HomeMy WebLinkAbout2003-04-22; City Council; MinutesMINUTES MEETING OF : DATE OF MEETING: APRIL 22,2003 TIME OF MEETING: 6:OO p.m. PLACE OF MEETING: CITY COUNCIL (Regular Meeting) City Council Chambers CALL TO ORDER: Mayor Lewis called the Meeting to order at 6:OO p.m. ROLL CALL was taken by the City Clerk, as follows: Present: Absent: None. Lewis, Finnila, Kulchin, Hall and Packard. PRESENTATIONS: Jim Ball, Public Works Supervisor, and Chair of the Strategic Change Team introduced the Strategic Change Team Members and described their “Dunk’ n Run” event. Mr. Ball presented Council with a check in the amount of $550.00, which was raised by the “Dunk’ n Run” event, as a donation to the Recreation Opportunity Grants Fund. Ken Price, Recreation Director, explained the purpose of the Opportunity Grants Fund. Ernie Soczka, General Manager of Cabrillo Power, announced that Cabrillo Power had received an Award of Excellence in Coastal and Ocean Management from the National Oceanic and Atmospheric Administration. He said that Cabrillo Power was recognized for their eradication efforts of the Caulerpa Taxifolia from Agua Hedionda Lagoon. CONSENT CALENDAR: Ray Patchett, City Manager, referred to Item No. 2 regarding the pavement overlay of Palomar Airport Road. He said that this project has taken other projects into consideration that might impact the overlay project and there would be no conflicts. ACTION: On a motion by Mayor Pro Tem Finnila, Council affirmed the action of the Consent Calendar, Items #I through #5, as follows: AYES: NOES: None. Lewis, Finnila, Kulchin, Hall and Packard. AB #17,141- REPORT ON SETTLEMENT OF HATCHER V. CITY OF CARLSBAD. Council accepted the report regarding the terms and conditions of the settlement as required by the Brown Act in Hafcher. et a/ v. Cifv of Carlsbad, et al, Case No. GIC 782067. 2. AB #17,142 -AUTHORIZATION TO ADVERTISE FOR BIDS FOR THE PAVEMENT OVERLAY OF PALOMAR AIRPORT ROAD, EL CAMINO REAL, AND PASEO DEL NORTE, PROJECT NO. 3667-5. Council adopted RESOLUTION NO. 2003-1 05, approving plans and specifications and authorizing the City Clerk to advertise for bids for the construction of the pavement overlay of Palomar Airport Road, El Camino Real, and Paseo Del Norte, Project No. 3667-5. 3. AB #17,143 -APPROVAL OF THE REALLOCATION OF EXISTING APPROPRIATIONS AND APPROPRIATION OF ADDITIONAL FUNDS AMONG THREE PROJECTS AT POINSETTIA PARK AND STAGECOACH PARK. Council adopted RESOLUTION NO. 2003-1 06, approving the reallocation and appropriation of additional funds, among three park projects; Poinsettia Park synthetic turf, Poinsettia Park access stairs, and Stagecoach Park access stairs; Project Nos. 3838, 3836, 3864. 4. AB #17,144 - FINAL MAP FOR CARLSBAD TRACT 00-06, BRESSI RANCH MASTER PLAN SUBDIVISION. Council adopted RESOLUTION NO. 2003-107, approving the final map for CT 00-06, Bressi Ranch Master Plan Subdivision, and authorizing the map to be recorded. 5. AB #17,145 -AUTHORIZATION TO ADVERTISE FOR BIDS FOR REHABILITATION OF NORTH AGUA HEDIONDA INTERCEPTOR SEWER- EASTERN SEGMENT, PROJECT NO. 3874-1. Council adopted RESOLUTION NO. 2003-1 08, approving plans and specifications and authorizing the City Clerk to advertise for bids for rehabilitation of the North Agua Hedionda Interceptor Sewer-Eastern Segment, Project No. # 3874-1. ORDINANCE FOR ADOPTION: 6. AB #17,146 -AMENDMENT OF THE CARLSBAD MUNICIPAL CODE SECTION 1.20.350 TO BE CONSISTENT WITH STATE LAW. ACTION: On a motion by Mayor Pro Tem Finnila, Council adopted ORDINANCE NO. NS-659 amending Section 1.20.350 of the Carlsbad Municipal Code to be consistent with State Law regarding disqualification due to a conflict of interest. AYES: NOES: None. ADJOURNMENT TO THE CARLSBAD HOUSING AND REDEVELOPMENT COMMISSION MEETING Mayor Lewis adjourned to the Joint Meeting of the Carlsbad Housing and Redevelopment Commission Meeting at 6:12 p.m. with all members present. RECONVENE THE COUNCIL MEETING. Chair Lewis adjourned to the remained of the Carlsbad City Council Meeting at 6:42 p.m. all Council Members present. DEPARTMENTAL AND CITY MANAGER REPORTS: 7. AB #17,147 - REQUEST BY LANlKAl LANE MOBILE HOME PARK TO GIVE PRESENTATION Leslie Tanner, Lanikai Lane Board Member, 6550 Ponto Drive, and Chair of Stop the Gate Committee, spoke against the installation of a gate at Lanikai Lane, which would close access to Ponto Drive from Surfside Lane. Teresa Horak, 6550 Ponto Drive, #I 08, explained the dangerous conditions that currently exist at Ponto Drive South. She described a situation where an ambulance driver could not find his way back onto Carlsbad Boulevard without assistance. Lou Gazo, 6550 Ponto