HomeMy WebLinkAbout2009-11-03; City Council; Minutes (4)MINUTES MEETING OF: CITY COUNCIL (Regular Meeting) DATE OF MEETING: November 3, 2009 TIME OF MEETING: 6:00 p.m. PLACE OF MEETING: City Council Chambers CALL TO ORDER: Mayor Lewis called the Meeting to order at 6:00 p.m. ROLL CALL was taken by the City Clerk, as follows: Present: Lewis, Kulchin, Hall, Packard and Blackburn. Absent: None. LEGISLATIVE INVOCATION: Mayor Lewis offered the Legislative Invocation. PLEDGE OF ALLEGIANCE: Mayor Pro tern Kulchin led the Pledge of Allegiance. PRESENTATIONS: Council Member Packard presented a Proclamation in recognition of the Carlsbad Winter Music Celebration to a representative of the La Jolla Symphony and Chorus, and Nancy Laturno Bonajic, Executive Director of Mainly Mozart. Diane Salisbury, Executive Director of La Jolla Symphony and Chorus was also present to receive the Proclamation. Ms. Salisbury announced a Messiah Sing along being presented on December 13, 2009 at Saint Elizabeth Seton Catholic Church in Carlsbad. Council Member Hall presented a Proclamation in recognition of National Hospice and Palliative Care Month to Debra Hubbard, representing Hospice of the North Coast. CONSENT CALENDAR: ACTION: On a motion by Mayor Pro Tern Kulchin, Council affirmed the action of the Consent Calendar, Items 1 through 7 as follows: AYES: Lewis, Kulchin, Hall, Packard and Blackburn. NOES: None. WAIVER OF ORDINANCE TEXT READING: Council waived the reading of the text of all Ordinances and Resolutions at this Meeting. 1. AB #20.025 - ACCEPTANCE OF DONATION. Council adopted RESOLUTION NO. 2009-274. accepting a donation from the Carlsbad Library and Arts Foundation for cultural programming in the Ruby G. Schulman Auditorium; and, authorizing the appropriation of funds. November 3, 2009 Carlsbad City Council Meeting Page 2 2. AB #20.026 -APPROVE MEMORANDUM OF UNDERSTANDING. Council adopted RESOLUTION NO. 2009-275. approving a Memorandum of Understanding with the Carlsbad Unified School District for the School Resource Officer Program. 3. AB #20.027 -APPROVE MEMORANDUM OF UNDERSTANDING. Council adopted RESOLUTION NO. 2009-276. approving a Memorandum of Understanding with the San Dieguito Unified School District for the School Resource Officer Program. 4- AB #20.028 - APPROVE AMENDMENT TO CAPITAL IMPROVEMENT PROGRAM. Council adopted RESOLUTION NO. 2009-277. approving an amendment to the Capital Improvement Program to include the El Camino Real and College Boulevard Intersection Improvement Project. 5. AB #20.029-APPROVE POLICE DEPARTMENT'S PARTICIPATION IN HOMELAND SECURITY OPERATION. Council adopted RESOLUTION NO. 2009-278. approving the Police Department's participation in Operation Stonegarden, a program of the U.S. Department of Homeland Security; and, authorizing the appropriation of funds for anti-smuggling operations. 6. AB #20.030 - REPORT ON CITY INVESTMENTS. Council accepted the City Treasurer's Report on City Investments as of September 30, 2009. 7. AB #20.031 - CONTINUE DECLARATION OF LOCAL EMERGENCY. Council adopted RESOLUTION NO. 2009-279. continuing the Declaration of Local Emergency of October 1, 2009, for the repair of a sewer main spill at 2402 Tamarack Avenue. ORDINANCE FOR ADOPTION: 8. AB #20.032 - AMEND THE CARLSBAD MUNICIPAL CODE REGARDING THE PROHIBITION OF DEPOSITING HANDBILLS ON VEHICLES IN PARKING LOTS. City Attorney Ron Ball titled the Ordinance. ACTION: On a motion by Mayor Pro Tem Kulchin, Council adopted ORDINANCE NO. CS-068. amending Section 8.28.055 of the Carlsbad Municipal Code regarding the prohibition of depositing handbills on vehicles in parking lots: AYES: Lewis, Kulchin, Hall, Packard and Blackburn. NOES: None. November 3, 2009 Carlsbad City Council Meeting Page 3 PUBLIC COMMENT: Russ Hanthorn, representing Rotary Club of Carlsbad, came forward to address Council. Mr. Hanthorn stated that