CALL TO ORDER: Mayor Lewis called the Meeting to order at 6:OO p.m.
ROLL CALL was taken by the Assistant City Clerk as follows:
Present:
Absent: None.
Lewis, Finnila, Kulchin, Hall, and Packard.
PRESENTATIONS:
Mayor Lewis asked the representative of the San Diego County Fair to come forward to
address the Council. Jen Goody came forward to announce that the fair opens one
month from today, and that the theme for the 2004 San Diego County Fair is the “Dr.
Seuss Centennial Celebration”. She presented fair schedules and “Cat in the Hat” pins
to the Council Members.
Mayor Lewis presented a proclamation to Lloyd Hubbs, Public Works Director,
proclaiming May 16-24, 2004, National Public Works Week. Mr. Hubbs introduced
Jane Strommer, Environmental Programs Manager, and Ann McClain, Solid Waste
Manager, who presented a preview of the new Environmental Programs Website and
new logo, and presented T-shirts to the Council Members.
Mayor Lewis presented a proclamation to artist, Bill Lignante, thanking him for his eight
years of service on the Arts Commission. Mr. Lignante expressed gratitude for being
given the opportunity to assist the City.
CONSENT CALENDAR:
Item No. 2 was removed from the Consent Calendar by Council Member Finnila.
ACTION: On a motion by Mayor Pro Tem Finnila, Council affirmed the action of the Consent Calendar, Item #I, with the exception of #2, as
follows:

1. AB #17,625 - SUBMITTAL OF THE 2004-2005 CONSOLIDATED PLAN FOR
THE COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM.
Council adopted RESOLUTION NO. 2004-154, approving submittal of the 2004-
2005 Consolidated Plan for the City’s Community Development Block Grant
Program to the U.S. Department of Housing and Urban Development.
2. AB #17,626 -AMENDMENT TO AGREEMENT FOR NORTH AGUA
HEDIONDA INTERCEPTOR SEWER REHABILITATION - PROJECT NO. 3537.
This item was removed from the Consent Calendar.
ITEM REMOVED FROM THE CONSENT CALENDAR:
2. AB #17,626 -AMENDMENT TO AGREEMENT FOR NORTH AGUA
HEDIONDA INTERCEPTOR SEWER REHABILITATION - PROJECT NO. 3537.
Mayor Pro Tem Finnila stated that she had requested that the item be pulled so that
staff could report on the wall and trails near the lagoon that are included in this sewer
con st ruct ion project.
Terry Smith, Senior Civil Engineer, the project manager for the sewer project, explained
that the wall will not be higher than 2-3 feet. He stated that the wall will be built to
simulate boulders and will be used to replace typical shore protection, only in areas
where it is needed to protect the trail from eroding. He noted that the trail will be placed
behind the wall.
Liz Ketabian, Park Planner, explained that the “walkable” trail will be twelve feet wide
and constructed of decomposed granite, with main the access off Hoover Street. She
reported that the trail is identified in the Agua Hedionda Lagoon Local Coastal Plan,
and will connect with the trails along the eastern boundary of the lagoon. Ms. Ketabian
stated that the trail is planned to have future connection with Park Drive, El Camino
Real and Laguna Riviera Park, with possible future connection to the Agua Hedionda
Lagoon nature center.
Council Member Hall noted that the sewer line that is being replaced has been in place
for over 40 years.
ACTION: On a motion by Mayor Pro Tem Finnila, Council adopted
RESOLUTION NO. 2004-155, approving Amendment No. 4 to the
professional services agreement with Dudek and Associates, Inc.
for the North Agua Hedionda Interceptor Sewer Rehabilitation
Project.

PUBLIC COMMENT:
Norman Duncan, 701 3 Via Coello, Carlsbad, addressed Council regarding education
and raising awareness of elder abuse. Mr. Duncan reported that he has put together a
program to aid in prevention of elder abuse, and has received a grant from the Cable
Television Foundation. He stated that the 30-minute program will be broadcast on
cable television and will be available to community organizations to view. He reported
that a program and free concert will be held on May 18, 2004, from 530 - 7:30 p.m., at
the Ruby Schulman Auditoriuam, at the Dove Library, and will include a presentation by
Deputy District Attorney Paul R. Greenwood and entertainment by the Ronnie Lane
Quartet with Taryn Donath.
ADJOURNMENT TO HOUSING AND REDEVELOPMENT COMMISSION MEETING:
Mayor Lewis adjourned to the Special Meeting of the Housing and Redevelopment
Commission at 6:25 p.m., with all members present.
CONTINUATION OF CITY COUNCIL MEETING:
Mayor Lewis reconvened the continuation of the City Council Meeting at 7:20 p.m., with
all members present.
DEPARTMENTAL AND CITY MANAGER REPORTS:
3. AB #17,627 - DRAFT TRANSNET EXTENSION ORDINANCE AND
EXPENDITURE PLAN.
Bob Johnson, Deputy City Engineer, Transportation, presented a Power Point
presentation (on file in the City Clerks Office). Mr. Johnson explained that the
SANDAG Board, on Friday, May 14, 2004, will consider whether to place the proposed
Extension Ordinance on the ballot in November.
Mr. Johnson explained that the original Transnet Program was a twenty-year program
that will expire in 2008. He stated that the proposed Ordinance would continue the 1/2
cent sales tax for another forty years and would raise an estimated 14 billion dollars to
pay for highway, transit and local road improvements. Mr. Johnson explained that the
ballot measure would require a 2/3 vote of approval.
In addition, Mr. Johnson explained that the proposed Ordinance would require each
agency to establish and collect a $2,000 regional impact fee. He noted that certain
projects such as low cost housing and remodels would be exempt from the new fees.
Tom Condon, 2450 Mark Circle, Carlsbad addressed Council regarding the proposed
tax. Mr. Condon expressed concern about the tax extension, and stated his belief that
the proposed Ordinance provides developer subsidies. He stated that the taxpayers
need real improvements to the transportation system, not continuation of the status
quo.

Mayor Pro Tem Finnila stated that the proposed Ordinance is a consensus from
representatives through out the County. She explained that due to the approval of the
existing Transnet tax, 60 miles of freeways have been constructed and new rail service
has been added in San Diego County. She explained that the proposed extension
would not only provide billions in additional funding for transportation and provide for
regional comprehensive planning, but will now include environmental planning for
projects as well.
Mayor Lewis expressed support for the proposed Extension Ordinance. He stated that
Carlsbad already requires development to pay for impacts, and noted that the current
City fees exceed the proposed $2,000 traffic impact fee.
Council Member Packard expressed support for proposed Ordinance and the
comments by Ms. Finnila.
ACTION: On a motion by Mayor Pro-Tem Finnila, Council expressed
support for the Transnet Extension Ordinance and
Expenditures Plan proposed for the November, 2004
Election.

4. AB #I 7.628 - HISTORIC PRESERVATION COMMISSION APPOINTMENT.
ACTION: On a motion by Mayor Lewis, Council adopted
RESOLUTION NO. 2004-1 56, appointing Sue Ladouceur to
the Historic Preservation Commission.

5. AB #17,629 - PLANNING COMMISSION APPOINTMENT.
ACTION: On a motion by Mayor Pro-Tem Finnila, Council adopted
RESOLUTION NO. 2004-1 57, re-appointing Julie Baker to
the Planning Commission.