Drive, #152, a resident of Lanikai Lane Mobile Home Park, said it is dangerous to drive in and out of Lanikai Lane Mobile Home Park. He expressed concern for the safety of pedestrians and felt that the bus stop is too close to the entrance of Lanikai Lane Mobile Home Park. Mr. Gazo said that when a traffic signal is installed, enough room is needed for vehicles to make a U-turn. He noted that many trucks with trailers make a U-turn in front of Poinsettia Cove in order to access the State Beach Campground. Mr. Gazo said these U-turns cause traffic congestion for Lanikai Lane Mobile Home Park residents traveling south on Ponto Drive and turning onto Breakwater Road. Austin Lynas, 6550 Ponto Drive, #140, a resident of Lanikai Lane Mobile Home Park, explained why he felt the traffic study dated November 2002 is inaccurate. He said that a comprehensive traffic study should be done during the summer months when trucks with camping trailers use the entrance to Lanikai Lane Mobile Home Park (Breakwater Road and Ponto Drive which is in also the entrance to Poinsettia Cove) as a U-turn area to access the State Beach Campground. He distributed photographs of a truck and trailer making a U-turn in front of Poinsettia Cove (on file in the City Clerk’s Office). Steve Fasching, 6550 Ponto Drive, #2, described the dangerous ingress and egress to the Lanikai Lane Mobile Home Park. April 22,2003 Carlsbad City Council Meeting Page 4 Jack Horak, 6550 Ponto Drive, #108, made a video presentation (not on file in the City Clerk’s Office) demonstrating the dangerous traffic situation and potential conflicts among vehicles, pedestrians and bicyclists at the intersection of Ponto Drive, Breakwater Road at Carlsbad Boulevard. He submitted a copy of the “Analysis of Vehicular access to Lanikai Lane Mobile Home Park Via Ponto Drive” dated September 2001 ; a copy of correspondence dated July 31 , 2000 to Tommy White from Jim Murray, Associate Engineer; and, two photographs of Carlsbad Boulevard. Mr. Horack also submitted for the record three black and white photographs of vehicles traveling from Lanikai Lane Mobile Home Park onto Ponto Drive and turning right onto Breakwater Road (all on file in the City Clerk’s Office). Mike Hollins, 6550 Ponto Drive, #80, President of the Lanikai Lane Mobile Home Park Home Owners’ Association, submitted a petition signed by resident of Lanikai Lane Mobile Home Park requesting that the City not install the “Knox box” at Ponto Drive ai Surfside Lane. Mr. Hollins said that the residents question the accuracy of the traffic study and feel that a gate is not necessary. Mr. Hollins suggested that a new traffic signal be installed at Lanikai Lane and Carlsbad Boulevard with enough room for a u- turn. He also said that Ponto Road should be closed and the asphalt replaced with landscape. Mr. Hollins said that the residents of Lanikai Lane Mobile Home Park nee to have a safe entrance and exit into their Mobile Home Park. Leslie Tanner, Lanikai Lane Board Member, 6550 Ponto Drive, and Chair of Stop the Gate Committee, explained that if a gate is installed, residents of Lanikai Lane Mobile Home Park going South on Carlsbad Boulevard, would need to make a U-turn at Breakwater Road and then immediately get into the right hand deceleration lane in order to enter Lanikai Lane Mobile Home Park. David Seeley, a resident of La Costa Downs, said he lives on Surfside Lane, which is currently one of the entrances to Lanikai Lane. He introduced Brian and Teresa Ross. Brian Ross, 6506 Surfside Lane, a resident of La Costa Downs, said that the transition from the Surfside Lane CUI de sac to Ponto Road is not designed to be a permanent access. He said that Surfside Lane is a very narrow street and the CUI de sac was designed to be a closed CUI de sac. Mr. Ross asked that the Surfside Lane become a closed CUI de sac soon. Teresa Ross, 6506 Surfside Lane, expressed concern for the safety of children who play in the open CUI de sac. She asked that Surfside Lane become a closed CUI de sac. Mr. Seeley explained that the residents of La Costa Downs and Lanikai Lane Mobile Home Park have been meeting together over the past several months. He said the two issues are that the entrance to Lanikai Lane Mobile Home Park should have a traffic signal and allow ingress and egress going north and south safely. He said this would provide an opportunity for a safe U-turn for trucks and trailers to access the State Beach. Mr. Seeley said that the other issue is that the residents are concerned about the design of the intersection at Breakwater Road and Carlsbad Boulevard. Mr. Seeley said that the residents had requested