MEETING OF : CITY COUNCIL (Regular Meeting)

CALL TO ORDER: Mayor Lewis called the Meeting to order at 6:03 p.m.
ROLL CALL was taken by the City Clerk, as follows:
Present: Lewis, Kulchin, Finnila, Nygaard, and Hall.
Absent: None.
PROCLAMATIONS:
Council Member Kulchin presented a proclamation to Laura Kimsey, Women’s Resource
Center, declaring April 2002 “Sexual Assault Awareness Month”.
Mayor Lewis presented a proclamation to Kevin Radcliffe, Carlsbad Optimist Club,
declaring May 5-1 1, 2002 “Respect for Law Week”.
PRESENTATION:
Linda Troyan, City Clerk, City of Imperial Beach, presented Lorraine Wood, City Clerk, with
a plaque and pin in recognition of Ms. Wood achieving her Certified Municipal Clerk status.
CONSENT CALENDAR:
Item No. 3 was pulled for discussion,
ACTION: On a motion by Mayor Pro Tern Kulchin, Council affirmed the action of
the Consent Calendar, Items #I through #5, with the exception of Item
#3, as follows:

NOES: None.
WAIVER OF ORDINANCE TEXT READING:
Council waived the reading of the text of all Ordinances and Resolutions at this Meeting.

1. AB #16.726 - FINAL MAP - NORTH POINTE WEST, CT 01-08.
Council adopted RESOLUTION NO. 2002-122, approving the final map for Carlsbad
Tract 01-08, North Pointe West, and authorizing the City Clerk to process the map
for recording.
2. AB #16.727- AWARD OF AGREEMENT FOR ELECTRICAL MAINTENANCE
SERVICES WITH SADLER ELECTRIC INC.
Council adopted RESOLUTION NO. 2002-123, accepting the bid proposal of Sadler
Electric Inc., and authorizing the execution of an agreement for electrical
maintenance services.
3. AB #16.728 - RATIFICATION OF AMENDMENT NO. 2 TO AGREEMENT FOR
COMMUNITY RELATIONS SERVICES AND THE IMPLEMENTATION OF A
PUBLIC AFFAIRS PROGRAM TO SUPPORT THE DESIGN AND CONSTRUCTION
OF THE VISTNCARLSBAD INTERCEPTOR SEWER AND THE SOUTH
CARLSBAD VILLAGE STORM DRAIN PROJECTS WITH KATZ & ASSOCIATES, INC. ___ This item was pulled for discussion.
4. AB #16,732 - AUTHORIZATION TO ADVERTISE FOR BIDS FOR GUARD RAIL
INSTALLATION AT MISCELLANEOUS LOCATIONS - PROJECT NO. 9022-1.
Council adopted RESOLUTION NO. 2002-126, approving plans and specifications
and authorizing the City Clerk to advertise for bids for the Guard Rail Installation at
miscellaneous locations, Project No. 9022-1.
5. AB #16.729 - REQUEST FOR OUT-OF-STATE TRAVEL FOR A COUNCIL
MEMBER TO ATTEND SISTER CITY EVENT IN CZECH REPUBLIC.
Council adopted RESOLUTION NO. 2002-125, approving out-of-state travel for
Council Member Nygaard to attend sister city event in Karlvoy Vary, Czech Republic,
May 3-5, 2002.
DISCUSSION OF CONSENT CALENDAR ITEM:
6. AB #16.728 - RATIFICATION OF AMENDMENT NO. 2 TO AGREEMENT FOR
COMMUNITY RELATIONS SERVICES AND THE IMPLEMENTATION OF A
PUBLIC AFFAIRS PROGRAM TO SUPPORT THE DESIGN AND CONSTRUCTION
OF THE VISTNCARLSBAD INTERCEPTOR SEWER AND THE SOUTH
CARLSBAD VILLAGE STORM DRAIN PROJECTS WITH KATZ & ASSOCIATES, - INC.
In response to Council, Skip Hammann, Deputy City Engineer, reviewed the staff report and
explained that additional funds are needed for communication regarding the project
construction.
Council Member Nygaard said it is important to communicate with the community regarding
construction projects and noted that staff has been successful in that endeavor.

