HomeMy WebLinkAbout2006-04-25; City Council; MinutesMINUTES MEETING OF : CITY COUNCIL (Regular Meeting) DATE OF MEETING: April 25, 2006 TIME OF MEETING: 6:00 p.m. PLACE OF MEETING: City Council Chambers CALL TO ORDER: Mayor Lewis called the Meeting to order at 6:00 p.m. ROLL CALL was taken by the City Clerk, as follows: Present: Lewis, Hall, Kulchin, Packard and Sigafoose. Absent: None. PRESENTATIONS: Mayor Lewis presented a Proclamation in Recognition of National Volunteer Week to Sue Irey, Volunteer Coordinator. CONSENT CALENDAR: ACTION: On a motion by Mayor Pro Tem Hall, Council affirmed the action of the Consent Calendar, Items #1 through #6 as follows: AYES: Lewis, Hall, Kulchin, Packard and Sigafoose. NOES: None. WAIVER OF ORDINANCE TEXT READING: Council waived the reading of the text of all Ordinances and Resolutions at this Meeting. 1. AB #18.537 - AWARD OF CONTRACT. Council adopted RESOLUTION NO. 2006-104. accepting bids and awarding the contract to Romero General for construction of the concrete replacement at various locations in the Northwest Quadrant of the City, Project No. 6006, and appropriating funds. 2. AB #18.538 - AWARD OF CONTRACT. Council adopted RESOLUTION NO. 2006-105. accepting bids and awarding the contract to Commercial & Industrial Roofing, Inc., to furnish new roofs at four city structures, Contract No. PWS06-25FAC, and appropriating funds. April 25, 2006 Carlsbad City Council Meeting Page 2 3. AB #18.539 - NOTICE OF COMPLETION. Council adopted RESOLUTION NO. 2006-106. accepting the 2005 Pavement Overlay Project, Project No. 3667-11, as complete, and directing the City Clerk to record the Notice of Completion. 4. AB #18.540 - TREASURER'S REPORT. Council accepted the City Treasurer's report on the status of City investments as of March 31,2006. 5. AB #18.541 - REQUEST FOR OUT-OF-STATE TRAVEL. Council adopted RESOLUTION NO. 2006-107. approving out-of-state travel for three City employees to attend the Department of Justice's Weapons of Mass Destruction Incident Command class in Anniston, Alabama. 6. AB #18.542 - REQUEST FOR FINANCIAL ASSISTANCE. Council adopted RESOLUTION NO. 2006-108. approving a request to provide financial assistance from the Housing Trust Fund to 10 very low income homebuyers within the Bluffs residential development, CT 02-18/SDP 03-03, and authorizing the City Manager to prepare and execute the loan documents. ORDINANCES FOR ADOPTION: 7. AB #18.543 - CITY TREASURER COMPENSATION. Assistant City Attorney Jane Mobaldi titled the Ordinance. ACTION: On a motion by Mayor Pro Tern Hall, Council adopted ORDINANCE NO. NS-797. amending Section 2.08.020 of the Carlsbad Municipal Code to adjust the compensation of the City Treasurer effective January 1, 2007. AYES: Lewis, Hall, Kulchin, Packard, Sigafoose. NOES: None. 8. AB #18.544 - CITY CLERK COMPENSATION. Assistant City Attorney Jane Mobaldi titled the Ordinance. ACTION: On a motion by Mayor Pro Tem Hall, Council adopted ORDINANCE NO. NS-798. amending Section 2.08.030 of the Carlsbad Municipal Code to adjust the compensation of the City Clerk effective January 1, 2007. AYES: Lewis, Hall, Kulchin, Packard, Sigagoose. NOES: None. April 25, 2006 Carlsbad City Council Meeting Page 3 9. AB #18.545 - CAR COUNTRY SPECIFIC PLAN AMENDMENT. Assistant City Attorney Jane Mobaldi titled the Ordinance. ACTION: On a motion by Mayor Pro Tern Hall, Council adopted ORDINANCE NO. NS-799. amending the Car Country Specific Plan, SP 19(1) to allow modifications to the Car Country Specific Plan, and to consolidate SP 19 and SP 19(C) into one document. AYES: Lewis, Hall, Kulchin, Packard, Sigafoose. NOES: None. PUBLIC COMMENT: Michele Levy, 3021 Highland Drive, Carlsbad, addressed Council regarding the proposed ad hoc Committee. She expressed concerns regarding the amount of funding that has been approved for Committee expenses, and suggested that the funding would be better used for other things, such as street repair. Ron Alvarez, 354 Oak Avenue, Carlsbad, representing Concerned Citizens addressed Council. Mr. Alvarez reported that the Save the Strawberry and Flower Growing Fields Initiative has received signatures of more than ten percent of the registered voters of Carlsbad. He expressed concern that a Council sponsored ballot measure would split the votes