that another traffic study be done after Poinsettia Park was completely occupied. He noted that the study was issued in November 2002; however, the residents only received a copy on March 20, 2003. Mr. Seeley said there should be no further delay in installing the Knox-box. He noted that the La Costa April 22, 2003 Carlsbad City Council Meeting Page 5 Downs Master Plan calls for a gate to be installed when the Lanikai Lane Mobile Home Park had its own permanent access onto Carlsbad Boulevard. In response to Council, Bob Wojcik, Deputy City Engineer, reviewed pertinent sections of the La Costa Downs Specific Plan 201. He said that the according to the Specific Plan 201 , Ponto Drive/Surfside Lane connection is to be considered temporary until permanent access to Carlsbad Boulevard is constructed. Mr. Wojcik explained that in the future, the portion of Carlsbad Boulevard in front of Lanikai Lane Mobile Home Park, would be realigned. He said that if a traffic signal were installed at the entrance of Lanikai Lane Mobile Home Park, it would need to be removed and replaced during construction of the realignment of Carlsbad Boulevard. In response to Council, he discussed costs related to traffic signalization and road improvements. In response to Council, Bob Johnson, Deputy City Engineer, explained why the State Beach campground has the current configuration for the entrance. In response to Council, Mr. Johnson described the bus stop installed by North County Transit District near Lanikai Lane Mobile Home Park. Mr. Johnson also discussed several locations where a U-turn could be built that would be convenient for the State Beach campers. Ron Ball, City Attorney, explained that the item before Council this evening is to only receive and accept the report. Mr. Ball said upon Council’s direction, an item could be placed on a future agenda for Council’s direction and action. Council Member Kulchin said she would like to have a traffic study done during summer months, when the State Beach campgrounds are heavily used. Mayor Lewis said he would like to investigate the possibility of installing a traffic signal at the entrance of Lanikai Lane Mobile Home Park, even if it would need to be removed when Carlsbad Boulevard is realigned. He noted that the date of realignment is not known at this time and might not occur for many years. Mayor Lewis asked that other options be suggested to Council in the future. In response to Mayor Lewis, Mr. Johnson said that Surfside and Ponto are both public streets. Mr. Johnson said that staff would schedule a future Council Agenda Item to consider conducting a traffic signal warrant analysis at the Lanikai Lane Mobile Home Park main entrance, recognizing it is currently a “T” intersection; consider conducting traffic studies this summer on Carlsbad Boulevard; and, consider conducting an evaluation at Breakwater Road during the summer. Mr. Johnson also stated he could look at any options and bring them back. Council concurred with Mr. Johnson’s comments and accepted the report. April 22,2003 Carlsbad City Council Meeting Page 6 RECESS Mayor Lewis declared a recess at 752 p.m. Council reconvened at 8:OO p.m. with all members present. DEPARTMENTAL AND CITY MANAGEMENT REPORTS (CONTINUED) 8. AB #17,148 -ALGA NORTE COMMUNITY PARK AQUATICS COMPLEX MASTER PLAN Mayor Lewis asked that after hearing the report tonight, a Council Workshop be scheduled, and then an item be placed on a future agenda for Council action. John Cahill, Municipal Projects Manager, presented the staff report. Pat Caughey, representing Wimmer Yamada and Caughey, made a Power Point presentation (on file in the City Clerk's Office). Randy Mendioroz, representing Aquatic Design Group, reviewed the various design options discussed at the February 27, 2003 public workshop. Mr. Cahill explained staffs recommendation for Option No. 7. Mr. Cahill also explained the Parks and Recreation Commission Alternative. In response to Council, Carl Pope, Aquatics Supervisor, and Mr. Mendioroz explained how the user fee is implemented in several aquatic facilities that Council staff has visited throughout the State of California. Discussion between staff and Council ensued regarding alternative approaches to addressing the need for lifeguards, swimming teachers and concession stands. Mayor Lewis said he would like information regarding the management of the Mission Viejo Pool presented at the workshop. Julie Lantz, 2844 Wilson Street, spoke of the need for a pool complex. Preston Roadman, 3535 Simsbury Court, said he is a member of North Coast Aquatics and spoke of the need for a pool complex. Lisa Rodman, 3535 