In response to Council Member Hall, Mr. Hammann described the current status of the
VisWCarlsbad Interceptor Sewer and South Carlsbad Village Storm Drain projects. He
estimated that the projects would be completed in approximately February, 2003.
Mark Sullivan, Construction Manager, reported that the storm drain on Oak Street up to
Madison Street has been completed. He noted that there is a section on Oak Street, from
the freeway to Harding, which still remains to be completed.
ACTION: On a motion by Council Member Kulchin, Council adopted RESOLUTION NO.
2002-124, approving Ratification of Amendment No. 2 for community relations
services and the implementation of a public affairs program to support the
design and construction of the VistalCarlsbad Interceptor Sewer and the
South Carlsbad Village Storm Drain Projects with Katz & Associates, Inc., a Nevada Corporation.
- AYES: Lewis, Kulchin, Finnila, Nygaard, and Hall. - NOES None.
PUBLIC COMMENT: None.
DEPARTMENTAL AND CITY MANAGER REPORTS:
7. AB #I6730 - REVIEW OF ALGA ROAD SPEED ZONE.
Bob Johnson, Deputy City Engineer, presented the staff report. He also made a Power
Point Presentation (on file in the City Clerks Office). Mr. Johnson explained how speed
limits are set in Carlsbad and how the law and the Vehicle Code impact decisions made in
setting speed limits.
Mr. Johnson said that Alga Road is an arterial street and explained the definition of an
arterial street. In response to Council, Mr. Johnson said that the portion of Alga Road
between El Camino Real and Alicante Road is a residential area. He defined a residential
district and explained the difference between a residential area and residential district.
Council Member Hall said he formerly lived on the corner of Estrella De Mar, just described
by Mr. Johnson. Council Member Hall acknowledged that cars have a tendency to increase
speed as they travel down the hill. Mr. Johnson explained that the state legislatures’
intention in the Vehicle Code was to not allow pocket speed zones for those types of
situations. Mr. Johnson said that the state legislature wants cities to consider all conditions
when establishing speed limits.
In response to Council Member Hall, Mr. Johnson said that a traffic study would be done in
association with the future traffic signal at Estrella De Mar and Alga Road. If no significant changes were found at that time, then the speed limit of 50 miles per hour on Alga Road in
that immediate area would stand.

Council Member Kulchin asked if the speed limit were reduced to 45 miles per hour on Alga
Road between El Camino Real and Alicante Road, would police officers be able to use
radar to ticket speeding vehicles. Mr. Johnson explained that according to the legal
requirements for setting speed limits, the ticket would be invalid and thrown out of court.
However, if the speed limit were 50 miles per hour on Alga Road between El Camino Real
and Alicante Road, radar could be used to validate a speeding ticket and it would be upheld
in a court of law.
Jacqueline Renna, 2003 Alga Road, requested that the secondary arterial status of Aviara
Parkway, posted at 40 miles per hour, continue on Alga to Alicante Road. She stated that
14 homes enter and exit on this section of Alga Road.
Council Member Hall said that the issue before Council this evening is enforcement of a
speed limit on Alga Road between El Camino Real and Alicante Road. He said he would
vote to reaffirm Council's previous approval of the 50 mile per hour speed zone on Alga
Road.
Council Member Nygaard concurred with Council Member Hall.
Council Member Finnila also concurred with Council Member Hall and Council Member
Nygaard. She noted that the city inherited the road from the County.
Council Member Kulchin said that there are many laws that Council must follow when
establishing speed limits.
Mayor concurred and said that he could support staffs recommendation to retain the 50
mile per hour speed zone on Alga Road.
ACTION: On a motion by Council Member Kulchin, Council reaffirmed their previous
approval of the 50-mile per hour speed zone on Alga Road.

8. AB #16,731 -COMMUNICATION PIAN FOR THE CITY OF CARLSBAD.
Dana Hartshorn, Management Analyst, presented the staff report. She also made a Power
Point Presentation (on file in the City Clerk's Office
In response to Council Member Nygaard, Ms. Hartshorn said that one of the goals is to
establish a Volunteer Coordinator position.
In response to Council Member Finnila, Ms. Hartshorn said that the Communication Team
will be working with the Building Department and County to welcome new residents to
Carlsbad.

Council Member Kulchin said she supported encouraging Citizens’ Academy Graduates to
volunteer for City service. She spoke in support of Carlsbad Really Means Service.
Council Member Hall said that Council and the Citizens’ Academy should be involved in the
Speakers’ Bureau. Council Member Hall said that The Communication Plan is not an
appropriate vehicle for Objective #I4 (To enhance and strengthen participation of employees
in the development and implementation of City initiatives and activities, creating a sense of
citywide Community and reinforcing the organization’s culture). Council Member Hall said
portions of Objective #4 should be returned to the City Manager‘s purview.
Mayor Lewis said that all future appointments to the Boards and Commissioners should be
graduates of the Citizens’ Academy. He asked that Council consider adopting such a
policy.
Council concurred to receive and file the report. No action was required or taken.
COUNCIL REPORTS AND COMMENTS:
Council Member Hall said he recently spoke at the Republican Womens’ Club and
expressed appreciation to Jim Elliott, Director of Administrative Services, for his technical
expertise.
Council Member Kulchin said she, the City Manager and several staff members were
recently invited by the International City Managers’ Association (ICMA) to give a
presentation on performance management.
Mayor Lewis announced that City Council Members have been invited and may be
participating in the upcoming events:
