HomeMy WebLinkAbout2005-03-18; City Council; MinutesMINUTES MEETING OF : DATE OF MEETING: March 18,2005 TIME OF MEETING: 12:OO Noon PLACE OF MEETING: CITY COUNCIL EMERGENCY MEETING 1635 Faraday, Room 173A CALL TO ORDER: Mayor Lewis called the Meeting to order at 12:lO p.m. ROLL CALL: was taken by the City Clerk, as follows: Present: Absent: None. Lewis, Hall, Kulchin Packard, Sigafoose PUBLIC COMMENT: None 1. AB#18,042 - LANDSLIDE IN THE AREA OF RANCHO SANTA FE ROAD AND AGUA DULCE COURT. City Attorney Ron Ball introduced the item. He spoke about the background of this item and the state of emergency at Agua Duke Court and old Rancho Santa Fe Road. Mr. Ball discussed Government Code 865-867. He stated that these sections provide immunity to public entities that undertake remedial action to abate earth movement or protect against the danger caused by earth movement without fear of incurring liability. Mr. Ball stated that Council would need to take action on the basis of expert opinion or other reasonable basis; determine the appropriate remedial action to halt, stabilize or abate the peril; and undertake remedial action. In response to Council, Mr. Ball stated that a simple majority vote is needed on this item. Also in response to Council, Mr. Ball stated that no preliminary vote is needed prior to holding an emergency meeting. Director of Public Works Lloyd Hubbs gave Council a briefing on the background of the Agua Duke Court landslide. Emergency Coordinator Dan Papp shared the current Southern California weather forecast. Mr. Papp stated that two inches of precipitation are predicted for the weekend. Mr. Hubbs noted that there was a need to stabilize the old Rancho Santa Fe Road and the utility lines underneath it. He asked if Council wanted to intercede at this time. In response to Council, Mr. Hubbs stated that he was currently in communication with the Agua Duke Court property owners. Using a City map, Skip Hamman, Deputy City Engineer, pointed out the three Agua Duke Court residences in danger at this time. Mr. Hamman also discussed the work performed at the site to date. Mr. Hamman stated that the approach to stopping further slides was to remove loose materials, re-compact and fill with reinforcement, add drainage and cover with plastic sheeting. Mr. Hamman displayed pictures of the effected site. In response to Council, Mr. Hamman stated that the foundations are still intact. Mr. Hubbs stated that, although there is no formal agreement at this time, the utility representatives, property owners, and the City staff have communicated regarding the plan. Mr. Hubbs shared the March 15, 2005, letter from Van Olin, Geo Engineer, regarding the state of emergency at the site. This letter is on file in the office of the City Clerk. In response to Council, Mr. Hubbs stated that the project would take a week or more to complete. In response to Council, Mr. Hubbs reiterated that all parties concur with the action plan. He further stated that he has drafted a cost sharing process for the work to be done. Mayor Lewis asked if any Council Member was in opposition to the emergency plan. ACTION: On a motion by Mayor Pro Tern Hall, Council adopted RESOLUTION NO. 2005-089, declaring abatement of impending peril and authorizing immediate expenditure of public money to safeguard life, health or property. - AYES: NOES: None Lewis, Hall, Kulchin, Packard, Sigafoose City Manager Ray Patchett noted that the City’s Emergency Operation Center is set up and ready to go should it be activated this weekend.