Simsbury Court, spoke of the need for a pool complex. She submitted correspondence from Ky Snyder, President, San Diego International Sports Council, expressing support for a multi-pool swimming complex in Carlsbad (on file in the City Clerk's Office). Jeffrey Lee, 4335 Trieste Drive, spoke of the need for a therapeutic pool. In response to Mayor Pro Tem Finnila, he said that therapeutic pools are usually maintained at a warm temperature. In response to Mayor Pro Tem Finnila, Mr. Mendioroz said that therapeutic pools are typically maintained between 88-92 degrees. April 22,2003 Carlsbad City Council Meeting Page 7 Bob Hoff, 1089 Evergreen Drive, Encinitas, 1089 Evergreen, Encinitas, said he is the Water Polo Coach at La Costa Canyon High School. He spoke of the need for a pool com p lex. Mayor Lewis said he felt that the community at large, not schools, should have first priority in using a community pool complex. Mike Anderson, 6546 Camino del Parque, said he is the UCSD Aquatic Supervisor. He spoke of the need for a pool complex in Carlsbad along with a spa Jacuzzi. Mr. Anderson noted that swim complexes quickly achieve maximum use, so he asked that a large pool complex facility be built. Spencer Rodman, 3535 Simsbury Court, spoke of the need for a pool complex in Carlsbad. Chris Lyle, 1030 Lighthouse Road, spoke of the need for a pool complex. Larry David, 7042 El Fuerte Street, read his comments into the record regarding the need for a pool complex (on file in the City Clerk's Office). Scott Pieratt, 7201 Manzanita Street, Parks & Recreation Commissioner, spoke in support of the Parks and Recreation Commission recommendation. He said that the complex should be built in one phase. Marlaine Hubbard, 3475 Corte Sonrisa, said she was speaking as a citizen of Carlsbad and not as a representative of the Parks & Recreation Commission. She said many people will be using the complex and the facility should be build for capacity. Robert Wren, 3342 Camino Coronado, said he is a member of North Coast Aquatics and spoke of the need for a pool complex. Council Member Hall asked that a discussion regarding concessions and cost recovery be held at the Council workshop. In response to Council Member Packard, Mr. Cahill said that the City employs enough staff to design parks in Carlsbad. He said the issue is identifying adequate financial resources for the actual park development. Ray Patchett, City Manager, explained that the City's financial forecasts did not anticipate the State's financial shortfall or that the State would take money away from municipalities. He said that staff would be returning to Council with a proposal to adopt one park per year in Carlsbad. Mr. Patchett said that during the Capital Improvement Program (CIP) discussions, Council could choose to amend the park development priorities. In response to Council, Mr. Patchett said that the schedule is for the CIP to be presented to Council on May 20th and the budget on June 3". He noted that on June 3rd, Council would also be presented with revenues, expenditures and the IO-year forecast. Final action on the CIP is scheduled for June 17'h. April 22,2003 Carlsbad City Council Meeting Page 8 Mayor Pro Tem Finnila summarized Proposition C, approved on the November 5,2002 ballot, and said that it does not require all facilities to be built right away. She expressed concern that the State of California would probably take municipal funds over the next two or three years to address their own budget needs. Council Member Kulchin said that many recreation facilities have been built in Carlsbad. She noted that costs for facilities could increase from the time of approval to the actual time of construction. Council Member Hall expressed concern that the amount of funds the State would take away from municipalities is currently unknown. He expressed concern that the maintenance of the aquatic complex will be challenging. Council concurred to direct staff to schedule a Council Workshop to discuss the Alga Norte Community Park Aquatics Complex Master Plan in more detail. Mayor Pro Tem Finnila said she and Council Member Kulchin would not be available for the May 2Ist Council Workshop. (It should be noted that after the April 22, 2003 Council Meeting, the Council Workshop was rescheduled for Monday, June 2, 2003.) Mayor Lewis said he does not want to phase the pool complex. 9. AB #17,149 -APPOINTMENT TO THE PARKS AND RECREATION COMMISSION Mayor Lewis requested that this item be continued. Council concurred. COUNCIL REPORTS AND COMMENTS: Council Member Packard said he would be attending a League of California Cities Meeting in San Marcos.
