Lewis, Finnila, Kulchin, Hall and Packard. APPROVAL OF MINUTES: Council Member Kulchin stated she would abstain from approval of the minutes of the Regular Meeting held March 23, 2004 due to absence from the meeting. On a motion by Mayor Pro Tem Finnila, minutes of the following meetings were unanimously approved as presented: Minutes of the Regular Meeting held March 23, 2004. (Kulchin - Abstain) PRESENTATIONS: Council Member Kulchin presented a Proclamation in recognition of Arbor Week (April 1 gth thru April 23") to Michael Bliss of the Public Works Department. Council Member Packard presented a Proclamation in recognition of Public Safety Dispatchers Week (April 1 lth thru April 17th) to Debbie Grady, Police Department Communication Manager. CONSENT CALENDAR: ACTION: On a motion by Mayor Pro Tem Finnila, Council affirmed the action of the Consent Calendar, Items #I through #7, as follows: AYES: NOES: None. Lewis, Finnila, Kulchin, Hall and Packard. WAIVER OF ORDINANCE TEXT READING: Council waived the reading of the text of all Ordinances and Resolutions at this Meeting . April 13,2004 Carlsbad City Council Meeting Page 2 1. AB #I 7,579 - EMERGENCY COMMUNICATIONS FUNDING. Council adopted RESOLUTION NO. 2004-1 14, accepting State of California 9-1 - 1 Emergency Communications funding and appropriating funds for the upgrade of the 9-1 -1 communications equipment and services to maintain compliance with all 9-1-1 standards. 2. AB #17,580 - VACATION OF A PORTION OF CORlNTlA STREET - (STV 04-02) - CT 99-04-02. Council adopted RESOLUTION NO. 2004-1 15, summarily vacating a portion of Corintia Street and setting a public hearing for April 27, 2004. 3. AB #17,581 - FINAL MAP FOR CARLSBAD TRACT 99-04-02 -VILLAGES OF LA COSTA - THE RIDGE SUBDIVISION. Council adopted RESOLUTION NO. 2004-1 16, approving the final map for CT 99-04-02, Villages of La Costa-The Ridge, and authorizing the map to be recorded. 4. AB #17,582 - HOMELAND SECURITY OVERTIME PROGRAM. Council adopted RESOLUTION NO. 2004-1 17, accepting and appropriating the Homeland Security Overtime Grant Program Grant Funds to be used for homeland security overtime activities. 5. AB #17,583 - FINAL MAP FOR CARLSBAD TRACT 03-03 - BRESSI RANCH - PLANNING AREA 15. Council adopted RESOLUTION NO. 2004-1 18, approving the final map for CT 03-03, Bressi Ranch, Planning Area 15, and authorizing the map to be recorded. 6. AB #17,584 - FINAL MAPS FOR CARLSBAD TRACT 02-14 - BRESSI RANCH - PLANNING AREAS 6 THRU IO AND PLANNING AREA 12. Council adopted RESOLUTION NO. 2004-1 19, approving six (6) final maps for CT 02-14, Bressi Ranch, Planning Areas 6-10, and 12, and authorizing the maps to be recorded. 7. AB #17,585 - TERRACES AT SUNNYCREEK - WIDENING OF EL CAMINO REAL AND IMPROVEMENT OF COLLEGE BOULEVARD - PROJECT NO. CT 96-02. Council adopted RESOLUTION NO. 2004-1 20, accepting the construction of Terraces at Sunnycreek, widening of El Camino Real and improvement of College Boulevard as complete and directing the City Clerk to record the Notice of Completion and release bonds appropriately. Mayor Lewis requested, and Council concurred that Item #IO be taken out of order and heard at this time. PUBLIC HEARING 10.AB #17,587 - LA COSTA CONDOMINIUMS - CT 02-28ISDP 03-18ICP 02-13IHDP 02-14 (CONTINUED FROM MARCH 23,2004). Saima Qureshy, Associate Planner and Bob Wojcik, Deputy City Engineer presented staff report. April 13,2004 Carlsbad City Council Meeting Page 3 They explained that the item had been continued due to issues with the noticing, and stated that twelve additional property owners had been sent notice of this meeting, and reported that staff recommends approval of this item as presented. Mayor Lewis opened the duly noticed public hearing at 6:11 p.m. and asked if anyone would like to speak. Evelyn Montalbano, 2404 La Costa Avenue came forward to address Council, and spoke in favor of having a traffic light installed during construction of this project. Council Member Hall inquired as to where Ms. Montalbano lives in relation to where the proposed traffic light would be installed. Ms. Montalbano responded that she lives approximately a