Program will
apply to future residential streets, which are not arterial or collector streets.

Acting Fire Chief Smith explained the policy to limit the number of dwelling units on a
cul-de-sac to 20 dwelling units. Acting Fire Chief Smith said staff is recommending
each dwelling unit on a cul-de-sac to be equipped with fire sprinklers. Acting Fire Chief
Smith also explained the recommended policy that if the land is situated in such a way
that the developer has no choice but to create a cul-de-sac, then 50 units will be
allowed, with the fire sprinkler requirement for each unit. Acting Fire Chief Smith said
that staff is also recommending traffic calming on all future residential streets.
Ron Ball, City Attorney, noted that a resolution amending the General Plan is required
with this item. If Council approves the introduction of the two ordinances this evening,
staff will present the resolution at the October 16’h Council Meeting.
Council discussion ensued regarding discouraging 50 dwelling units in a cul-de-sac.
In response to Council, Mr. Johnson said the size of homes on lots is a separate issue
and will be coming to Council in the near future. Mr. Wojcik explained staffs proposal
for Pasadena Driveways.
Mr. Johnson explained that the Livable Streets Program is contained within the right-of-
way. Garage setbacks and other issues are part of the Livable Neighborhood Program.
In response to Council Member Hall, Acting Fire Chief Smith said that fire sprinklers in
homes need to be tested every 30 years. He explained the piping, and said there is a
valve to prevent the water from backing up and causing damage.
In response to Council, Mr. Wojcik explained that if a street has a five percent grade,
depending on the location of the driveway, there could be difficulties with drainage
issues. Therefore, staff felt it important to remove the offset driveway issue from policy
to provide flexibility. Offset driveways would probably not result in drainage issues on
streets with two or three percent grade.
Mayor Lewis asked if trees along the right-of-way are specified in the Livable Streets
Program. Mr. Johnson said that the city’s landscape manual will describe what type of
tree is appropriate for a particular street or area.
Ron Ball, City Attorney, referred to Page 33, of the staff report for Livable Streets
(Council Agenda Item No. 6), Item C.22. He asked for Council’s direction regarding this
language.
Council Member Nygaard replied that she would like to see justification for 50 dwelling
units in a cul-de-sac. Council Member Finnila expressed concern for the length of the
cul-de-sac. She said a maximum number of units in a cul-de-sac should not be
identified in order to provide flexibility. Council Member Finnila spoke of the importance
of maximizing street connectivity.
Mr. Johnson said that the cul-de-sac standards fall within the engineering standards.
He noted that a resolution could be presented to Council next week amending the
general plan and include language to strengthen the cul-de-sac policy to reflect
Council’s direction.

Mayor Lewis opened the duly notice public hearing at 7:Ol p.m. and asked if anyone
wished to speak on this matter in any way.
Alan Thum, 1392 Peachwood Drive, Encinitas, reviewed his submitted correspondence
(on file in the Office of the City Clerk), stating his concerns that the Negative
Declaration should be rejected and proposed amendments should be revised.
Council Member Finnila said many of Mr. Thum’s concerns are being addressed
through the federal storm drain requirements.
Seeing no one else wishing to speak, the Mayor closed the public hearing at 7:ll p.m.
ACTION: On a motion by Council Member Finnila, Council introduced ORDINANCE
NO. NS-602, amending Title 21, Sections 21.04.210, 21.04.355,
21.09.160, and 21.37.100 to modify regulations related to street widths;
and,
Council introduced ORDINANCE NO. NS-603, amending Title 11, Section
11.04.010 and Title 20, Section 20.16.040(3) to modify regulations related
to residential streets; and
Council continued RESOLUTION NO. 2001-312 to the Council Meeting of
October 16, 2001; and,
Council directed staff to return to the Council Meeting of October 16, 2001
with a resolution approving amendments to the land use and circulation
elements of the General Plan to incorporate the concept of livable designs
of residential streets; and Council directed staff to include language in the
resolution that long single-access streets, generally exceeding 20
residential dwelling units is discouraged and should be used only when
physical conditions make it not feasible to provide street connectivity.

8. AB #16,176 - THREE-HOUR PARKING TIME LIMIT ON STATE STREET.
Bob Johnson, Deputy City Engineer, presented the staff report.
In response to Council, Debbie Fountain, Director of Housing and Redevelopment,
explained that the three-hour parking on State Street will hopefully entice people to park
in the parking lots and walk to their destination in the downtown area. Ms. Fountain
explained that when staff began the parking program, staff had a campaign, the North
County Transit District placed flyers on the train, business owners were encouraged to
have their employees use the parking lots.
Alice Brown, representing Arthur Brown Plumbing, 2697 State Street, said they have
their own off-street parking for their customers. Mrs. Brown said all day long non-

customers park along the street in front of their business. Mrs. Brown said her
customers have a difficult time getting out of the driveway because the parked cars
create an obstacle. She noted that a nearby liquor store has large trucks that double
park on the street and create a safety hazard. Mrs. Brown suggested that the North
County Transit District have shuttles drive to the various parking lots in the downtown
area and deliver people to the train station. Mrs. Brown spoke in support of the three-
hour parking on State Street.
Mayor Lewis asked if the curb in front of the Brown’s business could be painted red.
Mr. Johnson said he would investigate the matter.
Council Member Finnila noted that Council had authorized a shuttle run this summer
and she asked to see the report,
Mr. Johnson said the shuttle was in operation for three months and Finance is putting
together a report for Council.
Ms. Fountain noted that most business owners along State Street support of the three-
hour parking.
In response to Council Member Hall, Ms. Fountain described the parking availability to
businesses north of State Street. She noted that some businesses north of State
Street have on site parking, but the parking is not adequate to fulfil1 their needs.
ACTION: On a motion by Council Member Finnila, Council introduced ORDINANCE
NO. NS-584, amending Title 10, Chapter 10.40, of the Carlsbad Municipal
Code by the revision of Section 10.40.158 to establish a three-hour
parking time limit on State Street from Beech Avenue to Carlsbad
Boulevard.

9. AB #16,389 - MUNICIPAL STORM WATER PERMIT AND PROGRAM
IMPLEMENTATION PROGRESS REPORT.
Rosanna LaCarra, Environmental Programs Manager, presented the staff report.
Ron Ball, City Attorney, said included in the order adopted by the Regional Water
Quality Control Board is a requirement to amend the City’s General Plan. Mr. Ball said
a General Plan amendment would be presented to Council in the future.
COUNCIL REPORTS AND COMMENTS:
Mayor Lewis noted that a number of citizens in the community would be randomly
telephoned to collect data on how the City can provide better service. Mayor Lewis
encouraged citizens to provide their comments.

Council Member Finnila said that SANDAG would meet twice a month. The first policy
meeting will be October 12fh to discuss preserving quality of life.
Mayor Lewis said he attended a meeting this morning regarding the region’s water
issues.