in the November, 2006 election. Mr. Alvarez also stated that his group would not participate in the meetings of the ad hoc Committee. John Strayer, 2001 Cima Court, Carlsbad, representing Carlsbad Citizens for Usable Public Places addressed Council. Mr. Strayer thanked the Council for their willingness to have the initiatives studied and for their efforts to include both of the initiative groups, along with the landowners, farmers, and business community in the process. Mr. Strayer explained that his group's proposal would retain 60% of the area in open space, while providing a grand central park and community buildings. He stated that his group, CCUPP will hold a public workshop on Wednesday evening, at 7:00 p.m., at the Cole Library to discuss their initiative. RECESS: Mayor Lewis declared a recess at 6:20 p.m. Council reconvened at 6:26 p.m., with five Council Members present. ITEM TAKEN OUT OF ORDER: At the request of Mayor Lewis, Council by consensus, agreed to consider Item No. 10 at this time. April 25, 2006 Carlsbad City Council Meeting Page 4 DEPARTMENTAL AND CITY MANAGER REPORTS: 10. AB #18.546 - MIRA MONTE DRIVE BARRICADE DISPOSITION. Bob Johnson, Deputy City Engineer, presented the staff report and reviewed a PowerPoint Presentation (on file in the Office of the City Clerk). Mr. Johnson presented a chronology of the matter and displayed maps showing the location of the existing k-rail barricades. He also showed the locations of the elementary and middle schools and the portions of Tamarack Avenue, Foothill Avenue, and Mira Monte Drive that would be affected by additional traffic if the barricades were removed. Mr. Johnson stated that the traffic study performed by RBF Consulting projected that removal of the barricades would result in increased traffic volumes and significant impacts to Tamarack Avenue (N), Foothill Avenue, and Mira Monte Drive. Mr. Johnson also explained each of the six options (included in the Agenda Bill) for Council consideration. In response to Council inquiry, Mr. Johnson expressed support for the accuracy of the traffic study and explained the model that had been used to calculate the traffic volumes. He noted that traffic patterns would change if the barricades were removed, which would result in a traffic reduction on Lake Boulevard and College Boulevard, and a traffic increase on Tamarack Avenue (N), Foothill Avenue, and Mira Monte Drive (both in Carlsbad and Oceanside). Amy Mortensen, 3518 Knollwood Drive, Carlsbad addressed Council. She stated that the area is currently pedestrian friendly and expressed concern that, if the barricades were removed, the area would no longer be safe for the children who walk to school. John Quintana, 3541 Knollwood Drive, Carlsabd, addressed Council and requested that the barricades remain in place to ensure the safety of the children in his neighborhood. Thomas Dempsey, 3641 Esplanade Street, Oceanside, addressed Council in support of the removal of the barricades. Mr. Dempsey requested that an all-way stop be installed at the intersection of Mira Monte Drive and Foothill Avenue, and suggested that traffic engineers should determine if additional traffic calming measures would be needed. David Fandey, 3533 Knollwood Drive, Carlsbad, addressed Council and requested that the barricades remain in place. He expressed concerns regarding the safety of children in the area due to the increased traffic that would result if the barricades were removed. Gary Schultze, 3514 Knollwood Drive, Carlsbad, addressed Council and requested that the barricades remain in place. Jackie Bynagte, 3908 Stoneridge Road, Carlsbad, addressed Council and requested that the barricades remain in place. Ms. Bynagte, who is a school crossing-guard expressed concern that removal of the barricades would result in increased traffic in the area and unsafe conditions for the school children. April 25, 2006 Carlsbad City Council Meeting Page 5 Jeff Clark, 3982 Foothill Avenue, Carlsbad, addressed Council and requested that the barricades not be removed. He expressed concerns that removal of the barricades would result in increased traffic in the area. Richard Shea, 3932 Plateau Place, Carlsbad, addressed Council and requested that the barricades remain in place. Kayla Hatchett, 3620 Seacrest