block away. Council Member Kulchin stated that the proposed traffic light would face the existing residences, and expressed concerns regarding the effect of the lights and noise on the homes in the area. Bill Hoffman of Hoffman Planning Associates, 5900 Pasteur Court, Carlsbad, representing the applicant, came forward to inform Council that he was present to answer any questions regarding the project. Seeing no one else wishing to speak, Mayor Lewis closed the duly noticed public hearing at 6:15 p.m. Council Member Packard asked staff to clarify the two alternatives for improving the line of site. Mr. Wojcik stated that the two options were to require the installation of a right-turn lane or to re-design and relocate the retaining wall. He stated that moving the retaining wall back would increase the site distance from the original 510 feet to 575 feet, and explained that the existing Caltrans standard requirement is 508 feet. He noted that the re-design of the wall had been discussed with the applicant. Mayor Lewis asked staff to clarify how a signal would work at the proposed location. In response, Mr. Wojcik explained that if a signal were to be installed it would be a three-way signal, with split phased timing. Mayor Lewis suggested that having an additional lane for deceleration might improve safety. Mr. Wojcik responded that a deceleration lane could possibly cause a blind spot to those citizens attempting to exit the development. Mayor Pro Tern Finnila expressed support for the re-design of the retaining wall and landscaping height restrictions. Ms. Finnila also stated that she believes that a traffic signal is not needed at this time. April 13,2004 Carlsbad City Council Meeting Page 4 Council Member Kulchin stated that she could support a deceleration lane. Ms. Kulchin also stated that she does not believe that a traffic signal is necessary at this intersection. Council Member Hall stated that he could support a traffic signal, due to the topography of the site. Council Member Packard spoke in favor of the re-design of the retaining wall in order to increase the line of site. Mr. Packard stated that he would not support a deceleration lane or a traffic signal. Mayor Lewis concurred that a traffic signal is not necessary at this time. Mayor Lewis spoke in support of the re-design of the retaining wall and also in support of a deceleration lane. ACTION: On a motion by Mayor Pro Tem Finnila, Council adopted RESOLUTION NO. 2004-096, adopting a Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program and approving Tentative Tract Map (CT 02-28), Site Development Plan (SDP 03-1 8), Condominium Permit (CP 02-1 3) and Hillside Development Permit (HDP 02-1 4) as recommended for adoption and approval by the Planning Commission, as amended to provide for the redesign and relocation of the retaining wall would be re- designed, the re-evaluation of the need for a traffic signal in one year as required by Condition #56, and that a deceleration lane would not be included in the project requirements. AYES: NOES: None. Lewis, Finnila, Kulchin, Hall and Packard. ORDINANCES FOR ADOPTION: 8. AB #17,586 -AMENDMENT TO CALIFORNIA PUBLIC EMPLOYEES RETIREMENT SYSTEM (CALPERS) CONTRACT. City Attorney, Ron Ball titled the Ordinance. ACTION: On a motion by Mayor Pro Tem Finnila, Council adopted ORDINANCE NO. NS-701, amending the CalPERS contract impacting local miscellaneous members and authorizing the one percent (1 %) employee retirement contribution that results from implementation of the 3% @ 60 benefit to be deducted from each employee’s salary on a pre-tax basis. Socorro Rodriquez-Anderson, 3222 Roosevelt Street, Carlsbad came forward to address Council. Ms. Rodriguez-Anderson asked Council to consider allowing residential areas to be utilized for farmworker housing. City Attorney, Ron Ball titled the Ordinance. ACTION: On a motion by Mayor Pro Tem Finnila, Council adopted ORDINANCE NO. NS-702, approving a Local Coastal Program Amendment to amend Title 21 of the Municipal Code by amending Section 21.42.01 0 to allow consideration of Farmworker Housing by Conditional Use Permit. AYES: