MEETING OF: CITY COUNCIL (Special Meeting)
DATE OF MEETING: April 14, 2009
TIME OF MEETING: 5:00 p.m.

CALL TO ORDER: Mayor Lewis called the Meeting to order at 5:01 p.m.
ROLL CALL was taken by the Deputy City Clerk as follows:
Present: Lewis, Kulchin, Hall, Packard and Blackburn.
Absent: None.
PUBLIC COMMENT ON AGENDA ITEM:
Ann Hallock, Carlsbad, came forward to address Council. Ms. Hallock provided Council
with an aerial photograph of the property formerly owned by Hanson Aggregates known
as the Quarry Creek property (on file in the Office of the City Clerk) and expressed
concerns relating to the inclusion of the property in the Housing Element. Ms. Hallock
explained that due to a fuel leak beneath the surface of the land, the soils at the site are
contaminated. In conclusion, she stated that although remediation measures have
been taken to make the soil safe, there is a potential that the soil remains hazardous
and for this reason the site should not be included in the City's Housing Element.
The Council adjourned into Closed Session at 5:08 p.m.
1. GOVERNMENT CODE SECTION 54956.9(b). The City Council hold a closed
session to discuss significant exposure to litigation regarding the Housing Element.
The Council reconvened at 6:00 p.m. with five members present. Mayor Lewis announced
that the Council heard the information and instructed staff and the attorney regarding the
item.
ADJOURNMENT:
By proper motion, the Special Meeting of April 14, 2009 was adjourned at 6:02 p.m.