Way, Oceanside, addressed Council. Ms. Hatchett, who is a fifth grade student at the elementary school, requested that the barricades be removed and that Mira Monte Drive be opened. Marilyn Shea, 3932 Plateau Place, Carlsbad, addressed Council requesting that Mira Monte Drive remain closed. She expressed concerns regarding increased traffic and safety incidents that would occur if the barricades were removed. Ms. Shea also expressed support for the installation of a three to four foot fence with access for emergency vehicles. Corrine Perez Garcia, 4016 Alto Street, Oceanside, addressed Council and requested that the barricades be removed, noting that Mira Monte was designed to be a through street. Ms. Garcia also stated that approximately one-half of the students at the Calavera Hills schools are Oceanside residents. Steve Landis, 3965 Foothill Avenue, Carlsbad, addressed Council and thanked them for requesting the traffic study. Mr. Landis expressed concerns regarding traffic congestion and pedestrian safety issues that would result from removal of the barricades on Mira Monte. He expressed support for the installation of a fence with an emergency access gate. Sue Landis, 3965 Foothill Avenue, Carlsbad, addressed Council on behalf of Joe Zyburt, and requested that the barricades remain in place. She stated that removal of the barricades would result in both increased traffic and higher speed traffic, which would not be appropriate on residential streets. Ms. Landis stated that installation of traffic calming measures would simply move the traffic to other nearby streets. Allen Amster, 3970 Foothill Avenue, Carlsbad, addressed Council and requested that the barricades not be removed. Doug Foote, 3999 Foothill Avenue, Carlsbad, addressed Council regarding the barricades. Mr. Foote stated that this matter is a public safety issue, and that the residential streets in that area will not be able to safely handle the traffic increase that is projected by the study. He requested that Mira Monte Drive remain closed to vehicular traffic, but that emergency and pedestrian access be allowed. Tom Ahrendt, 3971 Plateau Place, Carlsbad, addressed Council and expressed opposition to the removal of the barricades. April 25, 2006 Carlsbad City Council Meeting Page 6 In response to Council inquiry, Mr. Johnson explained that Option #5 would provide wheelchair and emergency access. He noted that the proposed Opticom feature would automatically open the gate for emergency vehicles. Council Member Sigafoose thanked those who had addressed the Council regarding this matter. She expressed support for Option #5 due to safety concerns. Council Member Packard stated that, due to the results of the traffic study, he could not support removal of the barricades and the opening of Mira Monte Drive. He expressed support for Option #5. Council Member Kulchin also thanked the public for attending the meeting. She indicated her support for Option #5 and requested that pedestrian access be included. Mayor Pro-Tern Hall expressed support for Option #5. He noted that his decision not to support the opening of Mira Monte Drive is based on the results of the traffic study and City traffic circulation standards. Mayor Lewis also expressed support for Option #5. He stated that opening Mira Monte Drive would result in an unacceptable increase in traffic on that street, which is not designed as a major arterial. ACTION: On motion by Mayor Pro-Tern Hall, the City Council selected Option #5, and directed staff to replace the existing temporary barricade with a fence and a gate accessible only to pedestrian and wheelchair access, and to emergency vehicles using the Opticom system emitter. AYES: Council Members Lewis, Hall, Kulchin, Packard, Sigafoose. NOES: None. RECESS: Mayor Lewis declared a recess at 7:51 p.m. Council reconvened at 7:59 p.m., with five Council Members present. RECONVENE CITY COUNCIL MEETING Mayor Lewis reconvened the City Council Meeting at 8:27 p.m., with five City Council Members present. This item was taken out of order and considered following Public Comment. COUNCIL REPORTS AND COMMENTS: Mayor Lewis and Council Members reported on activities and meetings of some committees and sub-committees of which they are members. CITY MANAGER COMMENTS: None.
