HomeMy WebLinkAbout2009-12-01; City Council; Minutes (2)MINUTES JOINT MEETING OF: THE CARLSBAD CITY COUNCIL AND HOUSING AND REDEVELOPMENT COMMISSION (Joint Special Meeting) DATE OF MEETING: December 1, 2009 TIME OF MEETING: 6:00 p.m. PLACE OF MEETING: City Council Chambers CALL TO ORDER: Mayor/Chair Lewis called the Joint Special Meeting to order at 6:09 p.m. ROLL CALL: was taken by the Assistant City Clerk, as follows: Present: Council/Commission Members Lewis, Kulchin, Hall, Packard and Blackburn. Absent: None. PUBLIC HEARING: 12. AB #20.054 - EXTEND URGENCY ORDINANCE RELATING TO A MORATORIUM ON POWER PLANTS IN THE COASTAL ZONE. Senior Planner Christer Westman gave the Staff Report and PowerPoint Presentation (on file in the Office of the City Clerk). Mayor/Chair Lewis opened the duly noticed Public Hearing at 6:15 p.m. Ronald Rouse from Luce, Forward, Hamilton and Scripps, representing NGR and Cabrillo Power I, came forward to address the Council/Commission. Mr. Rouse stated he would like to reintroduce the letter he submitted to Council during the October 20, 2009 meeting along with a letter submitted to the Council/Commission at tonight's meeting. Mr. Rouse said that the California Energy Commission issued its final staff assessment endorsing the Carlsbad Energy Center Project, and the San Diego Air Pollution Control District issued its final compliance certificate in November. He added that the proposed project fulfills the long range vision for the site, allows for the retirement of the three less efficient boiler units at the existing facility, provides a smaller footprint and lower profile, and the proposed project's placement will permit the future development of approximately 60 acres west of the railroad tracks. Julie Baker representing Vision of Power came forward to address the Council/Commission. Ms. Baker stated she felt the siting of two power plants on the coast in Carlsbad was unacceptable. She said there is no guarantee if, and when, the existing Encina Power Plant will be demolished. Mr. Baker urged the Council/Commission to continue the moratorium. Kerry Siekman of Carlsbad came forward to address the Council/Commission. Ms. Siekman spoke in support of the City extending the moratroium. Mayor/Chair Lewis closed the Public Hearing at 6:25 p.m. City Attorney/General Counsel Ron Ball explained that the action taken by the Council/Commission during this meeting authorizes land use review of the entire Coastal zone. ACTION: On a motion by Mayor Pro Tern Kulchin, Council introduced and adopted ORDINANCE NO. CS-070. extending Urgency Ordinance No. CS-067, prohibiting new or expanded thermal electric power generation facilities within the Coastal Zone; and, Adopted RESOLUTION NO. 2009-299. directing city staff to study and consider amendments to the Land Use Element of the General Plan, Zoning Ordinance and other regulations pertaining to the location and operation of thermal electric power generation facilities within the city. AYES: Lewis, Kulchin, Hall, Packard and Blackburn. NOES: None. ACTION: On a motion by Vice Chair Kulchin, the Commission adopted RESOLUTION NO. 479. authorizing the Planning Director on behalf of the Redevelopment Agency to study and consider amendments to the Land Use Element of the General Plan, Zoning Ordinance and other regulations pertaining to property within the South Carlsbad Coastal Redevelopment Area and other areas of the city, as related to the appropriate locations for, and operation of, thermal electric power generation facilities. AYES: Lewis, Kulchin, Hall, Packard and Blackburn. NOES: None.
