CALL TO ORDER: Mayor Lewis called the Meeting to order at 6:OO p.m.
ROLL CALL was taken by the City Clerk, as follows:

APPROVAL OF MINUTES:
On a motion by Council Member Kulchin, Minutes of the following meeting were
unanimously approved as presented:

CONSENT CALENDAR:
Council concurred with staffs request to continue Item 5 (Reimbursement Agreement
with LB/L Concordia Carlsbad 19, LLC for the Construction of a Traffic Signal at
Carlsbad Village Drive and Appian Road/Avenida De Anita and Approval of
Appropriation of Funds) to a future Council meeting.
ACTION: On a motion by Mayor Pro Tem Kulchin, Council affirmed the
action of the Consent Calendar, Items #I through #7, with the
exception of Item #5, as follows:

WAIVER OF ORDINANCE TEXT READING:
Council waived the reading of the text of all Ordinances and Resolutions at this
Meeting.
1. AB #16,680 - NAMING OF ZONE 19 COMMUNITY PARK.
Council adopted RESOLUTION NO. 2002-079, reviewing the public input
received and the recommendation of the Carlsbad Parks and Recreation
Commission and selecting the name of AVIARA COMMUNITY PARK as the
official name for Zone 19 Community Park.

STRUCTURAL FIRE FIGHTING AGREEMENT.
Council adopted RESOLUTION NO. 2002-080, approving Amendment No. 5 to
extend and amend the agreement for furnishing protective clothing for structural
fire fighting with L N Curtis and Sons.
AB #16,681 - AMENDMENT NO. 5 TO PROTECTIVE CLOTHING FOR
AB #16.682 - REPORTING THE VALUE OF CALPERS EMPLOYER PAID
MEMBER CONTRIBUTIONS FOR ALL LOCAL FIRE EMPLOYEES.
Council adopted RESOLUTION NO. .2002-081, establishing the effective date for
reporting the value of California Public Employees’ Retirement System
(CalPERS) Employer Paid Member Contributions (EPMC) for all local fire
employees.
AB #16,686 - AUTHORIZATION TO ADVERTISE FOR BIDS FOR CAMINO
VlDA ROBLE AND EL CAMINO REAL IMPROVEMENTS - PROJECT 3812.
Council adopted RESOLUTION NO. 2002-083, approving plans and
specifications and authorizing the City Clerk to advertise for bids for Camino Vida
Roble and El Camino Real Improvements, Project No. 3812.
AB #16,683 - REIMBURSEMENT AGREEMENT WITH LB/L CONCORDIA
CARLSBAD 19, LLC FOR THE CONSTRUCTION OF A TRAFFIC SIGNAL AT
CARLSBAD VILLAGE DRIVE AND APPIAN ROAD/AVENIDA DE ANITA AND
APPROVAL OF APPROPRIATION OF FUNDS.
This item was continued to a future Council Meeting.
AB #16,684 - REPORT OF SETTLEMENT OF FEDERAL AND STATE
ENVl RONMENTAL LITIGATION.
Council accepted a report of the settlement of the federal lawsuit entitled,
Canyons Network, et al. v. Norton, et al. (Case No. Olcv0963-BTM), and the
related state lawsuit entitled, Sierra Club, et al. v. City of Carlsbad, et al. (Case
No. GIN 017085).
AB # 16,687 - FIRST AMENDMENT TO THE LAND USE, OPEN SPACE,
CONSERVATION AND OPEN SPACE ELEMENTS OF THE GENERAL PLAN
IN 2002 FOR PROPERTIES COMMONLY KNOWN AS CALAVERA HILLS
PHASE II (GPA 99-03), NPDES STORMWATER UPDATE (GPA 01-15) AND
SHOPPING CENTER REDESIGNATIONS (GPA 01 -06).
Council adopted RESOLUTION NO. 2002-084, approving amendments to the
Land Use, Open Space, Conservation and Open Space Elements of the General
Plan in 2002, for properties commonly known as Calavera Hills Phase II, NPDES
Stormwater Update and Shopping Center Redesignations.
PUBLIC COMMENT:
Elaine Bracken, 802 Kalpati, said she would like to see the Carlsbad Police Officers
receive high tech training.

Jacquee Renna, 2003 Alga Road, asked that the Alga Road speed limit, near her
home, be reduced to 45 miles per hour. She expressed concern that the current 50
mile per hour speed limit has resulted in accidents.
Staff explained road classifications and speed enforcement issues on Alga Road.
Ron Ball, City Attorney, recommended that if Council wished to discuss the matter
further, that staff return to Council with an agenda item on a future agenda. Council
Member Kulchin asked staff place the issue on a future agenda.
ADJOURNMENT TO THE CARLSBAD MUNICIPAL WATER DISTRICT MEETING
Mayor Lewis adjourned to the Special Meeting of the Carlsbad Municipal Water District
at 6:18 p.m. All members were present, except Board Member Nygaard.
RECONVENE CITY COUNCIL MEETING AND RECESS
President Lewis adjourned to the remainder of the Carlsbad City Council Meeting at
6:26 p.m. with all members present except Council Member Nygaard. Mayor Lewis
declared a recess at 6:26 p.m.
RECONVENE
Mayor Lewis called the Council Meeting back to order at 6:30 p.m. with all member
present except Council Member Nygaard.
PRESENTATION:
Mayor Lewis presented the Carlsbad High School Lancers Dancers, and Coach Carrie
Smith, with a proclamation in honor of their winning the 2002 National Dance Team
Title.
COUNCIL REPORTS AND COMMENTS:
8. AB # 16.685 PRESENTATION ON THE RESULTS OF THE CITYWIDE PUBLIC
OPINION SURVEY BY CAL STATE SAN MARCOS SOCIAL BEHAVIORAL
RESEARCH INSTITUTE.
Joe Garuba, Management Analyst, introduced Allen Risley, representing Cal State San
Marcos Social Behavioral Research Institute. Mr. Risley made a Power Point
Presentation (not on file in the City Clerks’ Office) to present the results of the Fiscal
Year 2001 Citywide Public Opinion Survey dated January 2002 (on file in the City
Clerk’s Office). Mr. Risley also compared results from the 2000 and 2001 survey.
Mr. Garuba noted that the 2001 survey is available on the City’s website for public
review.
Council concurred to receive and file the survey.

COUNCIL MEMBERS COMMENTS:
Council Member Kulchin announced that the William D. Cannon Art Gallery's newest
exhibition, "Petitions of Devotion: Russian Icons from the Timken Museum," runs
through April 28th.
Mayor Lewis reported on the most recent activities of the Metropolitan Water District.
CITY MANAGER COMMENTS:
Ray Patchett, City Manager, announced that the regularly scheduled Council Meeting of
March 19, 2002 will not be held.
CITY ATTORNEY COMMENTS: None.
ADJOURNMENT:
By proper motion, the Regular Meeting of March 12, 2002, was adjourned at 7:19 p.m.