NOES: None. Lewis, Finnila, Kulchin, Hall and Packard. PUBLIC COMMENT: None. ADJOURNMENT TO JOINT SPECIAL MEETING OF THE CITY COUNCIL AND HOUSING AND REDEVELOPMENT COMMISSION Mayor Lewis adjourned to the Joint Special Meeting of the Housing and Redevelopment Commission at 6:43 p.m. with all members present. RECONVENE CITY COUNCIL MEETING Mayor Lewis reconvened the remainder of the City Council Meeting at 7:03 p.m. with all members present. RECESS: Mayor Lewis declared a recess at 7:03 p.m. Council reconvened at 7:08 p.m. with all members present. DEPARTMENTAL AND CITY MANAGER REPORTS: 12.AB #17,589 - TRAFFIC EVALUATION IN THE VICINITY OF THE LANIKAI LANE MOBILE HOME PARK. Bob Johnson, Deputy City Engineer presented staff the report and reviewed a Power Point presentation (on file in the City Clerk’s Office). Mr. Johnson reported that Dennis Stouffer of the State Parks Dept. was present to answer any questions from the Cou nci I. In response to Council inquiry, Mr. Johnson reported that the State has agreed to stagger the entry times to the park for the summer to lessen the traffic impacts, but that the State is not willing to redesign the park entrance. April 13,2004 Carlsbad City Council Meeting Page 6 Council Member Hall asked staff from which direction the Fire Department services approach Lanikai Lane Mobile Home Park. Fire Chief, Kevin Crawford answered that the response pattern that is used to get into Lanikai Lane will vary depending on what is deemed the most appropriate route (Le. the direction from which the Department is responding, the number of apparatus that are needed, and various other factors). Council Member Kulchin referenced a letter that had been received from Jack and Theresa Horak (on file in the City Clerk’s office) regarding emergency crews recently accessing Lanikai Lane Mobile Home Park from Surfside Lane. Citizens Richard Donahue, Roger Berry, Craig Sturges and Bill Wisener came forward to present a Power Point Presentation (copy of presentation is on file in the City Clerk’s Office) and spoke about their concerns as follows: Richard Donahue, 6480 Franciscan Road, Carlsbad urged Council to proceed with the installation of a Knox Box and gate per the conditions of SP-201. Mr. Donahue stated that the residents would like to still have pedestrian as well as bicycle access through the gate. Roger Berry, 6503 Surfside Lane expressed safety concerns regarding the traffic on Surfside Lane. Mr. Berry spoke in favor of the gate being installed. He added that, during peak periods, north bound travelers use Lanikai, Ponto, and Surfside to avoid the traffic signal at Island Way. Craig Sturges, 6477 Franciscan Road, Carlsbad spoke regarding the traffic patterns and speeding in the area. Mr. Sturges expressed support for installation of a Knox Box. Bill Wisener, 6497 Surfside Lane, Carlsbad spoke in support of the Knox Box and gate being installed at Ponto Drive as soon as possible. Mike Hollins, 6550 Ponto Drive #80, Carlsbad expressed concern regarding overloading the light at Breakwater Road. Mr. Hollins spoke of the need for installation of a light at the entrance to Lanikai Lane. Leslie Tanner, Lanikai Lane, Carlsbad expressed concern regarding traffic patterns in the area. She suggested that RVs be required to access the State Park by taking the Cannon Road exit from 1-5, rather than the Palomar Airport Road exit to alleviate traffic congestion on Carlsbad Boulevard. Ms. Tanner spoke in opposition to the Knox Box and the closure of Ponto Drive at Surfside. She recommended that if the street were to be closed, a Knox Box would be needed, one at each end of Ponto. Jack Horak, 6550 Ponto Drive #108, Carlsbad explained the need for safe ingress and egress to homes at Lanikai Lane. Mr. Horak distributed a map (on file in City Clerk’s office) that depicts the blind spot and topographical and vegetation issues near the park en trance. April 13,2004 Carlsbad City Council Meeting Page 7 Mr. Horak suggested the removal of two large palm trees would help with the line of site, and suggested that street lights be installed at the park entrance. He also supported the