HomeMy WebLinkAbout2008-07-15; City Council; Minutes (2)MINUTES MEETING OF: CITY COUNCIL (Regular Meeting) DATE OF MEETING: July 15, 2008 TIME OF MEETING: 6:00 p.m. PLACE OF MEETING: City Council Chambers CALL TO ORDER: Mayor Lewis called the Meeting to order at 6:00 p.m. ROLL CALL was taken by the City Clerk, as follows: Present: Lewis, Kulchin, Hall and Nygaard. Absent: Packard. LEGISLATIVE INVOCATION: Father William Rowland of St. Patrick's Church gave the Legislative Invocation. PLEDGE OF ALLEGIANCE: Council Member Matt Hall led the Pledge of Allegiance. APPROVAL OF MINUTES: On a motion by Mayor Pro Tern Kulchin, the minutes of the following meetings were approved as presented: Minutes of the Special Meeting held June 17, 2008. Minutes of the Joint Special Meetings held June 17, 2008. Minutes of the Regular Meeting held June 17, 2008. CONSENT CALENDAR: ACTION: On a motion by Mayor Pro Tem Kulchin, Council affirmed the action of the Consent Calendar, Item Nos. 1 and 2 as follows: AYES: Lewis, Kulchin, Hall and Nygaard. NOES: None. ABSENT: Packard. WAIVER OF ORDINANCE TEXT READING: Council waived the reading of the text of all Ordinances and Resolutions at this Meeting. 1. AB #19.512-APPROVE RATIFICATION OF REIMBURSEMENT AGREEMENT WITH TECHBILT CONSTRUCTION CORPORATION. Council adopted RESOLUTION NO. 2008-208. approving the ratification of a reimbursement agreement with Techbilt Construction Corporation for Planned Local Drainage Area Facility "BP" along La Mirada Creek at Faraday Avenue, Project No 3622. July 15, 2008 Carlsbad City Council Meeting Page 2 2. AB #19.513 -APPROVE PURCHASE CONTRACT OF POLICE COMMAND POST VEHICLE AND AUTHORIZE OUT-OF-STATE TRAVEL. Council adopted RESOLUTION NO. 2008-209. approving the purchase contract of a Police Command Post Vehicle from Farber Specialty Vehicles, and authorizing out-of- state travel to Ohio for design, construction inspection and vehicle pick-up. ORDINANCES FOR INTRODUCTION: 3. AB #19.514 - AMENDMENT TO CARLSBAD MUNICIPAL CODE TO PROHIBIT SMOKING IN CITY PARKS. BEACHES AND TRAILS. Michael Caraglio, Carlsbad, came forward to address Council. He thanked Council for moving forward with the proposed ban on smoking at City parks, beaches and trails. Candice Porter, San Dieguito Alliance for Drug Free Youth, spoke in support of the proposed ban on smoking at City parks, beaches and trails. Ms. Porter suggested that Council eliminate from the Ordinance the phrase, "Smoking prohibited except in designated areas," as this language could create confusion. Judi Strang, North Coastal Council Parent Teacher Association, also spoke in support of the proposed Ordinance banning smoking at City parks, beaches and trails. City Attorney Ron Ball titled the Ordinance. ACTION: On a motion by Mayor Pro Tern Kulchin, Council introduced ORDINANCE NO. NS-894. amending Section 11.32.010 of the Carlsbad Municipal Code and adding Section 11.32.110 to prohibit smoking in City parks, beaches and trails. AYES: Lewis, Kulchin, Hall and Nygaard. NOES: None. ABSENT: Packard. 4. AB #19.515- REPEALING AND ADOPTING CHAPTER 3.28 OF THE CARLSBAD MUNICIPAL CODE REGULATING PURCHASING . Colette Wengenroth, Finance Manager, presented the staff report and reviewed a Power Point Presentation (on file in the Office of the City Clerk). Ms. Wengenroth explained that staff is recommending a change to Section 3.28.040 (c)(2) of the proposed Ordinance as follows: "All Capital Outlay Items approved by the City Council during the budgeting process regardless of the dollar amount, unless otherwise directed by City Council." Council Member Hall stated that he had concerns regarding Section 3.28.040 of the proposed Ordinance which outlines how Capital Improvement Projects are awarded. Because of the time required to review these items, Council Member Hall requested that the proposed Ordinance be continued to the next Regular Meeting. Council concurred to continue the item to the Regular Meeting of July 22, 2008. July 15, 2008 Carlsbad City Council Meeting Page 3 5. AB #19.516 - ESTABLISH A NO PARKING ZONE ON A PORTION OF CAMINO DE LOS COCHES. City Attorney Ron Ball titled the Ordinance. ACTION: On a motion by Mayor Pro Tern Kulchin, Council introduced ORDINANCE NO. NS-895. amending Title 10, Chapter 10.40, of the Carlsbad Municipal Code by the addition of Section 10.40.131 to declare a No Parking Zone on the southerly side of Camino de Los Coches from Rancho Santa Fe Road to its intersection with Maverick Way. AYES: Lewis, Kulchin, Hall and Nygaard. ABSENT: Packard. NOES: None. PUBLIC COMMENT: Michele Levy, Carlsbad, came forward to address Council. She spoke in support of the development of a Master Plan for the Carlsbad Fire Department. Helen Nielsen-Eckfield, Carlsbad, spoke in support of the Slow Down-Save Gas-Curb Global Warming Program. She explained that this has been an ongoing program with Carlsbad and San Marcos High Schools to focus attention on the benefits of driving 55 miles per hour on freeways. Richard Eckfield, Carlsbad, also spoke in support of the Slow Down-Save Gas-Curb Global Warming Program. Mr. Eckfield asked Council to direct Carlsbad Police Department to monitor Interstate 5 to enforce the posted speed limit of 55 miles per hour. Mr. Eckfield also suggested that Council post signage at the Carlsbad city limits stating that posted speed limits are strictly enforced (Handouts on file in the Office of the City Clerk). In response to an inquiry from Council Member Hall, Mr. Eckfield shared the findings of a Federal Government study that compared fuel efficiency at various freeway speeds. Mr. Eckfield explained that the study indicated that driving 60 miles per hour could result in significant savings for drivers. ADJOURNMENT TO THE JOINT SPECIAL MEETING OF THE CITY COUNCIL AND CARLSBAD MUNICIPAL WATER DISTRICT Mayor Lewis adjourned to the Joint Special Meeting of the City Council and Municipal Water District at 6:36 p.m. with four Council Members present. RECONVENE CITY COUNCIL MEETING Mayor Lewis adjourned the Regular Meeting of the Housing and Redevelopment Commission and reconvened the City Council Meeting at 7:13 p.m. with four Council Members present.