the Rotary Club of Carlsbad and the Carlsbad Army and Navy Academy are hosting a Wreath Laying Ceremony and Corp Cadet Military Review in recognition of Veteran's Day. He also invited Council and the community to attend the event, which will take place on the football field at the Army Navy Academy on Carlsbad Boulevard, on November 11, 2009 at 10:30 am. Richard Eckfield, Carlsbad, came forward to address Council. Mr. Eckfield spoke in support of requiring the 22nd Agricultural District, owners of the Del Mar Fairgrounds, to construct a seasonal rail platform train stop at the Del Mar Fairgrounds to mitigate increased traffic during horse racing season, (Handout on file in the Office of the City Clerk). Council Member Hall requested that the item be put on a future City Council agenda. Tom Watson, representing the Mitchell Thorp Foundation, came forward to address Council. Mr. Watson invited Council and the community to attend the 1st Annual Mitchell Thorp Walkathon on January 23, 2010. Mr. Watson stated that proceeds from the event will benefit Carlsbad High School students Chase Quarterone and Sam Reiser, who are battling cancer. He also stated that registration and donation information is available at www.mitchellthorp.com. (Handout on file in the Office of the City Clerk). Diane Nygaard, representing Preserve Calavera, came forward to address Council. Ms. Nygaard invited Council and the community to help plant trees at the Buena Vista Biological Preserve on Saturday, November 14, 2009 from 9 to 11:30am. Peter Mac Laggen, representing Poseidon Resources, came forward to address Council. Mr. Mac Laggen stated that a Coastal Development permit from the California Coastal Commission has been obtained for the Carlsbad Desalination Project. He stated pre- construction activity will begin next week with project completion anticipated by the middle of 2012. DEPARTMENTAL AND CITY MANAGER REPORTS: 9- AB #20.033 - PRESENTATION FROM CITIZEN ON TRAIL SAFETY ENFORCEMENT. Fred Sandquist, President of the Batiquitos Lagoon Foundation, reviewed a PowerPoint Presentation (on fife in the Office of the City Clerk), regarding options available to enhance trail safety enforcement in Carlsbad. Police Chief Tom Zoll came forward to address Council. Chief Zoll stated that the Police Department will increase its patrolling of trails through March 2010 to better evaluate trail safety. In response to Council inquiry, Parks Planner Liz Ketabian stated that Trail Captains are volunteers who are assigned to monitor trails for maintenance issues. The following individuals came forward to address Council and spoke in support of trail safety enforcement: Donald Stapp, Mark Abel and Diane Nygaard. Council received the presentation. November 3, 2009 Carlsbad City Council Meeting Page 4 10. AB #20.034 -ADVERTISE FOR BIDS FOR JOINT FIRST RESPONDERS TRAINING FACILITY. Special Projects Director Skip Hammann and Deputy City Engineer Bill Plummer reviewed a PowerPoint Presentation (on file in the Office of the City Clerk). Council discussion ensued regarding operating costs of the training facility. Council Member Packard stated that he supports the building of the training facility but disagrees with the proposed business model. He stated that he would support a joint venture with other agencies to fund the project. ACTION: On a motion by Mayor Pro Tem Kulchin, Council adopted RESOLUTION NO. 2009-280. approving the plans and specifications and pre-qualifications of contractors seeking to bid on the Joint First Responders Training Facility; and, authorizing the City Clerk to advertise for bids, Project No. 3686 as follows: AYES: Lewis, Kulchin, Hall, Packard and Blackburn. NOES: None. COUNCIL REPORTS AND COMMENTS: Mayor Lewis and Council Members reported on activities and meetings of some committees and sub-committees of which they are members.