installation of two Knox Boxes at each end of Ponto Drive. Council Member Kulchin asked if Lanakai residents had discussed the need for installation of signs or lights at the entrance with the park owner . Mr. Horak responded that the lease holder has not been willing to install any type of improvements at the entrance to Lanikai Lane. Jerry Crean, 6550 Ponto Drive, Carlsbad spoke regarding traffic concerns, and the difficulty exiting the park onto north bound Carlsbad Boulevard. Mr. Crean said. that he was not in favor of a Knox Box being installed. Lester Coates, 6550 Ponto Drive #I 11, Carlsbad came forward to address Council. Mr. Coates spoke in opposition to the Knox Box installation. He stated that the Lanakai access to north bound Carlsbad Boulevard is dangerous and indicated that the traffic merge is complicated because of traffic and grade separation. Council Member Packard inquired regarding the ownership of the property where the palm trees are located. Mr. Johnson stated that he believes the trees are located in the public right-of-way. In response to Council Member Kulchin, Mr. Johnson explained that the tree removal process requires posting of notices and must go the Parks and Recreation Commission for review. He also confirmed that Ponto Drive is a public street. Mayor Pro Tem Finnila confirmed that the Knox Box would be pedestrian and bicycle friendly. She also suggested that staff provide information to the State regarding directing RV traffic to exit 1-5 at Cannon Road, rather than Poinsettia. Council Member Hall inquired as to the amount of traffic that can be accommodated at the Breakwater intersection, and the suggestion for the second Knox Box. Mr. Johnson responded that the intersection has some constraints, such as limited queing capacity and signal timing that could be adjusted. He stated that the suggestions for a second Knox Box is a good one, which would prevent cars from parking in the area if the road is closed. Ray Patchett, City Manager, requested that the questions regarding the palm trees, lighting at Lanikai Lane and the standing water on Ponto Drive be referred to staff for review. Ron Ball, City Attorney stated that another hearing would need to be scheduled for consideration of a second knox box. Council Member Hall spoke in support of improving line of site at entrance to Carlsbad Boulevard at Lanikai Lane. Mr. Hall also stated that he has concerns about if a Knox Box was going to be installed that there would actually need to be two installed. April 13, 2004 Carlsbad City Council Meeting Page 8 Council Member Packard spoke in support of deferring the construction of a right turn que lane on Carlsbad Boulevard southbound until after the summer to see if the State Park’s Department plan of staggering the entry times solves the traffic congestion problem. Mr. Packard also expressed his support for the construction of a Knox Box. Council Member Kulchin spoke in support of the Knox Box installation as well as a second Knox Box. Ms. Kulchin also concurred to wait until the State Park’s Department pilot program this summer can be analyzed. Council Member Finnila spoke in support of the Knox Box gate installation with the condition that it should be pedestrian and bicycle friendly. Ms. Finnila concurred that the construction of the right turn lane be deferred. Mayor Lewis stated that he could not support the Knox Box installation. ACTION: On a motion by Mayor Pro Tem Finnila, Council adopted RESOLUTION NO. 2004-122, as amended, directing staff to process for inclusion in the 2004-2005 Capital Improvement Program (CIP) the construction of a left-turn lane on northbound Carlsbad Boulevard at Breakwater Road, and directing the installation of an emergency gate with Knox Box lock on North Ponto Drive; and Council directed that the consideration of extending the right-turn- only lane on south bound Carlsbad Boulevard from Poinsettia Lane to Breakwater be deferred until after the State’s pilot program; and Council referred the matter of palm tree removal, line of sight issues, street light and flooding problems to staff for review and re corn mend at ion.
