Mayor Lewis, Mayor Pro Finnila, Council Members Kulchin, Hall and Pac ka rd . LEGISLATIVE INVOCATION was given by Pastor Stan Gold of the First Baptist Church of Carl s bad. PLEDGE OF ALLEGIANCE was led by Council Member Kulchin. PRESENTATION: Cheryl Ernst introduced the new Carlsbad Unified School District Superintendent Dr. John Roach. CONSENT CALENDAR: ACTION: On a motion by Mayor Pro Tem Finnila, Council affirmed the action of the Consent Calendar, Items #2 through #4 with the exception of Item #1 which was pulled for discussion. AYES: NOES: WAIVER OF ORDINANCE TEXT READING: Council waived the reading of the text of all Ordinances and Resolutions at this Meeting. 1. AB #17,664 - ACCEPTANCE OF A DONATION. irhis Item was removed fiom the Consent Calendar for dikcussion. 2. AB #17,665 - FINAL MAP FOR CARLSBAD TRACT 03-08, CARLSBAD OFFICE PARK. Council adopted Ri, approving the final map for CT 03-08, Carlsbad Office Park. 3. AB #17,666 - STREET LIGHTING AND LANDSCAPING DISTRICT NO. 1. Council adopted RESOLUTIO N NO. 2004-188, initiating proceedings for the annual levy of assessments and ordering the preparation of an Engineer’s Report for a special assessment district; and June 15,2004 CITY COUNCIL Page 2 Council adopted PESOLUTION NO. 189, approving the preliminary Engineer's Report for the annual levy of assessments within a special assessment district; and Council adopted JZESOLUTION NO. 190, declaring Council's intention to provide for an annual levy and collection of assessments in a special assessment district, and setting the public hearing for July 6, 2004. 4. AB #17,667 - STREET AND LANDSCAPING DISTRICT NO. 2. ITEM REMOVED FROM THE CONSENT CALENDAR: 1. AB #17,664 - ACCEPTANCE OF A DONATION. Jim Comstock and Alan Marblestone, representing the Carlsbad Arts Associates, presented Council with a donation of $23,200.00 from their group. ACTION: On a motion by Mayor Pro Tem Finnila, Council adopted RESOLUTION NO. 2004-186, accepting a donation from the Carlsbad Arts Associates for partial funding for: TGIF Jazz in the Parks Concert Series, Three Part Art Program, and Art at Jazz Program. z: INTROD 1. AB #17,668 - AMENDMENT OF THE CARLSBAD MUNICIPAL CODE TO BE IN COMPLIANCE WITH THE GOVERNMENT CODE. Assistant City Attorney Mobaldi titled the ordinance. ACTION: On a motion by Mayor Pro Tem Finnila, Council introduced ORDINANCE NO. NS-709, amending Sections 1.20.090 and 1.20.480 of the Carlsbad Municipal Code to bring these sections into compliance with the California Government Code requirement for a majority vote of the membership for all resolutions. AYES: Lewis, Finnila, Kulchin, Hall, Packard June 15,2004 CIW COUNCIL NOES: None. Page 3 ORDINANCE FOR ADOPTION: 2. AB #17,669 - DISSOLUTION OF MARATORIUM PROHIBITING ISSUANCE OF PERMITS FOR WIRELESS COMMUNICATION FACILITIES. ACTION: prohibiting the issuance of permits for the placement of wireless communication facilities in the public right-of-way and repealing Ordinance No. NS-690, which extended Ordinance No. NS-684. On a motion by Mayor Pro Tem Finnila, Council adopted repealing Urgency Ordinance No. NS-684 AYES: NOES: None. Lewis, Finnila, Kulchin, Hall, Packard PUBLIC CO MMENT: None. 3. AB #17.670 - BLUFFS - CT 02-10/SDP 03-03/CDP 03-35/HDP 02-09. Senior Planner Van Lynch and Associate Engineer John Maashoff presented the staff report. (The presentation is on file in the Office of the City Clerk). In response to Council, Mr. Maashoff described the alternative street design used within the project. He further stated that pedestrians would be able to travel via walkways within the project. In response to Council, Management Analyst Craig Ruiz described the criteria for “very low income” as $27,400/ year for a two-income household. He also explained about the terms and conditions for resale of the affordable housing in the first 15 years of ownership. Mr. Ruiz stated that the conditions are monitored by recordation of the deed of trust. The applicant, Mr. John Simon, 4737 Bryce representing Anastasi Development thanked staff for their work on the project. In response to Council, Mr. Simon stated that the pool would be gated and the access would be by a keyless pad. Mr. Simon further stated that he had talked to the surrounding home owners regarding the project. Mayor Lewis opened the duly noticed public hearing at 6:30 p.m.; seeing no one else wishing to testify, Mayor Lewis closed the public hearing at 6:31 p.m. In response to Council, Mr. Lynch stated that the colors of the project were earth tones. June 15,2004 CITY COUNCIL Page 4 ACTION: RESOLUTION NO. 2004-194, approving the Mitigated Negative Declaration, Mitigation Monitoring and Reporting Program, Tentative Tract Map, Condominium Permit, Site Development Plan, Coastal developments Permit and Hillside Development Permit to allow the construction of a 78-unit condominium project on 8 contiguous parcels, on property generally located on the north and east side of Harrison Street, west of Adams Street, and south of Chinquapin Avenue, in Local Facilities Management Zone 1. On a motion by Mayor Pro Tem Finnila, Council adopted AYES: NOES: None.
