CALL TO ORDER: Mayor/President Lewis called the Joint Special Meeting to order at
655 p.m.
ROLL CALL: The following Members were present:

Lewis, Finnila, Kulchin, Hall and Packard.
APPROVAL OF MINUTES:
On a motion by Mayor Pro TemNice President Finnila, minutes of the following meeting
were unanimously approved as presented:
Minutes of the Joint Special Meeting held November 4, 2003.
PUBLIC HEARING:
8. AB #17,378 -WATER AND SEWER MASTER PLANS UPDATES.
Steve Jantz, Associate Engineer; Elaine Blackburn, Senior Planner; Karen Svent,
Dudek and Associates; and, Shawn Shamlou, Project Manager, Dudek and Associates
reviewed staff report and a Power Point presentation (on file in the City Clerk’s Office).
Staff answered Council/Board questions regarding tanks near Blackrail Road and
Merkle Dam, use of the growth management database, and comments received from
Native American Representatives.
Mayor Pro TemNice President Finnila referred to the 84 individual sewer and water
improvement projects that have been identified for construction to accommodate
estimated future growth in the City. She said that the project to abandon nine water
wells should be returned to staff for further review. MayodPresident Lewis agreed.
In response to CounciVBoard, staff explained that water from the nine wells had been
tested and the water quality is irredeemable. Staff said that by abandoning the nine
wells, water rights would not be forfeited.

Ray Patchett, City Manager, said that he had received correspondence from the City of
Oceanside regarding the wells. (This correspondence is not on file in the City Clerk’s
Office). Bob Greaney, Deputy Public Works Director, explained that the City of
Oceanside has expressed concern regarding the impact the nine wells might have on
the groundwater.
CounciVBoard concurred to remove the abandonment of nine water wells from the
sewer and water improvement project and refer the matter back to staff to further
review.
In response to CounciVBoard, staff explained the mutual agreements with other
agencies. Staff said that abandoning the nine water wells would not impact the
connection fees.
MayodPresident Lewis opened the duly noticed public hearing at 7:26 p.m. and asked if
anyone wished to speak on this matter in any way.
Margaret J. Bonas, 231 Olive Avenue, spoke in support of unbundling the
abandonment of the nine water wells from the sewer and water improvement projects.
She suggested that public hearing notices regarding water issues be mailed with water
statements.
Seeing no one else wising to address CounciVBoard, MayorIPresident Lewis closed the
public hearing at 7:31 p.m.
ACTION: On a motion by Mayor Pro TemNice President Finnila,
CounciVBoard adopted RESOLUTION NO. 2003-301, Certifying a
Program Environmental Impact Report for the 2003 City of
Carlsbad Water and Sewer Master Plans Updates; and,
Adopted RESOLUTION NO. 2003-302, approving the 2003 City of
Carlsbad Sewer Master Plan Update and Approving a Change to
the City’s Sewer Service Capacity Fee; and,
Adopted RESOLUTION NO. 1194, Approving the 2003 CMWD
Water Master Plan Update and Approving a Change to the CMWD
Water Service Connection Fee; and,
Introduced ORDINANCE NO. NS-682, Amending Chapters 13.1 0
and 14.16 of the Carlsbad Municipal Code to Update and Revise
the Way in which Sewer Capacity and Water Connection Fees are
Adjusted; and,

Council directed staff to unbundle the abandonment of nine water
wells from the 84 individual sewer and water improvement projects
that have been identified for construction to accommodate
estimated future growth in the City and to return to staff for further
review the issue of abandonment of nine water wells.
